我国加入WTO对政府职能转变提出了更为迫切的要求。政府转移出来的职能 ,一部分需要中介组织来承接。对于我国中介组织发展中存在的问题 ,解决的关键在于深化改革     

Bushwhacking the Democratic Peace

The invasion of Iraq has been justified, ex post , as for the purpose of promoting the democratic peace. It does not, however, appear to have been a principal goal ex ante . Most democratic peace theorists, moreover, do not endorse democratic regime change by great-power external military intervention. Success is difficult to achieve (usually at high cost), and the conditions in Iraq were not promising even had the occupation been carried out more competently. Greater success in democratization has been achieved by UN peacekeeping operations, and by various regional international organizations using a variety of peaceful measures to ensure free elections, constrain authoritarian leaders, and empower democratic forces. International organizations, notably those whose membership is largely composed of democracies, are especially likely to succeed in promoting democracy.     

NGOs and Ethnic Conflict: Lessons from the Work of the Project on Ethnic Relations in the Balkans

This article examines the impact of nongovernmental organization-sponsored contact and communication on fostering peaceful solutions to ethnic conflict via case studies of the activities of the Project on Ethnic Relations (PER) in Romania, Macedonia, Montenegro, Kosovo, and Serbia. It explores five operational principles that guide PER activity: creating credible, neutral forums for dialogue; maintaining momentum; working within political realities; encouraging indigenous solutions from within existing processes; and acting with the backing of powerful states. These principles explain PER's success as a "weak mediator" of ethnic conflicts. According to this analysis, PER also exhibits organizational characteristics that contribute to success, including nonpartisanship, area expertise and extensive networks of local contacts, and an ability to secure the trust of local actors.
A significant indicator of the success of PER activities is the establishment by conflicting parties of institutionalized mechanisms for addressing their differences. Contrary to the view that electoral competition contributes to conflict, this study finds that the possibility of achieving an electoral advantage by participating cooperatively in conflict resolution activities creates incentives for local actors to recognize opportunities offered by PER activities and leads local actors to heed PER's advice. Finally, the article offers a cautionary observation. While PER's perceived influence with major international actors may contribute to its local successes, once a state actor with the power to impose a solution has committed itself to ending a conflict, its preferences outweigh any local interests in determining the outcome and renders the efforts of a "weak mediator" such as PER irrelevant.     

论贿赂外国公职人员或国际公共组织官员罪

贿赂外国公职人员或国际公共组织官员罪是《联合国反腐败公约》规定的一类新型犯罪。对这一犯罪,可以从贿赂对象、贿赂范围、贿赂对价、贿赂方式和贿赂领域五个方面加以理解。我国刑法在规定这一犯罪时,应注意刑法与《公约》的协调,立法上注意与我国刑法中“国家工作人员”概念之转换,司法上注意与国外贿赂犯罪的规定相协调;刑事管辖权上应当以属地管辖原则为主,辅之以属人管辖;法定刑的设置应以有期徒刑为处罚方式,并可以适用罚金刑。     

Putting Local Associations Into their Context. Preliminary Results from a Swiss Study of Local Associations

The paper presents results from the Swiss case of the European comparative project CID (Citizenship, Involvement, Democracy). This project examines the relationship between political institutional assets and civic and political engagement in several Western and Eastern European countries. The paper seeks to investigate how civic engagement can be generated and shaped by a given institutional and political context as well as by a peculiar community size. The central hypothesis is that the context affects the character of local participation. To verify this, the papers examines two different Swiss cantons: the German speaking Canton of Bern and the French speaking Canton of Vaud. Moreover, for each canton, four local communities of different size have been selected. This research design discusses how participation is fostered by a more open political opportunity structure (the German canton), and how this combines with the size of the community.

基于农村合作经济组织立法的必要性与紧迫性 ,农村合作经济组织应采取分业立法模式 ,分别立法 ,重点是制定单独的《农业专业合作社法》 ,并明确农业专业合作社的法律地位 ,合作社设立、变更与撤销 ,合作社管理 ,合作社成员的权利和义务 ,合作社产权及盈余分配制度等。     

公共组织的分形结构与公共政策变动的结构性社会振荡

公共组织机构有它非线性的表现。运用自然科学的分形理论能够发现公共组织机构设置的分形结构,并可以在此基础上引出公共政策变动所引起的结构性社会振荡的内在机理。     

Race and the City: Neighborhood Context and the Development of Generalized Trust

Previous research has indicated that socio-economic and racial characteristics of an individual's environment influence not only group consciousness and solidarity, but also affect his or her views toward minority or majority groups. Missing from this research is a consideration of how context, social interaction, and interracial experiences combine to shape more general psychological orientations such as generalized trust. In this study we address this gap in the literature by conducting a neighborhood-level analysis that examines how race, racial attitudes, social interactions, and residential patterns affect generalized trust. Our findings suggest not only that the neighborhood context plays an important role in shaping civic orientations, but that the diversity of interaction settings is a key condition for the development of generalized trust.     

领导干部“主动辞职”现象研究

文章对领导干部“主动辞职”现象进行了探讨,认为这种现象引发社会注目有“主动辞职”行为的超前性、彻底性、趋利性和群体的特殊性四方面的原因;产生“主动辞职”行为有行为主体———“主动辞职”者自身、行为客体———党政部门、行为所处的社会环境三方面的原因。同时,文章指出应从正视现象、提升规范、反思党政机关自身三方面积极应对领导干部“主动辞职”现象。     

证券投资纠纷仲裁问题研究

证券投资纠纷仲裁是一项重要的纠纷解决制度。采用仲裁方式不但可以方便、快捷、高效地解决证券投资纠纷,还可以为双方当事人保守商业秘密,是适合我国证券市场健康发展、保护中小投资者权益的最佳选择。重构我国证券投资纠纷的仲裁体制,由中国证券业协会负责筹建解决证券纠纷的行业仲裁委员会,是完善我国证券投资纠纷仲裁制度的必由之路。
