20世纪 80年代初期以来 ,许多发达国家公共部门的管理在发生巨大的变化。这不仅仅是一种形式上的变革或管理风格的细微变化 ,而是在政府的社会角色下政府与公民关系方面所进行的改革。本文回顾了公共行政发展演变之路 ,希望能有益于社会转型之中的中国各级政府。     

French engagement versus British commitment. Was it interlingual miscommunication or political manipulation?

ABSTRACT

The efforts undertaken to establish the contemporary European Union started many years earlier. The history of establishing a pan-European organization is interesting not only for historians and economists but also translators and linguists as it is the history of interlingual communication (negotiations and agreements). One such negotiation was allegedly ineffective due to the difference in understanding the French term engagement and its English equivalent employed by translators and interpreters, that is to say the English term commitment. The authors aim at presenting the political background of negotiations and the social semiotic analysis of the terms in question in order to provoke the reader to find the answer to the question whether the negotiation was broken due to interlingual miscommunication resulting from erroneously chosen equivalent or it was destined to failure from the very beginning due to socio-political and economic interests of negotiating parties. In order to achieve that goal, the authors have analysed notes exchanged between the governments of France and Great Britain in course of negotiation. The history of negotiation and the linguistic analysis are combined to illustrate the complexity of meaning construction and the semiotic implications of the contextual dependence of meanings of terms and their dynamic evolution in time and space.

Bugs,predations or manipulations? Incompatible epistemic regimes of high-frequency trading

Abstract

Calls for greater transparency as well as corporate and individual accountability have emerged in response to the recent turbulence in financial markets. In the field of high-frequency trading (HFT), suggested solutions have involved a call for increased market information, for example, or better access to the inner workings of algorithmic trading systems. Through a combination of fieldwork conducted in HFT firms and discourse analysis, I show that the problem may not always stem from a lack of information. Instead, my comparative analysis of different market actors (regulators, market analysts and traders) shows that the diverse and complex ways in which they access and construct knowledge out of information in fact lead to what I call different epistemic regimes. An understanding of how epistemic regimes work will enable us to explain not only why the same market event can be viewed as very different things – as market manipulation, predation or error – but also why it is so difficult to arrive at a unified theory or view of HFT. The comparative perspective introduced by the idea of epistemic regimes might also serve as a starting point for the development of a cultural approach to the study of financial markets.     

Subjects with agency? Children’s participation in family law proceedings

Galvanised by the UN Convention on the Rights of the Child, many jurisdictions now recognise children’s rights to participate in decisions that affect them. While such legal rights have increased, research on family law proceedings shows how children’s views can still be undermined, ignored or not even sought in decisions about them. This article uses the academic resources of childhood studies, to consider dominant and alternative narratives of children’s participation within Scottish family law. Drawing upon reported case law and empirical research, the article concludes that children’s participation gains protection by being institutionalised but children’s participation is attenuated because it is not recognised as relational and contextual. As rationality, consistency and autonomy are privileged, the weight given to children’s views is lessened by concerns about children being manipulated or distressed. Courts and their decisions may be child-focused, centring on children’s welfare, but they are not child-inclusive, involving children in decision-making.     

Perceived threat of crime,authoritarianism, and the rise of a populist president in the Philippines

President Duterte of the Philippines implemented an open “war” on drugs based upon claims of an over-proliferation of illegal drugs in the country. Despite summary killings of suspected users and dealers, Duterte enjoys popular support among Filipinos. This paper assesses reasons behind the support using citizens’ perceptions of the severity of the drugs/crime problem, their punitiveness, and authoritarian attitudes as explanations. A sample of 114 Filipinos across Luzon, Visayas and Mindanao responded to an electronic survey about socio-legal issues. Results show that drugs/crime are perceived as serious problems nationally yet only minor problems locally. This perceived national seriousness is significantly related to support for Duterte. Trust in the law and enforcement agents, an authoritarian attitude, and region are also strongly related to support for Duterte. This paper concludes with reflections on information manipulation as means to advance political ends and the importance of context in furthering theories of authoritarian submission.     

利用足迹自动识别系统对现场足迹进行图像处理

针对现场足迹的特点,在足迹自动识别系统原理的基础上,分析研究影响足迹图象质量的各种因素,并就这些不同原因,给出有效的足迹图象处理方法。结果表明,利用足迹自动识别系统对现场足迹进行处理,可以得到较高质量的足迹图象。同时,相比较其他图象处理方法,该方法简单、方便,具有较好实用性和可操作性,从而提高了现场足迹的利用率。     

On arbitration,arbitrage and arbitrariness in financial markets and their governance: unpacking LIBOR and the LIBOR scandal

Abstract

Amongst a series of scandals to hit international financial markets in recent years, that surrounding the London Interbank Offered Rate (LIBOR) – a highly influential interest rate benchmark – has attracted particularly intense media scrutiny. This paper seeks to push beyond conventional understandings to unpack critically both LIBOR itself and the scandal involving its manipulation by major international banks. Envisioning LIBOR as a commodity beset by inherent contradictions, the paper mobilizes the tropes of arbitration, arbitrage and arbitrariness to illuminate, respectively: the market-making work performed by LIBOR; its role in enabling the transfer of financial risk, most notably when fraudulently manipulated; and the nature of the regulatory prosecution of such manipulation.
