对悲剧性命运的超越--勇气与希望的美学意义

对自由、理想、完美、永恒的渴求，是人类存在的根本，人类自诞生之日起，就开始为之奋斗不息，这一贯穿整个人类历史进程的渴求，似乎离人越来越远。面对人的悲剧命运的被动存在，是勇气和希望给了人以超越的精神。艺术总是时时不忘将勇气和希望带给处于困境中的人们，把人类的所有渴求都展现在了它的世界里。     

为什么我们没有“新闻法”———反思我国新闻传播立法研究

我国改革开放以来的新闻立法历经30多年至今未果,无论法治社会的内在要求还是传媒领域的现实发展,都表明了迫切的新闻立法诉求。在“新闻法”尚不能出台的众多复杂原因中,学术研究的偏颇却总是被忽略,研究方法的迷失带来学理探讨的浅尝辄止,宏观研究的乏善可陈,以及学科之间的壁垒隔膜。其背后透露出不容回避的学术勇气的不足和技术细节研究的缺乏。基于新闻传播法学理论建设的推进和现实新闻传播立法的需求,应首先在思想和理论上明确：新闻自由是谁的自由,谁可以办报,如何协调采访报道和国家公权力的关系等问题,同时必须关注新闻传播立法技术的研究,如舆论监督的规范体系,为新闻来源保密的规则归属等细节问题。     

论孔子思想中的“勇”

在孔子的思想体系中,"知""仁""勇"是并重的。不过,长期以来,人们对孔子思想中的"勇"关注不够。"仁"是核心,源于人心,其实"勇"也源于人心,它需要以"知"为前提,以"礼"、"义"为限度。作个纵横比较则更有意思,孔子之"勇"和柏拉图有相近之处,它也是孟子和荀子之"勇"的源头。     

Courage,regulatory responsibility,and the challenge of higher‐order reflexivity

Contemporary regulators must respond to ever‐increasing societal demands in various domains. Regulators must cope with these demands under conditions of extreme epistemic scarcity and ideological divide. This leaves regulators perplexed about what action they should take. Regulatory praxis offers two primary responses to this moral and epistemic dilemma: technical canonization and reflexive regulation. While these two approaches represent contrary regulatory philosophies, they suffer from two common blind spots: (a) disregard of the critical role of discretionary judgment in regulatory action; and (b) disregard of the dilemma of higher‐order reflexivity. The article explores the idea of higher‐order reflexivity in the regulatory context. This exploration renders visible the abysses that are faced by regulators as they attempt to resolve regulatory dilemmas through a cognizant and introspective process. The article argues that the Socratic concept of courage and the idea of forward‐looking responsibility provide a plausible framework for thinking about the challenge of regulatory judgment. It concludes with a discussion of the legal and institutional mechanisms that could both facilitate and put to scrutiny the realization of this ideal (but noting also several features of the contemporary regulatory system which constitute potential barriers).     

Interrupting the Myth of the <Emphasis Type="Italic">Partage</Emphasis>: Reflections on Sovereignty and Sacrifice in the work of Nancy,Agamben and Derrida

Agamben traces the bio-political essence of modern politics to the non-sacrificial killing of Homo Sacer in Roman law. Nancy, on the other hand, links the history of Western politics to the fundamental logic of sacrifice in Western metaphysics. He nevertheless contemplates the possibility that Western societies may finally have arrived at the threshold of a non-sacrificial existence. Derrida seeks to resist the sacrificial logic of Western metaphysics and politics, but nevertheless appears to accept it as an irreducible fact of human co-existence. Unlike Nancy, he envisages no actual or actualised beyond beyond the realm of sacrificial metaphysics and politics. He thus can be said to interrupt Nancy’s ‘myth’ of a non-sacrificial partage. This article compares these three philosophical stances in the hope of throwing more light on the role of sacrifice in the law and politics of our time. Professor of Law, Rand Afrikaans University. 比较中美两国对"好撒马利亚人"立法的历史、发展及现状,可以看到我国对见义勇为进行立法保护和救济的迫切性。尤其在赋予见义勇为者有限的豁免权、加强对见义勇为者的权益保护及如何救济方面,我国需要进行明确立法,避免"英雄流血又流泪"事件的发生。     

"肝胆皆冰雪"--宋代词人张孝祥人格精神评议

张孝祥是南宋初期词坛上影响较大的一位词人。在南宋民族矛盾沉重的特定历史时期,他主张抗金爱国,表现出坚定执著的政治信念;他不与投降派同流合污,又表现出鲜明的是非观念。同时他还以爱国之情抒以忠诚正义之志气,以恬淡之笔表达豪迈旷远之情怀。“肝胆皆冰雪”是他一生人格精神的写照。从他的事迹和创作中,我们可以体味到诗品与人品一致之关系。     

Dominion Cartoon Satire as Trench Culture Narratives: Complaints,Endurance and Stoicism

Abstract

Although Dominion soldiers’ Great War field publications are relatively well known, the way troops created cartoon multi-panel formats in some of them has been neglected as a record of satirical social observation. Visual narrative humour provides a ‘bottom-up’ perspective for journalistic observations that in many cases capture the spirit of the army in terms of stoicism, buoyed by a culture of internal complaints. Troop concerns expressed in the early comic strips of Australians, Canadians, New Zealanders and British were similar. They shared a collective editorial purpose of morale boosting among the ranks through the use of everyday narratives that elevated the anti-heroism of the citizen soldier, portrayed as a transnational everyman in the service of empire. The regenerative value of disparagement humour provided a redefinition of courage as the very act of endurance on the Western Front.
