目前,西部地区的信息生产能力明显落后于全国平均水平。其中最为关键的制约因素,或者说对今后西部地区信息资源的生产起主导性作用的因素在于:数据库生产能力和多媒体文献资源的生产能力。     

iCLIC Data Mining and Data Sharing workshop: The present and future of data mining and data sharing in the EU

Held at Southampton University's Highfield campus and hosted by iCLIC, an interdisciplinary core on Law, the Internet and Culture, the Data Mining and Data Sharing workshop brought together attendees and speakers from industry, government, academia and a range of disciplines alike. The workshop comprised two sessions, each with a keynote and an associated panel. The first session was chaired by Eleonora Rosati and dealt with copyright and database rights, data mining and data sharing. The second session, chaired by Sophie Stalla-Bourdillon, focussed on data protection, data mining and data sharing. The following report covers both sessions, associated panel discussions and the subsequent question and answer sessions.     

English High Court decides that “making available” over the internet only occurs in the jurisdiction where the servers are based

The English High Court has considered the meaning of “making available to the public” by online transmission in the context of database rights and has determined that the act of making available is only committed in the country where the host server is located, and not the country where the material is accessed by the public.     

The efficiency of Y-chromosome markers in forensic trace analysis and their inclusion in the Austrian National DNA Database

Y-STR markers are a valuable tool in the analysis of biological traces in which a mixture of male and female trace material is to be expected. It is possible to generate a Y-chromosome DNA profile, even if all the prior sperm tests are negative and no sign of any male component is found in amelogenin. In 38 of a total of 239 sexual offences a perpetrator trace was identified solely using Y-STR analysis. Based on these findings, the Austrian National DNA Database was expanded to include Y-STRs in 2012 with the primary objective to identify serial sexual offences.     

Haplotype diversity in human mitochondrial DNA hypervariable regions I–III in the city of Caracas (Venezuela)

In order to expand the database of variable DNA for forensic identification purposes in Venezuela, we analyzed the sequence polymorphisms of mitochondrial DNA (mtDNA) hypervariable regions (HVR) I–III from 100 unrelated individuals from the city of Caracas, using PCR amplification and fluorescent-based capillary electrophoresis sequencing method. Dominant haplogroups corresponded to Native Americans followed by African ones. The inclusion of HVR III although useful for sub-haplogroup assignation, added little to the discrimination capacity of our database.     

European Court of Justice rules on the protection of databases under the Database Directive (96/9/EC)

The European Court of Justice has ruled on the circumstances in which databases may be protected by the Database Directive. In a decision that renders the protection of databases a narrow concept, the ECJ appears to have introduced a new requirement that a database must comprise its author's “creative ability” in order to qualify for protection as a copyright work.     

Trends in Converted Firearms in England & Wales as Identified by the National Firearms Forensic Intelligence Database (NFFID) Between September 2003 and September 2008

Abstract: The National Firearms Forensic Intelligence Database (NFFID © Crown Copyright 2003‐2008) was developed by The Forensic Science Service (FSS) as an investigative tool for collating and comparing information from items submitted to the FSS to provide intelligence reports for the police and relevant government agencies. The purpose of these intelligence reports was to highlight current firearm and ammunition trends and their distribution within the country. This study reviews all the trends that have been highlighted by NFFID between September 2003 and September 2008. A total of 8887 guns of all types have been submitted to the FSS over the last 5 years, where an average of 21% of annual submissions are converted weapons. The makes, models, and modes of conversion of these weapons are described in detail. The number of trends identified by NFFID shows that this has been a valuable tool in the analysis of firearms‐related crime.
