Judges rule their decisions to enforce foreign divorce judgments and therefore to achieve procedural justice. Notwithstanding of that, the enforcement couldface different challenges, not only about its coercive enforcement —lacking of voluntarily compliance of the original decision— but also ju-risdictional/territorial limitations. These limitations are related with the existence of different locations among the place of the original subject matter, the place of its effects and, the place where the enforcement decision will be ruled. However, geographical boundaries should not affect vested rights. Therefore, it is crucial to grant mechanisms that will ensure the enforcement of foreign decisions. Based on two Venezuelan Supreme Court decisions, this document analyses issues related with the enforcement in Venezuela of Mexican divorce judgments, considering both the Inter-American Convention on Extraterritorial Validity of Foreign Judgments and Arbitral Awards and Venezuelan domestic rules.  相似文献

Abstract

Using data on post-Greggexecutions and death sentences, we explore the previously observed, but not well understood, relationship between slavery and the death penalty. We classify modern states into categories focused on their jurisdictional law and practice of slavery circa 1860. Our analyses reveal that the relationship between slavery and modern executions is stronger even than previously recognized, with 90.6% of post-Greggexecutions occurring in states that supported the practice of slavery, whether or not they were in the Confederacy or inside the traditional boundaries of the South. We conclude that capital punishment is one of the enduring legacies of American slavery.  相似文献

Why do some authoritarian rulers, such as Saddam Hussein, kill or torture other people personally, whereas others, like Joseph Stalin, delegate such violence to subordinates? Such politically motivated interpersonal violence committed by authoritarian leaders has never before been theorized. Through a comparison of Hussein and Stalin, we explain why some dictators engage in this behavior and others do not. We propose a model based on three components: the individual's prior habituation or non-habituation to violence; regime characteristics that ‘select for’ a personally violent or non-violent ruler; and, once a ruler takes power, the interaction of the first two variables. We also suggest that most communist regimes featured organizational characteristics that discouraged such violence by the leader.  相似文献

The Supreme Court has recently decided to re‐examine the constitutionality of executing individuals under the age of 18 at the time of the offense. The Supreme Court’s reliance on public opinion as evidenced through opinion polls and changing laws in the 2002 Atkins decision has suggested that public opinion may play a role in the Court’s decision regarding juvenile executions. There is considerable evidence that the majority of Americans favor a ban on juvenile executions. In the current study, we use Oklahoma data collected in 2003 by the Oklahoma University Public Opinion Learning Laboratory to examine more closely the factors that predict a support of a ban on juvenile executions. Interestingly, only one fourth of Oklahomans oppose such a ban. Earlier research suggested that religious fundamentalism is linked to support of juvenile executions, but we did not find this, suggesting that public opinion may be shifting. We then analyzed the data separately by race and then by sex. Our findings suggest that there may be differences between groups in the predictors of support for a ban on juvenile executions, at least in Oklahoma, indicating the need for further research.  相似文献

In this article we analyse various forms of emotional management of mourning in the experiences of six female relatives of victims of extrajudicial executions in Colombia. Referencing the concept of the ‘spectral’, we discuss the ways in which family members establish ways of living with mourning that emphasise the impossibility of achieving closure, and explore the ways in which they keep the wounds of their suffering open as a means of organising themselves politically, in pursuit of justice. The article suggests an alternative to a teleology of closure, suggesting that, in contexts of impunity such as the one prevailing in Colombia, mourning becomes a scenario of habitability.  相似文献

Does the death penalty save lives? In recent years, a new round of research has been using annual time‐series panel data from the 50 U.S. states for 25 or so years from the 1970s to the late 1990s that claims to find many lives saved through reductions in subsequent homicide rates after executions. This research, in turn, has produced a round of critiques, which concludes that these findings are not robust enough to model even small changes in specifications that yield dramatically different results. A principal reason for this sensitivity of the findings is that few state‐years exist (about 1 percent of all state‐years) in which six or more executions have occurred. To provide a different perspective, we focus on Texas, a state that has used the death penalty with sufficient frequency to make possible relatively stable estimates of the homicide response to executions. In addition, we narrow the observation intervals for recording executions and homicides from the annual calendar year to monthly intervals. Based on time‐series analyses and independent‐validation tests, our best‐fitting model shows that, from January 1994 through December 2005, evidence exists of modest, short‐term reductions in homicides in Texas in the first and fourth months that follow an execution—about 2.5 fewer homicides total. Another model suggests, however, that in addition to homicide reductions, some displacement of homicides may be possible from one month to another in the months after an execution, which reduces the total reduction in homicides after an execution to about .5 during a 12‐month period. Implications for additional research and the need for future analysis and replication are discussed.  相似文献
