新时代我国现代化产业体系构建的工业化逻辑及其实现路径

现代化产业体系是现代化经济体系的重要组成部分,是指产业发展的新型化、产业结构的高级化、产业发展的集聚化和产业竞争力的高端化。从新时代经济发展的现实状态来看,我国现代化产业体系的构建必须坚持工业化的逻辑。坚持工业化逻辑就是要防止过度去工业化,从新兴产业的新动能培育与传统产业的新旧动能转换两条路径入手,以新型工业化、再工业化、继续工业化及工业现代化为基本逻辑,在坚持把实体经济做优做强的基础上,通过创新为我国工业化发展提供核心动力,进而构建我国新时代的现代化产业体系。现代化产业体系构建的工业化逻辑的实现需要发挥现代信息技术对产业发展的渗透作用,以信息化带动传统产业的现代化,加快战略性新兴产业的发展;推进供给侧结构性改革,积极培育现代化产业体系的新动能;推动消费结构升级,积极培育未来新产业的发展;完善支持体系,创造现代化产业体系构建的环境。     

人民币国际化背景下汇率对工业行业就业的影响——基于跨境贸易结算的影响因素视角

将跨境贸易人民币结算比重引入劳动力市场动态均衡模型,推导出汇率影响就业的全新路径,并利用2000-2018年中国工业行业面板数据进行实证分析。研究发现:通过进出口产品结构贸易路径,汇率对行业总体就业的正向影响最显著,其次是经由汇率变动预期路径,而汇率通过净出口指数路径对就业的负向影响较微弱。人民币汇率对不同行业就业的影响产生差异的根源是不同行业进出口产品结构及产品异质性的差距导致在汇率变动的不同情形下,行业间跨境贸易人民币结算的水平不同,从而造成外贸企业对劳动力的需求具有差异。并且,技术特征及贸易来源地特征是造成行业间就业水平差异的显著因素。     

贵州黔东南苗族聚落仪式与公共空间研究

位于黔东南山地地区的苗族聚落因其特殊的地貌形态和文化渊源,形成了各类与平原聚落不同的、极具特色的公共空间。论文通过文献研究与实地走访调查,总结黔东南苗族聚落中的公共空间类型与特色,并探究其由内在的文化联系而形成的序列结构。黔东南苗族聚落的公共空间可分为生产空间、交通空间和仪式空间三类,其中仪式空间最具特色。黔东南苗族聚落的公共空间布局灵活自由,形态因地制宜;各类公共空间为鼓藏节、招龙节等重要仪式活动提供场所,作为历史的象征连通古今;模拟历史演变的仪式活动串联起各类公共空间,形成连通村落内外、村落之间的公共空间序列,对民族文化的传承和构建起到积极作用。     

Maltreatment and Family Dysfunction in Childhood and the Subsequent Adjustment of Children and Adults

The adjustment problems associated with sexual abuse, physical abuse, psychological maltreatment, neglect, and witnessing family violence during childhood were examined in three studies. Study 1 demonstrated significant overlap between maltreatment types in parent reports (N = 50) of maltreatment experiences of their child aged 5–12 years. Parental sexual punitiveness, traditionality, family adaptability and family cohesion significantly predicted scores on 4 maltreatment scales and children's externalizing behavior problems. Level of maltreatment predicted internalizing, externalizing, and sexual behavior problems. In Study 2, significant overlap was found between adults' retrospective reports (N = 138) of all 5 types of maltreating behaviors. Parental sexual punitiveness, traditionality, family adaptability, and family cohesion during childhood predicted the level of maltreatment and current psychopathology. Although child maltreatment scores predicted psychopathology, childhood family variables were better predictors of adjustment. Study 3 demonstrated that child maltreatment scores predicted positive aspects of adult adaptive functioning (N = 95).

Seeing the improvement of the criminal trial structure from China’s criminal courtroom arrangements (tribunal design)

The setting of criminal court has become an important representation of the criminal trial structure due to its visual and vivid reflection of the legal position and relations among the three parties of litigation, i.e. the prosecuting party, the advocating party and the judge. As a result of the influence of ancient “inquest” centered trial mode, lack of the defendant’s right to silence and incomplete revolution of the criminal trial mode, the existing criminal court setting features an umbrella shaped structure. To reform the criminal trial structure in China, we should eliminate the air of “inquest” from the existing court interrogation mode, strengthen the hearing of evidence and set up a equiangular triangle shaped trial structure of neutral trial, equality between the prosecuting and advocating parties and litigant oriented. __________ Translated from the Jurist Review, 2005, (2) (in Chinese)     

Fundamental principles of the international protection system of intellectual property rights and the applications

Legal principle, which underlies the value of the legal system, is supposed to be the origin and basis of concrete legal rules. It has also resulted from abstracting and summarizing the value and spirit of these legal rules. In light of the universality and hierarchy of legal principle, the principles of the international protection system of intellectual property rights (IPR) can be divided into the following two types: one is the fundamental principles applied to the what, why and how a legal system shall be constructed, such as principles of sovereignty, equality and mutual benefit, joint development, and international cooperation, which also can be expressed as the principles of sovereignty, international coordination and cooperation, fairness and justice. The other type includes those existing in the legal system and capable of being applied directly, such as the principle of national treatment, principle of minimum standard, principle of independence (for industrial property right), principle of independent protection (for copyright), principle of compulsory implementing patent (for patent right) and doctrine of priority (for industrial property right), etc. In my opinion, the principles of the international protection system of IPR shall follow the latter model, indicating that they shall be provided and written in the international conventions on the grounds that they can be applied directly, and that they can be universally applied to the whole international protection system of IPR instead of exclusive application to one certain system. Hereupon, the author believes that principles concerning the international protection system of IPR should include the principles of national treatment, minimum protection standard and public interest.
