Framing Exclusion in the Public Sphere: Far-Right Mobilisation and the Debate on Charlie Hebdo in Italy

While the January 2015 Paris terrorist attacks presented a crucial opportunity for far-right mobilisation, the focus on liberal democratic values and Charlie Hebdo’s non-conformist progressive profile presented challenges for right-wing discourse. Taking Italy as a paradigmatic case of public controversies on cultural and religious affairs, this article examines the opportunities and constraints generated by multicultural crises for far-right framing choices. A qualitative frame analysis analyses the discourse of three types of far-right actors. While the populist radical right, extreme right, and ultra-religious right groups disagree on crucial criteria for outgroup exclusion, they collectively employed the Charlie Hebdo controversy to redefine their exclusionary discourse on liberal grounds with the goal of gaining legitimacy in the mainstream public sphere.     

试论现代传媒语境中的刑事案件书写文化

各种传媒手段对刑事案件的发生、侦查、诉讼、司法监督予以不同方式的传播和解读,使得刑事案件的书写和表达形成独特的传媒文化。传媒文化拓展了刑事案件书写的场域,使之不仅仅局限于司法程序及其适用,还通过对多元文化的参照,借助当时所提供的媒介手段所提供的书写、交流和传播模式,将刑事案件书写扩充到社会舆论的"公共领域"。现代传媒文化与书写文化关系的厘清因此凝聚在对司法行为闭合式书写和公共领域开放式传播界限的严格界定,以及刑事案件司法程序中严格规范写作和现代传媒自由解读不断互渗的默许或者禁忌。     

Verschafft die direkte Demokratie den Benachteiligten mehr Gehör? Der Einfluss institutioneller Rahmenbedingungen auf die mediale Präsenz politischer Akteure

Dieser Aufsatz untersucht den Einfluss politisch‐institutioneller Kontextfaktoren auf die Artikulationschancen politischer Akteure in der Öffentlichkeit. Als empirische Grundlage dient eine Inhaltsanalyse der Schwangerschaftsabbruchdebatte in der Schweiz im Vergleich mit Deutschland und den USA über einen Zeitraum von drei Jahrzehnten. Es wird aufgezeigt, dass institutionell bedingte Machtdifferentiale ‐ vermittelt über mediale Selektionslogiken ‐ in hohem Masse die öffentliche Präsenz der Akteure, ihr mediales Standing, bestimmen. Dies benachteiligt insbesondere zivilgesellschaftliche Herausforderer, wie etwa soziale Bewegungen. Direktdemokratische Verfahren, so wird weiter argumentiert, wirken in der Schweiz diesem Effekt jedoch entgegen, indem sie den Aussenseitern Möglichkeiten zur Profilierung und Etablierung bieten. Davon profitieren ebenfalls die Parteien, welchen in der Schweiz ansonsten eine schwache institutionelle Stellung attestiert wird. Mit seinen Ergebnissen stützt der Aufsatz schliesslich die Forderung nach einer Kontextualisierung politischer Kommunikationsforschung im Sinne eines “institutional turn” und zeigt das Potenzial einer komparativen Vorgehensweise auf.     

论缔约责任的赔偿范围

缔约责任以赔偿信赖利益损失为目的,信赖利益是缔约当事人信赖对方缔约行为时所产生的利益,信赖利益损失与合同是否成立有效没有关系。在合同关系不存在情况下缔约责任人要赔偿直接损失和间接损失;在合同有效情况下,责任人仅赔偿受害人支出的额外缔约费用及其利息。直接损失的计算以实际损失为准,间接损失要分为两种情况计算。缔约责任赔偿不包括精神损害赔偿。缔约责任赔偿不受履行利益范围限制,不适用过失相抵规则,但要受可预见性规则限制。     

哈贝马斯的"公共领域"理论与传媒

哈贝马斯是当代罕有的百科全书式的大思想家。他在 4 0年前出版的《公共领域的结构转型》一书提出了传媒在他所谓的公共领域中的中心地位的著名观点。尽管他的传媒理论同他的其他理论一样被认为具有乌托邦色彩 ,但其给予传媒学术界和业界的思考是多维而深层次的 ,对于在现实情境下建构中国的公共领域和发挥传媒的社会公器功能具有学术和实践意义     

Effeminate Edmund Burke and the masculine voice of Mary Wollstonecraft

ABSTRACT

This article focuses on the gendered and nationalist rhetorical strategies Mary Wollstonecraft used in her work The Vindication of the Rights of Man which was written as an open letter of response to Edmund Burke's Reflections on the Revolution in France . While a number of scholars note Wollstonecraft’s adoption of a masculine voice in her systematic feminizing of Burke, this article also pays attention to the ways in which Wollstonecraft impugns Burke with the taints of being crypto-Catholic, Irish, and quasi-French. We notice how Wollstonecraft’s masculine voice is rational, combative, righteously passionate, middle-class, patriotically English and critically Protestant. We compare the fashioning of Wollstonecraft’s voice with contemporary political caricatures of John Bull and the cartoon depictions of Edmund Burke that appeared as Wollstonecraft was composing her VRM. Wollstonecraft’s VRM gained her considered attention and her critique of Burke’s character, (and what this article claims is her misreading of his aesthetic treatise), have been remarkably influential even to the present day. The characteristics of the distinct voice created in Wollstonecraft’s first Vindication are also evident in her second and more famous Vindication of the Rights of Woman. However, the rhetorical commitments entailed in Wollstonecraft’s public voice created challenges for her arguments in the second Vindication that demand careful attention.     

反思欧盟制宪实践——哈贝马斯式的视角

在质料意义上而言,欧盟已经存在有宪政雏形。哈贝马斯认为,制宪将会促成欧洲范围内全方位、多层次的大辩论,为各国协商对话和沟通创造契机,产生政治公共领域,培育共同政治文化。文章指出,一部形式和规范意义上的欧盟宪法是社会治理系统工程的开端和象征,代表着一种新秩序,无论是在欧盟内部还是在世界舞台上。     

基于紫外可见积分球反射光谱法鉴定血痕经历时间

目的建立一种快速鉴定血痕陈旧度的方法。方法在实验室条件(20℃、25℃、30℃)下,使用UV-2450型紫外可见分光光度计,利用反射附件ISR-240A积分球,以BaSO_4标准白板做参比,间隔一定时间测定健康人耳静脉血血痕纱布的反射光谱,采集特定波长反射率R_(541)、R_(577),计算R_(541)/R_(577)值,使用SPSS 17.0软件进行直线拟合与回归分析。结果一定条件下8 h内,血痕经历时间与其特定波长紫外可见反射率比值回归分析的R~2均大于0.8,回归方程成立,血痕经历时间与R_(541)/R_(577)值具有高度相关性。结论所建立的方法简便、快速、无损,可靠性好,可以对实验室条件下8 h内血痕经历时间进行鉴别。     

网络话语权的公共领域特征与话语民主的实现

网络作为公共舆论的重要平台,使得公民的话语权在网络空间得到全新的实现。网络公共领域的话语表达所表现出的匿名性、开放性、互动性等特点,使得网络话语权的行使具有传统媒体无可比拟的优势,成为公民问责和实践话语民主的重要形式。
