国际刑事司法协助制度的若干新发展

《联合国打击跨国有组织犯罪公约》和《联合国反腐败公约》对国际刑事司法协助制度的新近发展作出了一定程度的总结,特别是确立了以追缴被非法转移的犯罪所得或收益为中心的司法协助新体系,放宽了双重犯罪原则对非强制性司法协助活动的限制作用,全面推广司法协助"中央机关"的联系机制,同时,倡导各国在条件允许的情况下采纳远程视频听证和联合调查的取证新方式。这些发展所涉及的一些新规则值得加以深入研究。     

治理网络游戏成瘾是青少年成长发展辅导的系统工程

互联网的迅速兴起是科学技术发展创新的重要标志,也因此给青少年带来了思维、交往等模式的变化而形成了社会性的冲击,很多青少年陷入网络瘾癖不能自拔。治理青少年网络游戏成瘾的问题应是一个青少年成长发展辅导的系统工程,绝不能片面地指责网络,更不能简单地割断青少年与网络间的联系。我们需要做的:一是研究青少年发展需求,检讨青少年的生活状态,为青少年创造一个快乐成长的客观环境;二是加强青少年成长团体的建设,为孩子搭建平等交流的人际环境平台,尽可能在青少年个体的生存环境中建设起畅通的倾诉、沟通管道;三是进入孩子们的网络世界,更直接地了解虚拟世界里的孩子,更多学会掌握现代社会信息交流的工具,在现代技术的平台上与孩子共同成长。     

谈铁路反暴力恐怖中的防范与保卫

铁路联系着国民经济的各行各业,往往是恐怖分子进行恐怖活动的首选目标。事实上来自新疆、西藏等地的“东 突”、“藏独”民族分裂势力、暴力恐怖势力、宗教极端势力已对铁路构成了严重威胁。面对严峻的恐怖敌情,我们必须加强防 范与保卫工作,通过提高安全意识、加强安全措施,对可能遭受恐怖袭击的目标进行保护,防范潜在的恐怖威胁。根据铁路的 实际情况,防范工作重点是:建立和完善反暴力恐怖协调机制;加强反暴力恐怖宣传教育工作,树立全民防范意识;明确目标, 落实责任;运用手段,获取情报;加强对危险物品的监督管理。     

Gender and Disorder Specific Criminal Career Profiles in Former Adolescent Psychiatric In-Patients

A Norwegian nation-wide sample of 1087 former adolescent psychiatric in-patients, 584 males and 503 females, were followed up 15–33 years after first hospitalization. On the basis of detailed hospital records from index hospitalization all were rediagnosed according to DSM-IV. The patient list was linked to the national criminal register and the diagnostic groups were compared as to gender-specific frequency of registered criminality. Next, the criminal career characteristics were compared in those with criminal records at follow-up, relative to mental disorder at index hospitalization. The prevalence of registered criminality, both overall and for specific types of crimes, differed significantly between diagnostic groups and between genders. In both genders criminal convictions were most frequent in disruptive behavior disorders and personality disorders. Among males, the lowest violent crime rate was observed in those with psychotic disorders. Males had more severe criminal careers than females, both quantitatively and qualitatively. The diagnoses and criminal profiles of the 10 most active criminals in the study sample were described closer, as were the 11 individuals found guilty of homicide.

我国公共场所图像监视法律治理路径分析

在过去的近十年中，我国的公共图像监视在政策、项目及资金等支持下得到迅猛发展。在我国特定的政治与社会背景下，公共场所图像监视是社会治安综合治理与公共安全技术防范系统的一个组成部分．呈现出政策创议、项目推动的发展历程。在法律治理和回应性法制视角下，公共图像监视法律治理是对公共图像监视实践的法律回应。目前，我国已初步构建起涵盖宪法、社会治安综合治理法律文件、公共安全技术防范法律文件、具体领域法律文件以及公共场所图像监视法律文件等公共场所图像监视法律治理的体系，但该体系仍然存在急需健全和完善的层面。

近年来,警察权益受侵害情况越来越严重,这对公安机关的正常运转带来巨大考验。公安机关应端正侵害警察权益案件的应对措施,在法律、管理、制度等方面维护公安民警的合法权益,明晰警察行为准则,完善警察权益救济措施,从而保障警察权益不受损害,提升警察执法自信。     

They are from within us: CVE brokerage in South-central Somalia

ABSTRACT

This article explores how societal actors in Somalia take part in a transnational politics of countering/preventing violent extremism (CVE/PVE) through a political sociological approach to militarisation. We argue that the transnational politics of CVE represents an extension of global militarism by some states, institutions, donors and brokers. CVE works to adapt global militarism and to reconfigure the global-local relationships that sustain it. We explore the roles and influence of local ‘CVE brokers’ in deradicalisation efforts in South-central Somalia. They inadvertently merge the counter-terrorism approach to Somali people, values and territory with non-military means. We show that their key practices – co-ordination, translation and alignment – advance, but also disrupt, alter and transform CVE policy objectives.

Structural Covariates of Violent Crime Rates in Germany: Exploratory Spatial Analyses of Kreise

This research applies the techniques of exploratory spatial data analysis (ESDA) and spatial regression modeling to explain variation in robbery and assault rates across 413 districts or “Kreise” in Germany. The findings from ESDA reveal a distinct clustering of low rates in southern Germany, especially for robbery. The results of the spatial regression analyses indicate that for the nation at large, Kreise with high robbery and assault rates tend to be those with comparatively high levels of socioeconomic deprivation and a more urbanized environment, findings consistent with those commonly reported with data for areal units in the USA. We also observe net regional effects for the south in the regression models that pose puzzles for further inquiry into the German case, and “null effects” of the eastern region that have implications for more general debates of the potentially criminogenic consequences of the transition to market economies.
