Observer determination of the make,model, and year of questioned vehicles

Often, criminal acts involving a vehicle are caught on digital video surveillance systems. While potentially useful for an investigation, the recording conditions are typically less than optimal for the extraction of key information for the identification of the perpetrator, such as a license plate. Providing the make, model and year of a questioned vehicle is a common request for examiners, to narrow the field of potential suspect vehicles. This study seeks to compare the performance of a nonpeer-reviewed make, model, and year determination between two separate groups, specifically, trained forensic image examiners and nontrained individuals. Results show that even with varied image capture conditions and quality, the trained forensic image examiners more correctly and completely identified the test group of questioned vehicles make, model, and year.     

Forensic Application of Analytical Mechanics in Fatal Fall From a Height

Fatal fall from a height initiated with a swinging motion on the sagittal plane of the victim's body is examined. Method of analytical mechanics is adopted to establish the functional relations between the swinging angle of the body and the force needed to sustain the body until release, and the amount of the horizontal displacement that would occur after release. The analysis is applied to support an expert opinion presented in a criminal court in which two accused were convicted of murder for dropping a female victim from a bridge. The results indicate that it is unlikely for the body to locate as recorded by the police investigation report in the case. This study demonstrates that a straightforward mechanical analysis can be utilized to examine uncommon falling scenarios.     

人民币国际化背景下汇率对工业行业就业的影响——基于跨境贸易结算的影响因素视角

将跨境贸易人民币结算比重引入劳动力市场动态均衡模型,推导出汇率影响就业的全新路径,并利用2000-2018年中国工业行业面板数据进行实证分析。研究发现:通过进出口产品结构贸易路径,汇率对行业总体就业的正向影响最显著,其次是经由汇率变动预期路径,而汇率通过净出口指数路径对就业的负向影响较微弱。人民币汇率对不同行业就业的影响产生差异的根源是不同行业进出口产品结构及产品异质性的差距导致在汇率变动的不同情形下,行业间跨境贸易人民币结算的水平不同,从而造成外贸企业对劳动力的需求具有差异。并且,技术特征及贸易来源地特征是造成行业间就业水平差异的显著因素。     

跨境民族因素对阿巴边境地区毒品问题的影响

随着1979年苏联入侵阿富汗和阿富汗抗苏战争的开展,阿富汗和巴基斯坦边境地区的罂粟种植面积迅速扩大,毒品产量迅速增加,成为世界毒品市场的重要来源地。阿巴边境地区的普什图人和俾路支人等跨境民族在"金新月"地带的罂粟种植和毒品生产中扮演着重要的角色。20世纪80年代后,阿富汗生产的鸦片主要来源于阿巴边境的普什图人村庄,巴基斯坦的罂粟种植也主要集中在以普什图人为主的西北边境省和联邦直辖部落地区。多年以来,尽管阿富汗和巴基斯坦政府在阿巴边境地区不断采取禁毒措施,发展替代种植,但是均未能清除该地区的罂粟种植和毒品生产。阿巴边境的普什图人、俾路支人等民族长期种植罂粟并参与毒品走私的原因包括历史、政治和经济等因素。从历史上看,阿巴边境的普什图人有种植罂粟的传统,出售鸦片是他们重要的经济来源之一。从政治上看,阿富汗和巴基斯坦两国政府不能对边境地区进行有效的管理和控制,从而为边境地区的普什图人和俾路支人种植罂粟和从事毒品走私提供了条件。此外,一些政党为了拉选票而支持当地人们种植罂粟也是重要的政治原因。从经济上看,种植罂粟的收入要高于种植小麦的收入,贩卖毒品的利润较高是吸引阿巴边境的普什图人、俾路支人等民族种植罂粟和从事毒品走私的重要原因。     

相对集中行政处罚权：立法模式与制度创新

相对集中行政处罚权实践是我国行政管理体制的创新举措,已经取得了较明显的效果。但目前囿于立法层次较低,且各地规范不一,极大地阻碍了这一新生事物的进一步成长。因此我们应在统一立法和系统全面立法的基础上,尽快制定一部法律或行政法规系统规范该制度。同时加强诸如表明身份制度、说明理由制度、阅卷制度、时效制度、格式化制度、职能分离制度、案卷排他性制度等研究,以丰富和完善该处罚权的实践。     

论新时期公安院校形象设计

公安院校形象设计是公安院校寻求广泛社会支持、提高综合竞争力、满足不同社会群体心理诉求的总体规划。设计良好、有特色的高校形象,要在确立办学理念的前提下,通过行为识别系统规范学校运行,通过视觉识别系统提升学校形象,并根据情况分别采用以传播媒介为主、以交际为主、以服务为主、以自我完善为主等不同的模式。     

Data Protection: An Opening Door?

Swedish public law has incorporated a general rule of public access to documents, and to information in the wider sense, since the Freedom of the Press Act of 1766. On the Community level, the relationship between Regulation (EC) 45/2001 on data protection and Regulation (EC) 1049/2001 on public access to documents exemplifies the tension between the public's interest in scrutinising the administration carried on in its name, and the integrity of the individual. However, a similar tension exists between Sweden's Personal Data Act of 1998, implementing Directive 95/46, and the Freedom of the Press Act. A misuse model of data protection law, by seeking to concentrate on serious rather than technical infringements of privacy, might serve to ease the tension. Managing commercial risks in open source software licensing

Legal context: The article reviews the commercial risk allocation clauses intypical open source licence terms and discusses their enforceabilityand implications. Key points: The enforceability of warranty disclaimers and limitation ofliability clauses in common open source licence terms is questionable,particularly in a cross-border context, and commercial licensorsshould take additional steps to protect themselves from down-streamrisks. Practical significance: Open source software presents a number of unusual commercialissues, because it is available free of charge and the providerstry to disclaim warranties and liabilities. End users and resellershave to adjust their own in- and out-licensing models to accommodatethis situation.     

大学生就业困境及法律保障问题研究——以《劳动合同法》制定为视角

1999年6月,随着我国高校扩招政策出台,我国高等教育步入跨越式发展阶段,这使得我国高校毕业生激增,而在短期内,社会对高校毕业生的需求增加幅度不会有很大变化.因此,在激烈的竞争中大学生就业弱势地位会愈加明显.大学生就业困境已经成为一个社会问题,如何解决大学生就业的法律保障是今后的一项重大课题.2006年3月20日,全国人大常委会向社会公布<中华人民共和国劳动合同法(草案)>并征求意见,此举无疑为研究大学生就业中的法律保障问题提供了新的契机.因此,基于大学生就业中缺乏法律保障之背景,探讨大学生就业的劳动合同法保护尤为必要.     

Hearts, as well as Minds: Wellbeing and Illness among Greek Cypriot Refugees

Recently the psycho-social health of refugees has rightly receivedemphasis, but the physical health of long-term refugees warrantssimilar attention. This paper uses qualitative and quantitativedata on informant-reported health outcomes for two Greek Cypriotvillage cohorts, one displaced, the other not displaced. Supplementarydata from a national diabetes prevalence study confirmed a possiblelink between refugee status and greater probability of cardiovascularillness. Depressive illness also seemed higher among the refugeevillage cohort. But it is not only the illness of some of theserefugees, but their surviving this, and the comparative wellnessof others which is important, compared with the ‘demographicshock’ victims of post-socialist Europe, 1989–1995.The paper suggests why the Greek Cypriots have done rather betterin health terms than the post-socialists of Eastern Europe,1989–1995, but argues that refugees in failing statesmay have much worse health outcomes.
