试论我国发行CDR的法律障碍及其解决对策

CDR是指在香港及海外上市的公司,想在中国境内证券市场筹集资金或流通其股份而设计出的一种新的金融产品。它的发行对我国投资者、上市公司和国内资本市场具有积极意义。本文探讨了拟议中CDR发行的法律障碍,并为我国推出CDR提出了若干建议。     

An investigation into the accuracy of follow-on GPRS/mobile data CDRs

This study investigated the accuracy of 3G and 4G follow-on GPRS (General Packet Radio Service)/mobile data CDRs (Call Detail Records) from three UK mobile network operators (EE, Vodafone and Three). Follow-on GPRS/mobile data CDRs are currently considered to be more open to misinterpretation than voice/SMS CDRs as uncertainties exist regarding the correspondence between the timestamp and the Cell ID presented within the CDRs. Consequently, follow-on GPRS/mobile CDRs may be disregarded during criminal investigations, potentially losing valuable intelligence and evidence. To assess the accuracy of follow-on GPRS/mobile data CDRs, connected mode RF (Radio Frequency) surveys were conducted while simultaneously producing follow-on GPRS/mobile data CDRs in a travelling vehicle. This allowed a comparison of the start Cell ID presented in the CDR and the Cell ID that provided coverage to the device at the start time of the CDR to assess the correspondence between the timestamp and the Cell ID presented within the CDRs, and to consider the validity of the terminology used by experts. It was found that individual follow-on GPRS/mobile data CDRs cannot consistently place a device within the coverage area of the start Cell ID at the start time of the CDR. Instead, the results indicate that a terminology which places the device within the coverage area of the start Cell ID ‘at or before’ the start time of the CDR is appropriate. It is crucial that follow-on GPRS/mobile data CDRs are analysed with this consideration in mind so to interpret the evidence correctly.

A comparative study of gunshot residue originating from 9 mm Luger ammunition from various producers

Following previous work on differentiation between gunshot residue according to the type of ammunition used, a specific investigation was undertaken of traces originating from 9 mm Luger ammunition using SEM-EDX. The aim of this study was to determine whether GSR originating from this type of ammunition is similar, or whether differentiation could be made between particular manufacturers of Luger ammunition. The results were collected in the form of counts of particles in each of seven key elemental classes being combinations of lead, antimony and barium. These were then adjusted to a factor known as frequency of occurrence which allows comparison of the distribution of particles within the classes between samples with differences in absolute particle counts. The relationships between the samples were examined using non-parametric statistical tests: R-Spearman and tau-Kendall rank correlation coefficients. It has been found that most of the studied samples of GSR were similar to each other despite their originating from various manufacturers.     

Hybrid processes within parenting plan assessments: Rationale and an illustrative model

Parenting plan Assessments, also known as child custody evaluations, are forensic psychological investigations into the needs of children, the parenting capacities of their caregivers, and the resulting fit between the children's needs and caregiver capacities. Typically, they result in recommendations that are, in the opinion of the assessor, formulated to meet the best interests of children regarding a parenting plan, child sharing, parental responsibilities and ancillary services that are likely to support the children's optimal functioning as well as the functioning of the now reconfigured family. Such assessments are part of a pathway to untangling conflicts between the parents regarding the most appropriate parenting plan for the reconfigured family. Paradoxically, the assessment process can exacerbate the conflict, entrench parental polarization, and create lingering feelings of helplessness, frustration, and disempowerment in the parents. This article provides a rationale for the use of a hybrid process that incorporates alternative dispute resolution as an integrated part of the parenting plan assessment and provides an illustrative model of such a hybrid process.
