Mary Wollstonecraft’s divergent attitudes towards trust

ABSTRACT

Mary Wollstonecraft is increasingly being recognized as a philosopher who made a noteworthy contribution to moral and political philosophy. Her work not only encompassed political treatises, such as the now well-known A Vindication of the Rights of Woman, but also fiction. This article demonstrates how Wollstonecraft’s work comprised three main ways of engaging with trust, namely distrust, virtuous trust, and open trust. It puts these three forms of trust into context with Wollstonecraft’s ambivalent relation to the 18^th-century culture of sensibility. Moreover, Wollstonecraft’s open form of trust is compared with the 20^th-century Danish theologian and philosopher K. E. Løgstrup’s conception of trust. Løgstrup regarded genuine trust as a spontaneous, basic phenomenon that was not rooted in moral reasoning. While there are some similarities between Wollstonecraft’s open trust and Løgstrup’s understanding of trust, Wollstonecraft ultimately reinforced the value of ‘an educated heart’, namely the idea that the feelings of the heart should be cultivated by reason. Accordingly, this article offers some insight into how we may perceive Wollstonecraft’s strong rejection of Edmund Burke’s ‘inbred sentiments’, that is, Burke’s belief in innate, benign moral instincts.

容隐制作为中西方的一种普遍的法律建制,从本源处回应着生活中容隐行为的普遍性。通过对容隐现象与容隐制的解读,可揭示出情感的本源性;进而从本源情感出发,将情与德、情与法相互勾连,可引出一个建构和谐社会的发生序列：缘之以情,导之以德,齐之以法。     

Sensibility in the era of global communication: a semioethic perspective1

This article proposes a phenomenological and semiotic analysis of sensibility in the era of globalization, which is the era of global communication. How are time, space, self, others, life, death, health, illness, work, employment, unemployment, free-time, development, underdevelopment, and so forth, perceived in today's world? As vast as this excursion may seem, these different issues concerning sensibility all bear on the problem of the relation between identity and alterity. The hypothesis guiding my analysis is that the common denominator in science and sensibility today is the ideology, or ideo-logic, of identity. However, taking Europe as our societal paradigm the ideo-logic of identity reveals itself as a menace to the difficult process of forming the European Union. In Europe – indeed, in world history at large – the logic of identity and of alterity can be traced in all the important phases that have determined peoples’ historical destiny. In the current phase of development in the social reproduction system of advanced capitalism, the contrast between identity and alterity is at an extreme, at the point of exasperation. In this article I intend to explore the possibility of opening sensibility to alterity not only in Europe, but in the anthroposociosemiosic sphere at large.

犯罪易感质是社会个体在社会化过程中表现出的一种特殊状态.在一定意义上,犯罪易感质的形成是决定一个常态的行为人衍变为反社会的犯罪人的关键.与普通未成年人相比,城市闲散未成年人犯罪易感质形成的可能性较大,而其特有的生活情境往往又促成了这种可能性的实现.预防城市闲散未成年人犯罪易感质的形成,不仅在于控制犯罪行为,更根本的是提高未成年人适应社会的健康能力,这是预防犯罪过程中以人为本位思想的体现.     

台湾地区女性权力参与的现状及原因分析

台湾地区女性权力参与起步于20世纪五六十年代,随着台湾威权体制的瓦解及西方女性主义思潮的传入,女性日渐成为台湾政治运作过程中不容忽视的因素。一方面,得益于政治民主化的推进及台湾民众深厚的“悲情意识”,女性参政情况得到有效改善,越来越多的女性开始进入政治生活,甚至进入政治决策核心。女性特有的政治魅力对于政治斗争的降温、政治僵局的化解起到特殊的积极作用,从而推动了台湾政治的良性发展。另一方面,由于受到社会经济制度、传统文化观念、大众传媒等不利因素的影响,台湾地区女性权力参与的发展并非一帆风顺,仍存在参政比例偏低、参政代价较大等不足,对女性切实发挥参政议政作用造成严重制约。     

转型期乡村社区情理与法治秩序的建构

法治秩序在乡村的建立是依法治国的必然要求,但是社区情理的普遍存在是转型期乡村社会的客观现实,无法撇开社区情理来谈论乡村的法制建设。转型期社区情理的特点有利于送法下乡,送法下乡要求打破城乡二元的社会管理体制,加强乡村程序理性的建设。     

从技术到情感：刑民交叉案件管辖

司法与戏剧都是以台上表演、宣讲台词的形式来表达人性化的情感。司法入口的刑民二分法与司法过程的逻辑三段论一样都不能排除情感因素作用。刑民交叉案件很显然是在严格刑民二分观点透视下的模糊和边缘地带。遵循司法制度的合成理论和司法过程的辩证理论，反映世界潮流，体现司法民主，切合和谐主题，采“超越极端，回归情感”的思路，为积极回应和适时流转当事人诉求，把刑民交叉案件管辖的一些历史沉淀和实践探索的边缘性制度逐步固定下来，从而增加现行制度的弹性和适应力。从本质上说，以情取胜而不是以力服人也是司法和竞技的主要差别。

This article examines Robert Semple’s Walks and Sketches at the Cape of Good Hope (1803), a largely forgotten early colonial text which intriguingly blends the genres of travel writing and the sentimental novel. My analysis seeks to place the text within the longer genealogies of South African literature in English by arguing that it anticipates a number of the central concerns this literature, among them sympathy for the suffering of others, the representation of racial and social difference, and the fracturing of metropolitan literary protocols in the colonial context.
