法治社会的价值目标是追求民主、平等;法治的核心问题是约束、限制权力;法治国家的本质特征是体现民治;实现 法治化的基本途径是建立安全、方便、经济的参政方式。     

Indigenismo and the Avant‐garde: Jorge Sanjinés' Early Films and the National Project

Jorge Sanjinés9; 1960s films Revolución and Ukamau challenge the class and ethnic hierarchies of Bolivian society by casting the proletarian and indigenous masses as revolutionary liberators. The new national imaginary they evoke is tightly bound to the experimental cinematic techniques they employ, since their rejection of rationalist, realist aesthetics signals a partial undermining of the linear time of the modern nation. Ukamau both recalls and resists previous Bolivian indigenismo, which sought to co‐opt the Indian into a national mestizo consciousness. Its exoticist portrayal of the Indian ultimately limits its political effectiveness, but textual and contextual analyses show subversive Indian agency leaking through.

Nutzt ein Wohnungseigentümer einen eigenm?chtig errichteten Teil seines WE-Objekts (hier: einen von seinem Rechtsvorg?nger ohne Baubewilligung gebauten Keller) ausschlie?lich, ohne dass diese R?umlichkeit in die Nutzwertfestsetzung einbezogen worden ist, handelt es sich zwar um einen allgemeinen Teil der WE-Liegenschaft. Die Erhaltungspflicht (hier: Behebung ernster [Feuchtigkeits-]Sch?den im Keller) trifft aber nicht die Eigentümergemeinschaft, sondern nach § 839 ABGB den ausschlie?lich nutzenden Wohnungseigentümer allein. Auch eine langj?hrige Duldung der ausschlie?lichen Kellerbenützung durch den Wohnungseigentümer vermag die Erhaltungspflicht dieses Raums nicht auf die Eigentümergemeinschaft zu verlagern. Diese Duldung vernichtet lediglich den Beseitigungsanspruch wegen eigenm?chtiger Inanspruchnahme allgemeiner Liegenschaftsteile.     

The Representation of the Female Body in the Multimedia Works of Regina José Galindo

The female body is central to the performance art, poetry and blog site interventions of Guatemalan Regina José Galindo. While Galindo is best known for her performance work, this article compares the hereto overlooked, distinctive and often shocking representations of the female body across her multimedia outputs. We first consider the ways in which, in all three media, Galindo presents an ‘excessive’, carnivalised, grotesque and abject female body. Second, we analyse representations of the female body that has been subjected to violence at a private and public level. In so doing, we show how Galindo not only contests hegemonic visions of gender and (national) identity but also challenges the viewer/reader to engage with, rather than look away from, the violence to which women are subjected in patriarchal society.     

Explaining the Reversed Gender Gap in Political Consumerism: Personality Traits as Significant Mediators

Research on political consumerism documents a persistent reversed gender gap, as women boycott and buycott products more often than men. Previous efforts to explain the reversed gender gap rely on classical theoretical models developed to illuminate gender differences in political participation in general. Accounting for socio‐economic and situational factors as well as socialization leaves a significant amount of the reversed gender gap unexplained, though. Adhering to recent empirical evidence of personality as an important factor influencing political behavior, we argue that gender differences in personality traits could provide an alternative explanation to account for gender disparities in political consumerism. We use original survey data specially designed to measure political consumerism in Switzerland, which also include the Big Five model of personality. We find empirical evidence that gender differences in personality traits, in particular agreeableness, explain a significant portion of the reversed gender gap in political consumerism.     

Does Moderation Pay in a Consociational Democracy? The Marginalisation of the SDLP in the North of Ireland

A central question in the debate between “centripetalists” and “consociationalists” concerns whether power‐sharing arrangements provide incentives for moderation. This article helps to formulate an empirical answer through an examination of the electoral decline of the Social Democratic and Labour Party (SDLP) following the Good Friday Agreement (GFA) in the North of Ireland. Drawing on primary qualitative interviews with key players, this article argues that the SDLP were electoral losers under a system of ethnic out‐flanking. Sinn Féin has successfully presented itself as the “greener” and more robust representative of nationalist interests, whilst simultaneously moderating its message and operating the institutions of Northern Ireland. Sinn Féin has taken ownership of the GFA and has positioned itself as the party best able to ensure its delivery. Sinn Féin’s rights‐based agenda, and vibrant electoral machine, has resonated with the nationalist electorate who are less sure of what the contemporary SDLP stands for.     

Exploring the Effects of North–South and South–South Research Collaboration in Emerging Economies,the Colombian Case

International research collaboration (IRC) is associated with both positive and negative effects on the performance of research in emerging economies. While some authors claim that North–South collaborations improve scientific quality and visibility for Southern countries, others claim that it may entail the reorientation of research to comply with Northern agendas. South–South collaborations are thought to increase the focus on local affairs, therefore leading to a relatively small number of scientific international publications appearing in “high quality” journals. Research on the impact of IRC beyond publications in international journals has been neglected despite the importance of other products in knowledge creation. This research uses a broad range of scientific outputs to empirically assess such assumptions and explore the outcomes of IRC in Colombia. Results from multivariate regressions and nonparametric analyses show that, contrary to common assumptions, Colombian research teams collaborating with partners from the global South report higher scientific production, while those collaborating with Northern countries seem to contribute to local knowledge the most.     

Applying Stone in a Western Landscape: Ranchers,Conservationists, and Causal Stories in the “American Serengeti”

As the emergence of nongovernmental conservation efforts generates conflict among various stakeholders, the causal story that each party articulates regarding conservation and the causes of land degradation reflects their unique interests. This study uses existing literature to evaluate causal stories surrounding a contemporary conservation effort: Montana9;s American Prairie Reserve. Through qualitative review of web‐based documents and newspaper articles, it generates a preliminary account of key stakeholders9; causal stories. The case study suggests that parties who might be disadvantaged by ascribing responsibility for environmental harms in an adversarial fashion may instead elect to articulate causal stories that are more neutral than existing approaches might forecast. The study concludes by suggesting that further development of causal story literature may enable it to better address contemporary conservation efforts.     

A 21st Century Low‐Carbon Transition in U.S. Electric Power: Extent,Contributing Factors,and Implications

The U.S. electric power sector has experienced a substantial shift of the generation mix since the turn of the century, moving from heavy reliance on coal‐powered generation to one drawing more from natural gas and, more recently, renewables. This transition has been forged by a mix of macroeconomic factors (recession and recovery); technological breakthroughs (horizontal drilling coupled with hydraulic fracturing; improvements in natural gas plant efficiency); clean energy policies at federal, state, and local levels of government; and private sector demands for carbon‐free energy sources. These factors have combined to reduce carbon emissions from electric power generation substantially this century. In this article we examine the extent of this transition, its causes, as well as the distinct American institutional factors steering it, including energy and environmental federalism, electoral politics, and the political economy of clean energy policy enactment and resistance.
