Domestic violence survivors and children in foster care often experience significant unmet civil legal needs. Legal aid services, when adequately funded, can help close the justice gap for these two populations while improving safety, stability, and court efficiencies. However, despite ample literature demonstrating how legal aid can improve outcomes, almost half of those seeking legal aid services are turned away due to lack of resources. This article reviews the research and data about how legal aid can improve outcomes for people in the domestic violence and child welfare contexts. It also discusses how several state‐administered federal funding opportunities—including the Victims of Crime Act (VOCA) Victim Assistance Formula Grant Program, Title IV‐D child support funds, and Temporary Assistance for Needy Families (TANF) basic block grants—can fund the needed civil legal help.  相似文献

第三方市场合作是中韩两国参与国际分工协作的新型合作模式,也是两国发展战略对接与比较优势互补的重要经济实践。中韩第三方市场合作在产品服务、工程建设、投资合作、产融结合和战略合作五个领域打造了一系列重要工程,不仅加深中韩两国的合作基础,还为第三方市场的经济发展注入新动力。但其中存在诸多挑战,产业结构的竞争、复杂的营商环境、域外大国因素的介入以及中韩经济波动等都对中韩第三方市场合作造成了阻力。因此,开拓战略新兴产业、打造示范工程、创新金融合作和完善协调机制,是实现中韩第三方市场合作可持续发展的重要保障。  相似文献

基本权利第三人效力,也被称为水平效力、私人效力、基本权利在私法或私人法律关系中的效力等。第三人效力是指,基本权利能否以及在何种程度上可以对诉讼当事人之间的民事实体法律关系产生影响。实践中,公私二元划分是第三人效力探讨的基础;基本权利客观法属性是第三人效力的规范范畴;基本权利人类图像与自由权的多重面向是第三人效力的价值范畴;基本权利保护义务是第三人效力的义务范畴;基本权利取向解释是第三人效力的方法范畴。第三人效力具有体系正义、规范正义和个案正义的诉求,本质上是涵盖不同范畴的结构性效力。提出第三人效力的目的在于国家通过干预社会和消解社会不公正,为私人主体创造秩序和自由。  相似文献

Charities are playing a significant role in the implementation of the government's New Deal programme. From providing advice on local employment issues to administrative services to work placements, the voluntary sector has been working in public/private partnerships throughout England and Wales. However, despite the government's commitments in the Compact between it and the voluntary sector to support the independence and creativity of the sector, the New Deal for 18-24 year olds reinforces many of the negative sides to the 'contract culture'. This article will examine working relations between charities and the State post Compact, using charities'participation in New Deal as a case study. We will argue that participating charities face a series of potential legal pitfalls. They might also find that, instead of being fully funded through State funds, their participation in the delivery of New Deal is partially funded through their own charitable resources.  相似文献

This article explores alternatives for the court process that promote a child‐centered approach to resolution of family law issues including a summary of procedures used in Los Angeles County to assist families. The article also explores alternatives to the traditional custody litigation model.
    Key Points for the Family Court Community:
  • Evaluations and trials are not the only tools available in family law.
  • Structured court ordered counseling can provide a meaningful intervention and reduce family conflict.
  • Alternative forms of mediation can help families address the “need to be heard” and retain personal autonomy in decision making.
  • The court system should help educate families about how to resolve conflict in a safe, effective, and meaningful way.

契合"放管服"改革理念的数据安全认证,在数字时代整个规制法体系中必将占据日益重要的地位。数据安全认证通过声誉评价机制,可以引导、激励互联网企业守法合规经营,可以增强用户对中小微互联网企业和新兴数字产业的信任感,可以避免"一刀切"的政府规制,可以满足社会公众多元的数据安全需求。数据安全认证机构应具有高度的独立性与专业性,防止其被互联网企业"俘获"或成为政府的"附庸"。宜实行自愿为主、强制为辅的数据安全认证模式。认证程序应强调公正透明性,认证标准应注重评价企业数据合规的制度建设。根据过错责任原则,分别设置数据安全认证机构"相应的赔偿责任"或"连带责任",并加大对数据安全认证违法行为的公法责任追究。科学构建法治化的数据安全认证体制机制,不仅是保障数据安全的现实需要,而且是弥补数字时代政府规制缺陷的迫切需求。  相似文献
