Financial crime in Japan takes a major toll on both individual victims and the nation’s economy. This paper focuses on large investment frauds that have occurred from post-war Japan to the present as well as financial crimes that involve racketeers of boryokudans, or organized crime groups, more commonly known as yakuza. Major financial offending by organized crime groups include: yamikin (loan sharks), sokaiya (shareholders who extort corporate funds), jiageya (“land sharks” who frighten tenants into vacating properties), and new forms of yakuza money crime that constitute significant challenges to enforcement. The paper concludes that more comprehensive legislation that applies to all forms of investment fraud is needed in order to stem the tide of white-collar crime in Japanese society.  相似文献

Abstract

While ASEAN played the leadership role for erecting the ASEAN Regional Forum (ARF), Japan generated positive impact on the historical trajectory leading to the birth of the ARF. This paper asks the following question: On what ideational foundation was Japan's support for the ARF based? Utilizing a conceptual framework based on the theoretical literature of multilateralism, the paper analyzes three major Japanese perspectives on the ARF in the inception years (1991–95) — Idealism, Realism, and Liberalism — while paying special attention to Liberalism, the perspective underlying Japan's actual policy. Liberalism, while leaning toward Realism, still incorporated some elements of Idealism. For Liberals, centering around the Ministry of Foreign Affairs, the ARF was a vehicle to foster a sense of trust, however fragile, on the basis of providing and sharing quality information about China, Japan, and the United States, without undermining the existing security arrangements including the US‐Japanese alliance.  相似文献

A solid-phase microextraction (SPME) procedure involving direct contact between the SPME fibers and the solid matrix and subsequent gas chromatography/mass spectrometric analysis for the detection of accelerants in fire debris is described. The extraction performances of six fibers (100 mum polydimethylsiloxane, 65 mum polydimethylsiloxane-divinylbenzene, 85 mum polyacrylate, 85 mum carboxen-polydimethylsiloxane, 70 mum Carbowax-divinylbenzene, and 50/30 mum divinylbenzene-Carboxen-polydimethylsiloxane) were investigated by directly immersing the fibers into gasoline, kerosene, and diesel fuel. For simulated fire debris, in the direct contact extraction method, the SPME fiber was kept in contact with the fire debris matrix during extraction by penetrating plastic bags wrapping the sample. This method gave comparable results to the headspace SPME method in the extraction of gasoline and kerosene, and gave an improved recovery of low-volatile components in the extraction of diesel fuel from fire debris. The results demonstrate that this procedure is suitable as a simple and rapid screening method for detecting ignitable liquids in fire debris packed in plastic bags.  相似文献

Using hitherto underutilized Japanese material, this paper systematicallyanalyzes two competing theories of military doctrine formation thataccount for the construction of the 1976 National Defense ProgramOutline (NDPO), postwar Japan’s first military doctrine.It demonstrates that, on balance, available evidence on thepolicy preference of two key civilian policymakers, Michio Sakataand Takuya Kubo, is more consistent with the interpretationdrawn from Posen’s balance-of-power theory than with thatfrom Kier’s domestic culturalist theory. While by no means ignoredby these policymakers, domestic political concerns neither dominantly shaped,nor gave a specific direction to their policy action. Rather,the policymakers were motivated to formulate the best responsepossible to Japan’s new international strategic conditions.This finding relates the hitherto neglected significance ofthe NDPO case to the larger, ongoing realist–constructivistdebate on the formation of military doctrine. It also leadsus to a more sophisticated understanding of NDPO formation,which focuses on the process of how a combination of politicalleadership and ideas triggered the breakthrough in Japanesesecurity policymaking.  相似文献

Antidepressant discontinuation syndrome (ADS) occurs after abrupt discontinuation of an antidepressant medication. A 23‐year‐old man with right hippocampal agenesis demonstrated sexual crime (hypersexuality) since the age of eight and had been successfully treated with carbamazepine since the age of 13. He had required increased doses of paroxetine and carbamazepine owing to the development of an unstable affect after quitting his job. He abruptly stopped taking his medication for 3 days and his criminal behaviors re‐emerged. We examined changes in brain structure and activity before and after medication cessation, using MRI and functional MRI (fMRI). The image of a girl in a swimsuit increased activity in the thalamus only after medication discontinuation. The alteration in thalamic activity might induce hypersexuality. We conclude that a primary hypersexuality had been suppressed with carbamazepine and paroxetine treatment, and the discontinuation of the medication caused the hypersexuality.  相似文献

The recent domestic constructivist studies characterize Japanese security policy as a serious anomaly to realism and a crucial case vindicating their approach to the larger study of world politics. The present paper challenges this view. It advances a postclassical realist interpretation of Japan's core security policy in the past quarter century. Japan's military doctrine expressed in the 1976 National Defense Program Outline (NDPO) is consistent with postclassical realism's predictions, as opposed to neorealism's predictions, which focus on the dynamics of the regional security dilemma and the question of financial burden resulting from military build-up. In addition, postclassical realism offers a more compelling theoretical guide for understanding Japan's core security policy than defensive realism or mercantile realism. This paper backs up its argument with the empirical evidence that Takuya Kubo, the author of the NDPO, himself intentionally based the NDPO on a postclassical realist line of thinking.  相似文献

Abstract

This article fills the void left by the existing literature that has failed to capture the utilities of the ASEAN Regional Forum (ARF) to the member states. From a rational institutionalist perspective, this article argues that the ARF is an institutional solution for a particular type of collective-action problem – the Assurance Game – that emerged in the post-Cold War Asia-Pacific region. In the Assurance Game, a weak and loose institution is sufficient because cooperation only requires efficient information transmission among players. This conception of the ARF finds empirical support in various features as well as the birth process of the multilateral institution. Thus, neither structural realists' skepticism nor constructivists' romanticism toward the ARF is warranted.  相似文献

In Japan, taxed diesel fuel from non-taxed fuel oil-A is illegally produced by removing coumarin, which is added as a non-taxed marker. The coumarin is removed using concentrated sulfuric acid and this produces a high viscosity and hazardous material, called "sulfuric acid pitch", as a by-product. This compound has a detrimental effect on the environment and is hazardous to humans. The actions have been associated with organized crime with the illegally gained taxes becoming financial bases. To discriminate legal and diesel oil from illegal product, the peak area ratio R(SC), the ratio of total sulfur to carbon (>C(14)), was used. R(SC) is calculated by the total areas of sulfur and carbon (>C(14)) from the gas chromatogram obtained by gas chromatography-atomic emission detection (GC-AED). Sulfur in legal diesel fuels is strictly regulated by a maximum limit, which was 50ppm (and is now 10ppm), but in the preparation of illegal diesel oil, in which coumarin is eliminated, sulfur cannot be removed. Therefore, the R(SC) of fuel oil-A and illegal fuel oil is over 15, whereas those for legal fuel oil and diesel fuel are under 2.0. Furthermore, these ratios do not change in weathering experiments. GC-AED was applied to an actual arson case and was found to be effective for the determination of total sulfur in trace amounts of accelerants detected in fire debris at the arson scene, and hence was effective for the characterization of the ignitable liquids used.  相似文献
