第三人干扰他人婚姻关系是否应当承担损害赔偿责任在我国长久以来一直存在争议。然而,通过对台湾法和德国法上两种完全不同的法律规定进行比较可以得知,第三人是否应当承担损害赔偿责任实际上是由一般社会观念及民众的价值判断所决定的。通过对我国现行法律中所体现的法律价值、第三人干扰婚姻关系制度的目的、负面风险的发生以及干扰婚姻关系行为的价值评判进行分析,笔者认为我国不应当要求第三人承担损害赔偿责任。与此同时,笔者也对受损害配偶受欺骗抚养非亲生子女的损害赔偿问题进行了分析。  相似文献

This paper examines how differences in sex drives between husbands and wives affect bargaining strengths during marriage and particularly at times when divorce might occur. The basic argument follows from the fact that sex drives vary over an individual's life cycle, and are systematically different for men and women. The spouse having the lowest sex drive at any time in the marriage has a property right over whether or not sexual intercourse will occur, with a consequent increase in bargaining power at the margin. The paper derives a number of testable implications from its model, and, using several data sources, shows empirically how this difference affects marriage, adultery and divorce.  相似文献

受国家支付能力的限制,法律控制的范围不应过度扩展。在理论上,法律控制的合理边界应当确定在边际控制收益与边际控制成本恰好相等的位置上。因此,为了节省公共资源的投入,国家就要被迫限定法律的控制的范围,甚至会有意保留一些法律空白,许多有害行为因此可以"逍遥法外"。通奸和手机传播黄色短信就属此类有害行为。  相似文献

‘The entire people cry out, “His blood be on us and on our children.”’ Is this the epochal ‘no’ of Israel renouncing its birthright? The legal precedent is not in delict but in contract, in treaties and covenants in which an entire people bind themselves and their descendants, their entire nation, in perpetuity by an imprecatory curse-oath identifying themselves and their descendants with a blood sacrifice that seals the contract. Legally, treaties and covenants require contemporaneous ratification. The author of Matthew’s gospel obtains the acclamations of the other actors, Pilate, the soldiers, the chief priests, scribes and elders and from the sign atop the cross by the formulaic talisman, ‘King of the Jews’ or ‘Israel’s King’ that each recite. He obtains the crowd’s acclamation from Pilate using together the words ‘Christ’ (Messiah) and ‘blood’ and employing a Jewish hand washing ritual. The purpose of the hand washing ritual was to forgive Israel for the guilt of innocent blood. However, Pilate uses this ritual meant to forgive Israel for its extreme opposite perverse purpose to condemn Israel. But the crowd uses the words ‘blood on’ in a different sense that evades Pilate’s request. ‘Blood on’ in the sacrificial system meant acceptance of a sacrificial blood offering.  相似文献

对通奸罪判处石刑是伊斯兰法的一项古老的规定,形成于伊斯兰法的早期阶段,通过圣训正式确立下来。在伊斯兰法世俗化改革时期以及伊斯兰法复兴运动中,这一规定随着伊斯兰法律的变迁或存或废,与伊斯兰世界的政治变革密切相关。时至今El,对通奸罪判处石刑仍然出现在一些伊斯兰国家的法律中,正因法律的象征性作用以及伊斯兰法浓厚的政治特性,对通奸罪判处石刑的规定短期内不会在伊斯兰法律中消失。  相似文献

古今中外的刑法史上,通奸通常被规定为犯罪,并且课以严厉的刑罚。但随着现代文明的进步,刑法在加强打击法定犯的同时,逐渐退出公民个人的私生活空间,让位于其他法律和道德规范。刑法的“有所为而有所不为”正是现代法治的要求,由此就不难理解现代社会中通奸行为的“非罪化”。  相似文献

Over the course of several books, Zizek develops a psychoanalytical account of the symbiosis between the public law and the individual subject’s own acquiescence. It is of course a non-formalist theory, suggesting that formal law alone does not achieve social order. This article applies an element of the theory empirically to a historical question: to the question of how the behaviour of juries in a particular type of 18th-century adultery trial managed to be both the object of contemporary controversy and an expression of normative values. The social ambivalence signalled by that doubleness opens surprisingly well to Zizek’s theory that the power of law is divided between its own public form and the subjects’ expression of superego. The theory of the split law, the hidden supplement outside the system, clarifies the historically-specific example. However, the historical example also illuminates the theory: it suggests how the space for this supplement also exists within the system, which can incorporate and make use of it.
