慕课对传统高职教育的冲击及应对预案

慕课虽然是在高等教育领域发端的，但随着云技术和互联网业的迅猛发展，其产生的“鲶鱼效应”将对我国高职教育产生一系列重大而深远的影响，从而导致我国高职教育的变革。基于此，文章旨在通过慕课可能对我国高职教育的管理、教与学、课程、师资队伍、学习与教学的考核与评估等许多方面，甚至包括高职教育的形态产生的影响和冲击进行深入系统的研究，并提出相对具体、有针对性、切实可行的预案和对策，从而促使我国高职教育进一步与国际接轨，深化高职教育改革。     

大学生消费行为与家庭背景的关系——基于在杭高校的调查

当今大学生是一个庞大而特殊的消费群体,在社会各方面因素的影响下,他们的消费心理、消费观念、消费方式等也不尽相同。然而,由于大学生还未迈入社会,他们的经济主要来源于家庭,是纯粹的消费者,属于＂寄生型＂消费者。本文主要通过对当前在杭高校大学生消费现状及其家庭背景的调查,分别探讨他们的消费行为与其家庭背景之间存在的相关关系。     

行政规划中的公众参与程序：理想与误区——从汶川地震恢复重建规划说起

通过对汶川地震恢复重建规划的分析可以发现，行政规划的确定将对众多社会群体的法律利益和事实利益产生重大影响。为此，有必要构建行政规划中的公众参与程序，作为公有制前提下公共利益与个体利益的平衡器，并以主体性公众参与作为目标模式。在行政规划的公众参与过程中，容易因公众参与的无限扩张导致政府决策效率低下甚至无法决策，或因公众利益的分化和参与不平衡导致社会公正受损，或者发生公众意见对法律和政策目标的偏离，对此均应竭力避免和纠正。     

Robotic prostheses as products enhancing the rights of people with disabilities. Reconsidering the structure of liability rules

The term ‘robot’ refers to a wide variety of devices, serving very different purposes. The case of robotic prostheses is considered here. After defining such devices, and briefly describing the technical peculiarities that characterize their functioning and distinguish them from traditional implants, their relevance with respect to the fundamental rights of people with disabilities is considered. Pursuant to the United Nations Convention on the Rights of Persons with Disabilities, a claim is made that favouring the development of said applications may be required to subscribing states. In light of such considerations, the liability regime – namely that emerging from the Defective Product Directive – is analysed, in the attempt to determine – with a prospective analysis – the impact that said rules are likely to have on their development. The technology-chilling effect and the anticipated extremely complex evidentiary burden the user would have to face in order to obtain compensation lead us to conclude that legal reform is advisable. Some alternatives are considered, and in particular that of the development of a – partially – state-funded no-fault plan, intended to allow more ex ante certainty for producers and researchers (favouring the development of said devices), and prompt and adequate compensation to the victim in case an accident occurs.     

国外社区警政理论与实践的反思

社区警务是现代警务改革的主要内容和发展趋势。但是多数国家的警方及媒体多以主观的褒奖替代了对其客观科学的分析研究;事实上社区警务的负面影响和具体操作的困难是不容忽视的。国外学者对社区警务的理论背景及实践操作中遇到的代表性问题进行了客观地分析和探究,并提出了相关对策。这对于我国正在进行的社区警务工作具有重要的借鉴意义。     

Environmental Harm or Natural Hazard? Problem Identification and Adaptation in U.S. Municipal Climate Action Plans

A number of cities in the United States have devised climate action plans (CAPs) to mitigate the effects of climate change. However, few of these plans address strategies to adapt to the long term effects of climate change that will occur in the near and distant future. The research presented in this article examines why cities choose to embed adaptation provisions in their CAPs. Our study codes the content of CAPs for all cities (N = 98) in the United States with populations greater than 50,000. We find cities that frame problems associated with climate change in the language of hazards are more likely to include adaptation strategies in their CAPs than cities that focus on other types of environmental harm. Our findings suggest that more robust efforts to plan for climate change will require the activation of communities of interest beyond those that have been instrumental in setting the current climate agenda.

《建立健全惩治和预防腐败体系2008—2012年工作规划》，是深入贯彻党的十七大精神，加强反腐倡廉建设的重要举措，对实现党的十七大确定的各项任务，夺取全面建设小康社会新胜利具有重要意义。为确保《工作规划》取得实实在在的成效，各级党委、纪委和广大党员干部必须正确理解把握其精神实质、基本要求和工作目标，善于结合实践创造性抓落实。     

Reversed Solidarity in Pension Plans

There is a unexpected phenomenon in the majority of complementary pension plans in the Netherlands. Unlike other arrangements that are the result of collective bargaining and decision making, these pension plans increase the inequality in the distribution of (lifetime) income. In those plans, persons without a career contribute to the payment of pension provisions of those with a career. Generally speaking, this implies that blue-collar workers and women pay for the pensions of white-collar workers, who are mostly men. For some of the contracting parties, the terms of the pension contract seem to be disadvantageous and suboptimal. The question arises as to why these contracts are being concluded and how they can survive in a competitive environment. Moreover, since the pension plans are the result of collective bargaining between the organisation of employers and the labour unions, the question arises as to how reversed solidarity fits the alleged redistributive goal of the labour unions. The analysis leads to the following conclusions. Firstly, that information and transaction cost, collective agreements, legal barriers and market failures on substitute arrangements prevent the conclusion of optimal contracts. Secondly, employers would find the pension plan attractive because it discourages shirking, enhances productivity and the process of job matching and reduces labour turnover. Thirdly, a pension plan based on final salary is in the interest of the median voter in the labour union, who is older and earns a higher seniority wage than junior workers. Furthermore, in the given circumstances the pension plan enlarges union membership and the dues income of the union and endows the union leadership with more prestige and influence. Individual union members would not oppose such a pension plan for reasons of informational asymmetry, transaction cost and the inability to capture the full benefits of their actions.A comparison of the pension schemes of Belgium, Germany, France and the UK shows that there are large differences in the structure and content of retirement provisions. Reversed solidarity may also be part of the pension plans in Belgium and the UK.
