关于我国劳务派遣行业存在的问题及建议探讨

劳务派遣是伴随着经济社会发展产生的一种新的就业组织方式,它不仅为企业提供了灵活用工的新途径和有效服务,也对缓解我国严峻的就业压力作出了有益贡献。但是,由于目前劳务派遣中大量存在的不规范行为,特别是适用范围的无序扩大,导致了劳务派遣人员的合法权益受损,企业培训员工的积极性缺失,职工队伍建设受到严重影响,制约了我国产业升级和产业转型,成为加快转变经济增长方式的重要影响因素。     

空间认知的几点反思

空间理论探究近年来成为学术界关注的热点，但从不同流派的空间认知中，可以发现他们对空间的认知或者基于空间理论展开的其他研究，都不同程度地存在着脱离对空间本体及基本属性认知的局限，因而从空间本体论、空间属性、空间方位、空间与时间关系角度全面深入地对其展开探究，是科学准确地把握空间基础理论的关键，也是进一步展开空间理论其他研究的前提。     

Assessing Risk of Placement Instability to Aid Foster Care Placement Decision Making

Placement stability is of critical importance to the well-being of children in foster care and has an impact on other key outcomes. Placement decision-making that matches children with placement resources is often cited as a practice that impacts placement stability, but little research exists to inform this practice. The focus of this research is on a child assessment tool that was developed to determine the appropriate level of care, which serves as one component of a web-based matching system that pulls together child and placement information used to inform the placement decision. The research examines the relationship between the child assessment subscale domains and placement stability for first and subsequent placement decisions and evaluates the stability of placements made in and outside of the indicated level of care.     

Electoral colorism: Candidate skin color and list placement in Ecuador

To what extent does candidate skin color influence party list placement in proportional representation systems? While candidate skin color is increasingly understood to play an important role in politics, the extent to which it shapes electoral opportunities and outcomes remains unclear. In this paper, we investigate whether party elites in list proportional representation systems place darker-skinned candidates in lower, less advantageous list positions than their lighter-skinned copartisans. Drawing on party lists from Ecuador’s 2021 National Assembly elections and an original measure of candidate skin color, we find evidence that candidate skin color is a significant determinant of list placement. This finding indicates that party lists reinforce color-based inequalities in political representation and reveals that a candidate’s skin color shapes their chances of winning elected office.     

The legal and administrative processes in adoption: views and experiences of newly formed adoptive families

The early stages of adoptive placements are important in achieving successful long-term outcomes for adopted children and their families. This paper reports on findings from the Wales Adoption Study, in which adoptive parents shared their views and experiences of the legal and administrative processes in obtaining an adoption order. Parents described a range of difficulties that added to anxieties and delays. These arose mainly through poor communication about the steps in the legal process and avoidable administrative errors or oversights. Some parents also experienced lack of information and support regarding agreed contact arrangements and work with their child to help them make sense of their adoptive status.     

植入式广告及其法律监管制度研究

作为一种营销方式,植入式广告已经不可阻挡地出现在我们的生活中。作为一种广告方式,无论是其法律地位,还是对其的监管措施,法律至今没有明确的规定。植入式广告是一种合法的广告形式,不违反现行法律规定,没有侵犯消费者的选择权。但作为一种广告形式不应当游离于法律的监管之外,应纳入广告法的管理范围。     

Older Youth in Extended Out-of-home Care

The purpose of this study is to examine the permanency experiences of older youth, age 18–21 in out-of-home placements and placement characteristics that influence age of exit from child welfare. Findings suggest a difference between age groups with more 18-year old youth exiting to emancipation than youth who exit at age 21. A higher number of spells in care and a higher number of placement changes during the last spell were associated with exit to emancipation. Additional study findings suggests that youth who leave care before the age of 21 may be more vulnerable than youth who stay through age 21. Implications for practice are discussed.     

我国私募基金的法律规制

私募基金立法要以效率为首要价值目标,以发挥私募基金的优势。私募基金投资者具有自我保护能力,因此规范私募基金要尊重当事人的自治。我国缺乏私募基金发展的信用环境,对私募基金的立法要以不损害其发展为前提的适度监管。     

论对私募基金的法律规制

私募基金最主要的特征在于以私募方式设立，其投资者必须为具有自我保护能力的合格投资者且不得超过一定数量。私募基金不得以广告、公开或变相公开方式发行，应根据发行人与劝诱对象之间是否存在“既存的实质联系”来判断发行方式是否构成公开。为了防止私募基金公开化，对私募基金份额的转售行为必须加以一定限制。信息披露是私募发行制度中的一项重要内容，贯穿于发行与转售两个阶段。     

越战后美国对印支难民的安置与其地区分布分析

在印支3国(越南、柬埔寨、老挝)1975年后出现的难民潮中,有大批人移居美国。美国出于现实利益需要和人道主义原则而接纳了他们。最初的难民在经过收容中心后,被安置到全国不同的居留地。他们跟着又与后来的难民分别通过家庭团聚、政府的"疏散政策"以及重择高福利居留地等方式,先后进行"二度移民",从而形成了印支难民在美国地区分布的基本格局。这一分布是高度不平衡的,高集中性的。
