危险驾驶罪相关问题浅析

近几年,以危险方法驾驶机动车辆而导致的重大交通事故有增无减,无疑给人们的生命、健康和财产安全造成了极大的威胁。在这种情况下,刑法修正案（八）第二十二条规定了＂危险驾驶罪＂。这一罪名的出现,对于预防严重的交通事故,更好地维护交通秩序,保护人民群众的生命、健康和财产安全具有重要的意义。危险驾驶罪是一个新罪名,对于这一犯罪的构成和认定上还有诸多争议。本文从客观方面的＂追逐竞驶＂与＂醉酒驾驶＂、主观方面的认定以及与其他犯罪的界限几个方面解读本罪,以期更加准确的理解、掌握和运用。     

Cross-state learning and service delivery in India’s federal system

ABSTRACT

This paper attempts to place the issue of cross-state learning and borrowing experiences in service delivery in India in the specific context of political incentives in India’s federal democracy as well relating it to the findings of the comparative literature on subnational policy diffusion in federal systems. It presents four types of borrowing experiences from a selection of six case studies of the past few years, and point towards ways in which learning/borrowing across states can be usefully incorporated into policy.     

Mobilising evidence in public policy: The contribution of the evidence provider

This article contributes to the conceptualisation of evidence‐based policy through providing a framework of the key factors that influence research utilisation, including those that shape the quality of evidence provided. We apply this framework to an analysis of public policy to regulate the remuneration of freight truck drivers to improve workplace safety in their industry. Recent policymaking concerning the regulation of truck drivers’ remuneration in Australia provides an opportunity to examine the quality and utilisation of research evidence by external evidence providers in opposing political contexts. This article suggests the need for informed and vigilant scrutiny of the contributions of evidence providers to government policymaking, particularly in the case of wicked policy problems about which there are sustained ideological differences that underpin problematisation, research interpretation, and conceivable policy solutions.     

刑法修正案（八）增设危险驾驶罪之问题研究

2011年2月24日全国人大常委会第十九次会议通过的刑法修正案（八）对现行刑法作了许多修改。其中,在刑法第133条后增设了危险驾驶罪,这次修改是本次修正案的重要内容之一,对危险驾驶行为的定罪,改变了＂肇事后再处罚＂的方式,对醉驾等危险驾驶行为的规制正式法律化。本文在讨论增设危险驾驶罪的原因以及本罪构罪标准的基础上,提出了对危险驾驶罪的几点完善意见。     

从刑法谦抑性看酒驾入罪

最新出台的《刑法修正案（八）》把酒驾行为纳入刑法的调整范围内。这是有违谦抑性原理的,原因是：第一,从人性上考虑,酒驾行为并不会给驾车者带来利益,所以就没有必要用刑罚这种严酷的手段来压制酒驾者的欲望;第二,酒驾虽然猖獗,但是它并没有穷尽所有的法律规制手段,加强行政执法力度完全可以控制;第三,实际操作起来烦琐的刑事诉讼并不...     

非机动车驾驶人交通伤害及预防对策研究

在我国每年发生的道路交通事故中,非机动车驾驶人往往成为最严重的伤害对象。根据非机动车驾驶人多为颅脑损伤的特征以及电动自行车、残疾人专用车自身的危险性,结合国外的经验,对非机动车驾驶人交通伤害的预防,可采取如下对策:推行佩戴安全头盔政策、制定自行车道设计规范及管理要求、优化大型车辆行驶路线、加强对自行车驾驶人的交通安全教育。     

驾驶模拟器用于驾驶员安全教育的研究

本文简要介绍了我国交通事故和驾驶员安全教育现状以及驾驶模拟器用于驾驶员安全教育的前提条件,提出了驾驶模拟器用于驾驶员安全教育的虚拟道路交通视景系统的组成及设计方法,分析了驾驶员安全教育的虚拟道路交通视景特征及驾驶模拟器用于安全教育的可行性。     

浅析醉酒驾驶行为的法律规制

醉酒驾驶行为的法律规制应追求自由、秩序和正义的价值,以实现对醉酒驾驶行为的遏止。但现实中,醉酒驾驶行为的法律规制因行为的多发性、饮酒的习惯性和制裁的限制性而存在一系列困境,因此在司法实践操作中,需破除对刑罚威慑作用的盲目笃信,在刑法与行政法的顺畅衔接和危险驾驶罪增设资格刑的同时,仍需社会力量的配合。     

Sociocultural Determinants of Policewomen–Taxi Drivers’ Interactions on the Major Highways in Ibadan Metropolis,Nigeria

This study investigated the sociocultural determinants of policewomen–taxi drivers’ interactions on the major highways in Ibadan metropolis. Purposive sampling technique was utilized for the selection of 11 policewomen and 35 taxi drivers. Data were generated through key informant interview and focus group discussion methods. Findings revealed that gender had no impact on the ability of policewomen to enforce traffic law. Policewomen were adjudged to be strict on traffic law enforcement. However, the size of the accolade generated by this feat has been slightly attenuated by the action of officers who habitually demand for bribe from apprehended taxi drivers.     

Empirical study of investment activity＇s drivers in capital-intensive Russian firms

In this paper we present the research results of key factors that determine the investment behavior of Russian companies during 2004-2008. The emphasis is made on the policy of capital expenditures. In the analysis, it included maeroeconomic, some industry factors （growth rate, spread of efficiency （ROIC-WACC）, market and industry risks） as well as some internal factors related to the equity structure and the quality of corporate governance.
