履行迟延的合同解除规则释论

针对主给付义务的履行迟延,符合我国《民法典》第563条第1款第3项、第4项的构成要件即可解除合同。符合我国《民法典》第563条第1款第3项之情形,直接落入“主要债务”的文义射程。合同解除法上的广义附随义务囊括了传统“债法上之义务群”中的狭义的附随义务与从给付义务,只有迟延履行广义附随义务不符合合同目的,方落入“主要债务”的射程,此时需将“主要债务”进行目的性扩张解释。在履行迟延中,应将我国《民法典》第563条第1款第4项作目的性限缩解释,并可采用类推适用违约损害赔偿的可预见性规则予以适用。就合同目的不能实现之判断,以公式来表明,即为“重大违约(需结合个案判断)+并非债务人订约时不可预见或不可认识(当事人主观标准+理性人标准)=合同目的不能实现”。可预见性的判断时点为合同订立时。不能实现合同目的的举证责任原则上由主张根本违约之一方当事人负担,但在如合同已明定给付日期等无争议之重要事项之场合,当事人无需负担举证责任。履行迟延中的合同解除权之发生不以债务人的可归责性为必要。在解释上,应当认为我国《民法典》第563条第1款第3项适用于非定期行为,我国《民法典》第563条第1款第4项适用于定期行为。关于相对的定期行为之成立,除有“履行期日严守”要件之外,还须结合合同目的予以判断。     

青少年网络途径认知及其网络行为

青少年对网络途径的认知可从他们对网络的态度、对网络影响的认知、网络规范的认知和网络信度的认知四方面分析,青少年的需要、价值观及生活阅历等决定他们对网络社会化途径的认知和选择,从而导致青少年产生特定网络行为,表现为青少年上网的目的、时间与地点、迷恋程度以及对不良信息的阅读。要将网络的消极作用抑制在更小的范围,最佳方法就是教育:对青少年来讲,要加强“善待网络”的教育;对家长来讲,应系统的接受网络技术和网络道德方面的教育;对学校来讲,应该加强网络人文教育,培养“善待网络”的一代。此外,还要从整体上净化青少年成长的环境,重视媒介素质教育。     

Examining Temporal Associations Between School Connectedness and Early Adolescent Adjustment

This study examined (a) the associations between school connectedness and early adolescent adjustment problems over a 1 year period and (b) the equivalence of these associations across gender. Five hundred middle school students (53.4% female), initially in the 6th and 7th grades, participated in the two-wave study. Results from two-group cross-lagged panel analyses were consistent across boys’ and girls’ data. After controlling for baseline levels of adjustment problems, school connectedness predicted lower levels of early adolescent conduct problems 1 year later. Regarding the opposite direction of associations, and even after baseline levels of school connectedness were taken into account, conduct problems predicted lower levels of subsequent school connectedness. There were no cross-lagged associations between depressive symptoms and school connectedness, although elevated levels of baseline depressive symptoms predicted higher levels of subsequent conduct problems. Findings elaborate previous research by demonstrating that early adolescents actively shape the middle school environment.

论精神障碍犯罪嫌疑人的讯问规则

因精神障碍犯罪嫌疑人在受讯问时．有受暗示性较强、依从性及内化性较强、更容易作出虚假供述的特征，因此对精神障碍犯罪嫌疑人的讯问应有特殊的法律规则进行规范。具体而言．应当建立对精神障碍嫌疑人进行适合讯问的评估制度，对于可以在适当成年人在场的情况下讯问的精神障碍嫌疑人．在讯问时应让适当成年人在场对嫌疑人进行保护并监督讯问行为。另外，基于精神障碍嫌疑人对抗讯问的能力较弱，应限制适用威胁、引诱、欺骗等通常情况下具有一定容许性的讯问策略．其它讯问策略也不得超出精神障碍嫌疑人的承受能力。     

Autonomy, guardianship and mental disorder: one problem, two solutions

The law in England and Wales governing both the provision of medical care in the case of adults with incapacity and the provision of care and treatment for mental disorder presents serious problems for the principle of patient autonomy. The adult with incapacity has no competence either to consent to or refuse medical treatment but the law provides no statutory structure for substitute decision making on that adult's behalf. On the other hand the law does allow a person with mental disorder to be treated for that disorder despite his or her competent refusal. The nature of these inconsistencies is considered and the implications which flow from the singling out of mental disorder are examined with reference to experience in two Australian jurisdictions. The current proposals for reform of the Mental Health Act are then considered in the light of the conclusions drawn.     

益气养阴活血中药改善2型糖尿病胰岛素抵抗研究

目的:探讨益气养阴活血中药改善气阴两虚血瘀型2型糖尿病患者胰岛素抵抗的机制.方法:将70例2型糖尿病胰岛素抵抗患者随机分为对照组和治疗组各35例.基础治疗均为口服格列吡嗪或达美康,治疗组在此基础上加用益气养阴活血中药.3个月为1个疗程.观察两组患者治疗前后空腹血糖(fasting blood glucose, FBG)、餐后2 h血糖(postprandial 2 hours blood glucose, P2BG)、空腹血胰岛素(fasting insulin, FINS)、糖化血红蛋白(glycosylated hemoglobin A1c, GHbA1c)、血脂、凝血功能等指标的变化,并计算稳态模型评估胰岛素抵抗(homeostasis model assessment insulin resistance,Homa-IR)指数.结果:两组患者治疗3个月后,FBG、P2BG、FINS、GHbAlc、Homa-IR及血脂、凝血指标均显著改善(P＜0.05,P＜0.01),治疗组改善程度显著优于对照组(P＜0.05,P＜0.01).治疗组降糖疗效和中医证候疗效显著优于对照组(P＜0.01).结论:益气养阴活血中药在防治和改善2型糖尿病患者的胰岛素抵抗及血脂紊乱、血液高凝状态方面具有一定的疗效.     

Developmental Antecedents of Interpartner Violence in a New Zealand Birth Cohort

This paper examines the developmental antecedents of interpartner violence (IPV) victimization and perpetration in a New Zealand birth cohort (n = 828). The study found: (a) IPV occurred in 70% of relationships, with conflict ranging from minor psychological abuse to severe assault; (b) men and women reported similar experiences of victimization and perpetration of IPV; (c) exposure to abuse in childhood, family dysfunction and adversity, childhood and adolescent conduct problems, and alcohol abuse/dependence were significant predictors of IPV victimization and perpetration at age 25; and (d) the antecedents of IPV were largely the same for males and females, although the specific effects of these risk factors differed according to gender. Conduct disorder was more strongly predictive of IPV for females, whereas family adversity was more strongly predictive of IPV victimisation for males.     

官德建设的误区及其对策

官德建设是在反腐败斗争中群众关注的焦点,官员的道德价值趋向和道德表现,具有示范效应和导向作用。当前存在着官德建设过分依赖人性而忽视理性的看待人和分析人;过分依赖自律而忽视他律和制度建设的误区。在官德建设中,要避免官德建设的超前性与社会道德的现实性相混淆;要避免把个人道德置于制度道德建设之上。     

穿行于一罚和多罚之间——论“一事不再罚”原则之内涵

“一事”即“一个行为”,其判断取决于对违法行为事实要进行一罚或多罚的考量,这种考量应围绕行政处罚效益、比例原则和法安定性原则进行。而对“不再罚”解读应考虑到行为违反的法律规范的个数及其相互关系,若一个行为同时违反了多个没有竞合关系的法律规范,则可以依照不同规范给予多次不同种类的处罚。
