大数据时代日本个人信息保护法探究

个人信息本来是极其隐私的事物,在大数据时代却时刻处于"裸奔"状态,时刻面临被侵犯的风险。特别在新冠肺炎疫情防控中,大数据技术发挥了重要作用,个人信息保护再次引起关注。整体而言,日本个人信息保护法以"个人优先"与"公共优先"的宗旨博弈为出发点,以"个人信息"的概念界定为基础,以个人信息权的保护为核心,以个人信息保护机构的独立设置为落脚点,为个人信息的保护奠定了基础。我国应当积极行动起来,尽快颁布《个人信息保护法》,助力大数据时代个人信息保护和数字经济的发展。     

司法改革方法论的反思性整合——一个实践理性的视角

在全面依法治国的时代背景下,司法改革的推进需要在实践理性的指导下,通过新的方法论体系来予以重新解读和把握。当下司法改革的方法论面临价值理性缺失、工具理性误区和理论范式失衡的现实困境,需要在问题导向的基础上,借鉴和利用多种社会科学方法,透过多种视角探讨如何认识改革、如何推进改革、如何评价改革,在实践建构中实现方法体系的反思性整合。以"制度化的社会回应型司法"为基本目标,协调价值理性与工具理性的冲突,统合国家治理的实践逻辑与法治的价值逻辑,统筹推进司法制度的改革和构建。     

Data Protection: An Opening Door?

Swedish public law has incorporated a general rule of public access to documents, and to information in the wider sense, since the Freedom of the Press Act of 1766. On the Community level, the relationship between Regulation (EC) 45/2001 on data protection and Regulation (EC) 1049/2001 on public access to documents exemplifies the tension between the public's interest in scrutinising the administration carried on in its name, and the integrity of the individual. However, a similar tension exists between Sweden's Personal Data Act of 1998, implementing Directive 95/46, and the Freedom of the Press Act. A misuse model of data protection law, by seeking to concentrate on serious rather than technical infringements of privacy, might serve to ease the tension. INTRODUCING PERSPECTIVES IN FAMILY LAW AND SOCIAL SCIENCE RESEARCH

This article provides an editorial introduction to the following three related articles on the growing use and influence of social science research in family law. It first considers why this has become problematic and identifies some common strategies used by advocates, sometimes under the guise of scholarship, to destroy the standing of research findings contrary to their ideological or political position. Then it discusses briefly the remedies proposed to mitigate these kinds of problems within the following three articles.     

The evolution of European legal integration

This article contributes to the development of theories on European integration by testing and exploring statistical models on the long-term development of legislative activity of the European Commission. Drawing on legal information gained from the European Union’s PreLex database and analyzing it with the help of statistical analyses, we map out growth patterns of EU law between 1976 and 2003. We construct time-series models and models based on non-linear regression. While the performance of models based on the traditional theoretical approaches, intergovernmentalism and neo-functionalism, is rather poor, the analysis suggests that nonlinear dynamic models might be an interesting avenue for future conceptualizations of the EU integration process. 美、日、欧现代物流发展的比较与启示

现代物流是系统管理的思想、理念和技术,集成系统化是现代物流发展的一个重要特征。美国、日本和欧洲现代物流发展各具特点,但对我国构建现代物流体系都具有启示作用。我国物流正处于由传统物流向现代物流转型的阶段,应当吸收西方发达国家现代物流发展的经验,建设与经济发展相适应、与人口资源环境相协调的现代物流网络体系,构建现代物流发展政策措施体系,加速物流现代化的我国现代物流的发展。     

中国调解与审判关系新论——从历史的视角

调解与审判合一,一直被认为是中国古代司法的优点。但正是因为调审合一有着明显弊端,我国古代司法向近代变迁时呈现出调解游离于审判之外的态势,这是利于依法治国及彻底解决纠纷的因素,值得我们在当代司法中借鉴。     

技术傻化的社会学阐述

傻化是操作技术的简易化，是用少的或浅显的知识去使用产品。“界面”(操作技术)是可以相对独立于“系统”(运行技术)的。技术傻化已渗透到日常生活的各个领域，其原因是：(1)现代社会的知识成指数函数增长，科技产品极大丰富；(2)专业化分工日益加深，制作(生产)日益与使用(消费)相分离；(3)开发商为实现其产品大众化目标，不断使其产品的操作简易化。技术傻化在发展中国家中有其重要功能。它有助于高新技术的推广普及，产生良好的社会经济效益；有助于消除现代社会中的“数字鸿沟”这一新型不平等形式；有助于丰富普通人的生活。     

Analysis of STR loci in Cartagena, a Caribbean city of Colombia

Allele frequencies, together with some parameters of forensic interest were estimated for nine STRs included in the AmpF/STR Profiler kit (CSF1PO, D3S1358, D5S818, D7S820, D13S317, FGA, TH01, TPOX and vWA) in a sample of 215 unrelated individuals from Cartagena (Colombia). For all loci, no significant deviations from Hardy-Weinberg equilibrium were observed. Comparative analysis results between our data and those from other Colombian and African population samples revealed significant differences, except with two Colombian Caribbean Coast sub-regions.
