The quandary of Jewish women unable to remarry because of their husbands’ refusal to grant them religious divorces is a real problem affecting real people. Husbands are wielding this lopsided power to “extort” money from their wives, obtain favorable child custody settlements, property settlements, and child support payments. The burgeoning divorce rate is certain to exacerbate this problem. Already, this situation has garnered international attention. In the wake of New York's legislative attempt to remedy this problem, countries, including the United Kingdom and Australia, have promulgated legislative solutions to this dilemma. New York is the only state in the United States to pass such a statute. Unfortunately, New York's statute is flawed because it is of limited applicability and still allows for situations in which the Jewish wife is civilly divorced but religiously married. This Note proposes amending New York's statute to make it applicable to any and all divorce proceedings and to any barrier to remarriage. This Note will further recommend that the proposed amended statute should be adopted worldwide. 相似文献

AbstractThis article examines how the decentralisation and fragmentation of the Indonesian state and resultant central–local dynamics affect cross-border regionalism in Indonesia’s periphery. It argues that cross-border regionalism projects are best understood as sites for scalar contestation over regulatory control between central and local government. Moreover, scalar contestation around cross-border regional projects is characterised by the struggles to control relationships with transnational capital between elites operating at different tiers of the state. When elites at different scales have conflicting interests and strategies, this can cause policy incoherence, inhibiting the development of cross-border regionalism. Conversely, when they align, and intersect with the interests of transnational business, cross-border regionalism can succeed. To illustrate the argument, this article utilises the comparative case studies of the Batam free trade zone and West Kalimantan–Sarawak cross-border cooperation. 相似文献

Unexpected Persistence Amidst Enlargement Stasis: Usages of Europe in Turkey’s Nuclear Energy Debate
Recent studies on European Union (EU) Enlargement have emphasised the importance of usages of ‘Europe’ by domestic actors as a necessary condition for the EU to have an impact on domestic politics. We study the usages of Europe in the critical case of Turkey’s nuclear energy policy. We analyse the narratives and actions of domestic actors in Turkey to identify if they use ‘Europe’ (the EU and the idea of Europe). We reach the counter-intuitive finding of usages by both state and non-state actors, which illustrates that usages of Europe can persist despite enlargement stasis in candidate states. 相似文献

Violent political revolt has been common in independent Uganda. For a long time, such revolts were exclusively expressed as rural-based rebel groups fighting the government. Since the mid-2000s, however, this seems to have come to an end. Instead, urban riots, very rare in the past, have become much more common. This article analyses these changing patterns of types and location of violent political revolt in Uganda under the National Resistance Movement government. It argues that the earlier prevalence of rural rebellions can be explained by the combination of a coercive and militarised state, and weak and ethnically factionalised political forces who took their violent resistance to rural regional bases. Over time, however, government counter-insurgency became more effective and the conditions for insurgency were undermined by withdrawal of external support. Furthermore, the reintroduction of multi-party politics in 2005 opened up new avenues for political expression. The changes to the political system were, however, more nominal than real in many respects. While the rebel option had become less attractive and feasible, a series of social, economic and political grievances remained which were only partly channelled through party politics. This essay explores the central role of Jewish joke telling in Sasha Marianna Salzmann’s play Muttersprache Mameloschn (first performed in 2012). Subversively revealing the problematic of essentializing cultural, national, and even sexual identity, Jewish joke telling figures as a performance of social and political resistance and disidentification in this play. Engaging with Jack Halberstam’s queer epistemology of failure and José Esteban Muñoz’s theory of queer disidentification, I propose that the act of Jewish joke telling by a young lesbian plays out as a new queer project of intervention in this play that confronts both antisemitism and culturally positioned sexual hegemony. 相似文献

The so-called ‘nexus’ approach has recently been promoted as addressing externalities across the water, food and energy sectors, thus helping to achieve ‘water/energy/food security for all’, ‘equitable and sustainable growth’ and a ‘resilient and productive environment’. While these are noble goals, this article argues that the reality on the ground appears to be taking a different direction, at least when it comes to China and its neighbours in South and Southeast Asia. There, a new era of large-scale water infrastructure development is creating several security-related problems, which represent serious challenges to the nexus goals. These challenges include food–energy tensions, human security threats and ecological risks. These challenges can also be linked to rising friction surrounding the management of water, food and energy resources in the region. The article argues that, in order for the nexus goals to be achieved in China and the countries on its southern periphery, there must first be increased awareness of this nexus among policy-making elites. 相似文献

Drawing on Laclau’s concept of populist discourse and Gramsci’s ‘national–popular collective will’, and using the case of Iran, this article puts forward the idea of the legacy of subalternity in the context of post-revolution governments. The concept of ‘national–popular collective will’ facilitates an understanding of how the popular subject is constructed and the meanings embedded in that process. It is argued that Islamic Republic elites articulate a populist discourse that constructs the ‘self’ (the Islamic Republic) as synonymous with ‘the people’. Embedded in this discursive construction is a legacy of subalternity that goes back to the 1979 Revolution’s populist discourse. 相似文献

The aim of this article is to explore the interaction between local, national, and transnational frames of memory as it manifests itself in the contemporary commemoration of the Jewish past. Focusing on the case study of Poland, I argue that articulations of transnational memory still remain deeply rooted in local and national interests and mythologies, reflecting the fears, desires, or longings of memory makers. Ranging from digital media which stress the interactive and agency-based dimension of transnational memory, through to vernacular “stumbling blocks” inspired by German citizens and subsequently transplanted onto the Polish ground, to public memorials which are either embraced or contested by a variety of social actors, these initiatives urge us to rethink traditional approaches to memory. In particular, these different scales and locations of remembrance question the common perception of collective memory as rooted in rigid nation-state frameworks in favor of memories that travel, move, and transgress multiple boundaries and affect multiple communities. 相似文献

Peace education is considered a necessary element in establishing the social conditions required for promoting peace-making between rival parties. As such, it constitutes one of Israel’s state education goals, and would therefore be expected to have a significant place in Israel’s educational policy in general and in response to peace moves that have occurred during the Arab–Israeli conflict since the 1970s in particular. This article reviews the educational policy actually applied by Israel’s state education over the years as reflected in formal educational programs and school textbooks, and suggests that although some significant changes have taken place over time, there has been and still is a significant gap between the stated goal and the practice of peace education in Israel. Reasons for this disparity and its implications are discussed and possible directions are proposed for coping with this educational challenge. 相似文献

Despite the limited number of peace museums around the world, there exists an essential role for existing peace museums to promote a culture of peace and peace education. The purpose of this article was to introduce the origins, rationale, scope and work of the Tehran Peace Museum in Iran. The concept of the museum is to facilitate peace education and develop peaceful environments drawn from the personal experiences of war survivors. The museum encompasses exhibitions about the horrors of chemical and nuclear warfare and is balanced with awareness programmes, bridge-building dialogues, connections with other peace museums and a comprehensive peace education programme catering for younger and older members of society. It offers the space and opportunity for a community of learning within the museum and welcomes fresh ideas and initiatives from visitors and volunteers. The Tehran Peace Museum is unique in its body of volunteers, men and women who have been directly affected by chemical weapons. They are involved in the Veterans Voices of Peace Oral History Project and actively voice the need for creating peaceful societies in today’s world. 相似文献
