哲学批评学:定义、框架与必要性

"哲学批评"是两个或两个以上的哲学家、两个或两个以上的哲学流派、两部或两部以上的哲学著作之间的批评."哲学批评学"可以定义为"概括和总结哲学批评活动之功能、原则、方法、规律等等的一门科学"."哲学批评学"的总体框架以哲学批评的定性、哲学批评的模式考察、哲学批评的历史考察为"三根支柱".建设"哲学批评学"的必要性,可以从如下方面去看:哲学的本性要求"哲学批评学"的构建;中国哲学研究的现状要求"哲学批评学"的构建;哲学领域的学科完善要求"哲学批评学"的构建;哲学领域中众多批评材料要求"哲学批评学"的构建.

马克思没有明确提出＂现代性＂的概念,但他仍然对现代性作出了新的理解。马克思的现代性思想主要体现在四个方面：一是对现代性的诠释;二是对现代性的维护;三是现代性思想的后现代意蕴;四是对现代性的批判。     

法律规范结构理论的批判与重构

长期以来，我国法学理论界对法律规范结构的学术观点主要有两种学说：“三要素说”和“两要素说”；虽然近有“新三要素说”对前二者提出了批判，但仍旧没有脱离传统的分析模式的缺陷：即将“存在论”的共时性结构分析转换为了“运行论”的历时性的操作分析。通过将结构界定为各要素的共时性存在，将法律规范结构重构为经由条件假定中介的调整性规则与管理性规则并立的条件性二元构造，较为合理地将法律规范的静态结构特质呈现出来。     

Critics Within: Islamic Scholars' Protests Against the Islamic State in Iran

Islamic scholarship, in Iran and elsewhere, has a long tradition of debate and critique. This tradition has come to pose a challenge to the constitutional order of the Islamic Republic of Iran, as a number of seminary-trained scholars have applied their critical methods to basic issues of state legitimacy, in particular the state's right to insist on interpretive closure. The regime has responded with force, convening special clergy courts to silence and imprison scholars, in violation of seminary norms of scholarly debate. These conspicuous acts of discipline seem to have backfired, as each escalating punishment has generated new critics within.     

The Female Body and Reviews of Women Pianists in 1950s London

Women pianists in London in the 1950s, performing mainstream repertoire (Beethoven, Schubert, Schumann, Brahms, Liszt and Chopin) as well as modern pieces which demanded stamina, physicality and bravura, were often the subject of negative reviews. The critics’ attitudes towards them seems to echo the prevailing Freudian mantra, ‘anatomy is destiny’: women, generally smaller than men, apparently possessing less power and mental capacity, were deemed unfit for this repertoire. But if some women pianists demonstrated ‘unusual’ (for women) physical and mental power, successfully performing long and difficult pieces, they too were damned by the critics, because they did not fit the traditional notion of femininity. In this article, the author demonstrates the magnitude of the effect of the cultural image of women on the reception of both the ‘feminine’ and ‘unfeminine’ women pianists in 1950s London.     

论我国刑事诉讼文化现代化研究的视角与进路

我国刑事诉讼现代化建设的理想状态应该是诉讼制度完善与诉讼文化改造同时并举。学术界应该更多地研究刑事诉讼文化的现代化,以刑事诉讼文化现代化如何实现作为今后研究的视角。我国刑事诉讼文化现代化研究应以文化哲学为首选的参照系,主要是它的日常生活批判理论。我国古代刑事诉讼为传统日常生活世界所蚕食,我国当下的刑事诉讼尚未远离日常生活世界,尚未真正走出日常生活世界。我国刑事诉讼文化现代化研究应以日常生活批判为切入点。在我国刑事诉讼领域开展日常生活批判,也就是从深层上促使社会主体有关刑事诉讼的心理、意识和思想体系从传统向现代转变,实现社会主体在刑事诉讼方面的现代化,实现我国刑事诉讼文化的现代化。
