非法买卖枪支案件之诱惑侦查

诱惑侦查是当今世界许多国家侦查非法买卖枪支案件的重要措施和手段 ,我国也在不同程度地适用这一有效方法。由于缺乏必要的指导 ,实践中存在不少问题 ,影响了其效能的充分发挥 ,也极易侵害公民合法权益。鉴于此 ,本文分析了非法买卖枪支案件运用诱惑侦查的条件 ,提出了非法买卖枪支犯罪案件诱惑侦查中诱饵的设计方案 ,以及非法买卖枪支犯罪案件诱惑侦查的策略和方法 ,以期能对我国当前的缉枪实践提供理论指导。     

完善我国网上证券交易立法的思考

本文结合国内立法的现状和证券公司开展网上证券交易的实践,对网上证券交易立法的完善进行了探讨,认为应当尽快健全网上证券交易的立法体系,注重加强对投资者的保护,在具体的立法内容上,应注意对市场准入、电子签名及其认证、证券公司与投资者之间的权利义务、信息披露、法律责任的承担、跨国交易的管辖权和准据法等问题的规制。     

Research on Pre－trade Transparency and Market Liquidity

The transparency of the securities market reveals the extent of transaction information transmission to traders. According to the relative trading position, it can be divided into pre-trade transparency and post-trade transparency. Using Shanghai Stock market high frequency trading data, this paper builds an econometric model and analyzes the market effect of two important changing pre－trading transparency events. The empirical result hows that the pre－trade transparency changing has no significant effect on market liquidity. The expansion from 3－layer bid－and－ask price to 5－layer obviously lifts the stock price, leading to the U－shape change in volatility and trading volume. However, the 5－layer bid－and－ask price expansion to 10－layer in level 2 shows no significant effect.     

The Green New Deal Must Preserve the Existing Nuclear Fleet

Abstract

As the largest source of carbon-free energy in the United States, nuclear energy must play a vital role in reducing emissions. This article suggests the Green New Deal, an ambitious federal proposal to address climate change, should aim to preserve the existing nuclear fleet by authorizing states to establish zero emission credit (“ZEC”) programs. The ZEC programs will provide credits, in the form of revenue, for the carbon-free attribute of nuclear energy. This article posits the ZEC programs should be based on a model ZEC program developed by the Federal Energy Regulatory Commission and explicitly authorized by amendment of the Federal Power Act to avoid issues of preemption.     

内幕交易、泄露内幕信息罪若干问题研究

我国虽于1997年修订刑法时将证券市场严重的内幕交易、泄露内幕信息行为犯罪化了,但新刑法颁布以来的司法实践证明,关于此罪的规定很少被适用,刑法的预防、威慑和惩罚功能并没有得到很好地发挥,这与日益严重的内幕交易、泄露内幕信息的犯罪现实形成鲜明对比。笔者以为,造成这一现象的原因之一是刑法规定本身的不完善以及刑法、附属刑法、行政法规之间缺乏应有的衔接和协调而导致司法操作的困难。本文立足于刑法180条(修正案)的规定,对内幕交易、泄露内幕信息罪在主体、客观方面、处罚等方面存在的相关问题进行了探讨。     

Diffusion models over the life cycle of an innovation: A bottom-up and top-down synthesis approach

The diffusion models tend to be tested individually in isolation and remain the same over time for the studied innovations in the literature. Moreover, there is growing interest to learn from other countries in our current age of globalization. Therefore, this paper chooses the innovation of public resources trading platforms in China to fulfill above literature gaps. We have examined key events and the issuances of related laws and regulations by Chinese governments. Our contributions are twofold: (a) Our analysis and results show that the diffusion models evolve over the different stages of a life cycle of an innovation, contrasting to the literature results that diffusion models remain the same for their studied innovations. Due to major diverse characteristics among different adopter categories over a life cycle of an innovation, we argue that it is appropriate and necessary to apply different diffusion models on different adopter categories, which is missing in the current literature. (b) We find a first bottom-up and then top-down synthesis approach as an effective, efficient diffusion process for both fitting local needs (i.e., effective) and adopting innovations rapidly nationwide (i.e., efficient).     

How the City of London lost at Brexit: a historical perspective

The nature of the City of London as an offshore financial centre has long made London dependent on the British state providing protection from external political regulation, even as London’s foreign currency business separated its interests from British governments’ economic policy preoccupations. Since the 2008 crash and the onset of the eurozone crisis, London has faced threats to both its autonomy from external regulatory demands and to its offshore business interests at the same time as the long-standing external statecraft of British governments around EU membership has broken down. The Cameron governments’ efforts to protect the City within the European Union under political conditions that were transformed by the eurozone crisis exposed the limits of Britain’s position as a member of the European Union. When David Cameron then tried to resolve the problem of EU membership through a referendum he made it extremely difficult to defend the City’s broader commercial interests in the Single European Market because freedom of movement issues weighed significantly more in British domestic politics than financial services.     

对完善我国短线交易归入制度的法律思考

短线交易是内幕交易的一种典型形态。各国立法上对短线交易行为的控制主要是通过归入制度实现的。我国现行立法上对短线交易的规定非常匮乏且不尽合理。今后的改革途径应当是适当扩大短线交易规制主体的范围;从立法上明确规制主体的身份界定标准;完善公司管理者和大股东的持股报告制度以及有关部门的信息披露制度;完善短线交易归入制度中的豁免适用规定;明确短线交易归入制度中的利润计算方法等。     

中国对外贸易摩擦的深层次原因与对策

贸易保护主义重新抬头,导致贸易摩擦的数量不断增加,领域和范围日益广泛,严重阻碍了国际贸易的发展。中国已进入贸易摩擦高发期,是国际贸易摩擦的最大受害国。日益频繁的贸易摩擦已成为国人关注的焦点问题。应对国际贸易摩擦,要在分析研究产生根源的基础上,对症下药,采取相应对策。     

畸变产物耳声发射在伪聋鉴定中的应用

目的寻找识别伪聋的客观方法。方法运用畸变产物耳声发射技术(DPOAE)对伪聋组、正常对照组及感音神经性聋组进行畸变产物耳声发射测试。结果(1)正常对照组的平均检出率为94.00％,感音神经性聋组的检出率为22.00％,两组比较有显著性差异(P<0.01),提示感音神经性聋组患者,通过DPOAE检查,可以发现其听功能障碍。(2)伪聋组的平均检出率为93.00％,与正常对照组比较无显著性差异(P>0.01),提示通过DPOAE检查,可以识别伪聋。而且,当听力下降>50dB时,检出率为零,这更表明DPOAE技术对伪聋有识别作用。结论DPOAE作为识别伪聋的客观检查方法可应用于法医临床学活体损伤鉴定。
