回归法律规范:刑事值班律师制度适用问题再反思

目前我国刑事值班律师制度规范背后折射出有权机关抑制辩方权利的倾向。根据法律规范意旨,只要被追诉人没有辩护人,国家就应“强制指派”值班律师介入案件。将“约见”解读为国家指派值班律师需以被追诉人申请为前提,这混淆了律师会见与介入案件的关系,且将国家责任转嫁给个人,弱化了对被追诉人获得最低限度法律援助权利的保障。相关规范性文件将值班律师阅卷权能限定为“查阅”,但基于法律援助法第37条的文义、控辩平等之程序公正底线要求等因素,值班律师阅卷权能还应包括“摘抄”“复制”。《法律援助值班律师工作办法》第10条第2款规定,值班律师有量刑异议时,只要其认可犯罪嫌疑人认罪认罚的自愿性,就应在具结书上签字。这是对值班律师功能“见证化”的公开宣示,与2018年刑事诉讼法第201条的意旨以及值班律师实质性参与量刑协商的改革要求相矛盾。值班律师应被赋予拒绝签字的权利。“实质性参与”应是目前完善值班律师制度的基本方向。     

马克思主义妇女理论中国化的百年流变探究

马克思主义妇女理论中国化就是将马克思主义的妇女理论与中国发展和中国妇女具体实际相结合的过程。马克思主义妇女理论中国化可使其更加适合中国妇女发展的国情,契合中国妇女解放的需要,解决我国妇女发展过程中面临的问题。伴随马克思主义中国化而推进的马克思主义妇女理论中国化已有百年历史,在此进程中,随着国情的变化,妇女理论的主题也发生着深刻的变化。立足以实践为基础的马克思主义辩证唯物主义和历史唯物主义视角,回答马克思主义妇女理论中国化从何而来、何以可能、向何而去的理论和现实问题,就需要从党的领导、人的全面发展、妇女理论中国化进程中的媒介、妇女理论中国化进程中的历史分期和妇女理论中国化的最新成果等五个维度,探究马克思主义妇女理论中国化的百年流变。     

地方创新性立法的限度及其规范化

地方创新性立法是推进地方治理法治化的重要手段,鼓励地方立法创新是完善我国立法体制的应有之义。为实现地方创新性立法的规范化,应明确地方性事务的判断标准,引入重大事项请示报告制度,加强立法决策量化论证。     

非正规的“正规化”:劳动力市场分割与家政服务企业——基于2019年四个城市的家政工人调查

在非正规就业盛行的家政市场,家政服务企业的重要性日益凸显,亟待考察这些劳动力市场中介机构的就业效果。通过分析2019年四个城市的家政工人调查数据,发现家政服务企业的发展可能会影响家政业内不同工种的收入差距,改变非正规就业市场的原有结构。伴随管理者企业的介入,家务员收入大幅提升,母婴护理员和家庭保洁员的收入则出现下降。家政企业对工人收入的改善和工作正规化的促进作用是有限的。本文不仅呈现了家政就业市场内部的异质性,为家政工作的正规化讨论提供中国经验数据,还指出劳动力市场中介机构在以女性为主的非正规就业市场上的特殊性,具有一定政策意义。     

论税收法定原则的司法化

税收法定原则的司法化是“全面落实税收法定原则”的必然要求,而传统理论疏漏了其中的司法内涵,导致税收法定原则出现了作为基本原则却难以直接指导和适用于税收司法的悖论。鉴于税收法定原则与罪刑法定原则的亲缘性,发展相对成熟的罪刑法定原则可以为完善税收法定原则的内涵构成提供三点启示。同时,结合税收法定原则的固有内容,税收法定原则的司法化应当在适用范畴上向司法原则扩围,价值层次上向实质正义升华,法定程度上向相对法定适当松动。据此,三路并进,税收法定原则的司法内涵得以全面、系统的补漏。税收法定原则司法内涵的完善将有助于打破税收法定原则司法化的理论困局,助推“全面落实税收法定原则”法治图景的实现。     

Harming America: Corporate Crime in a Context of Deregulation

ABSTRACT

Like many Republican presidential candidates before him, Donald J. Trump campaigned on a pro-business, anti-regulation platform, and since his election in November 2016, he has directed his administration to move forward with deregulation in many arenas, including consumer financial protections, environmental controls, and workplace safety among others. Past efforts to roll back regulations governing certain industries, such as the savings and loan and the mortgage industries, have had harmful consequences for the general public or for specific interest groups. In this study, we review what the Trump administration has accomplished with regard to deregulation to date. Then, based on past deregulatory fiascos, we theorize the harmful collateral consequences that may result from this most recent swing of the regulatory-deregulatory pendulum.     

Psychopathy and Female Gender: Phenotypic Expression and Comorbidity; A Study Comparing a Sample of Women Hospitalized in Italy's Maximum Security Facility with Women Who were Criminally Sentenced and Imprisoned,

Various studies have shown that women with psychopathy tend to commit crimes that are less violent than those of psychopathic men. The present study was designed to address the influence of psychopathy on the crimes committed by female offenders. A national sample of female offenders found NGRI or of diminished responsibility and at risk for criminal recidivism (OPG patients) was compared with a sample of female offenders who were convicted and imprisoned. Results of this comparison between the two groups of female offenders indicate that psychopathy is a transversal psychopathological dimension which may or may not be associated with other mental disorders. In both samples, the most commonly reported offenses among women with high PCL‐R scores were minor offenses, not particularly violent, but they appear to be related to typical psychopathic features such as superficial charm, pathological lying, and manipulation.     

建构亲密与控制情绪:幼儿教师的情感劳动研究--以北京市3所幼儿园的田野调查为例

儿童抚育从家庭领域走向公共领域,由此诞生了照料和教育儿童的专门职业--幼儿教师。本研究关注幼儿教师职业群体,基于田野调查与访谈,从情感劳动理论视角对其劳动过程进行研究。研究发现,幼儿教师的情感规则包括两方面:一方面,作为照料者,他们被期待付出"像妈妈一样的爱",与幼儿建立起亲密情感联结,并对其进行无微不至的照顾;另一方面,作为教育者,他们需要遵循"温柔而坚定"的情感规则,管理负面情绪的表达,并选择合适的互动方式实现教育目的。本文还讨论了幼儿教师在情感劳动的实践中面临的不同情境以及应对策略,包括工作环境的压力与限制、教师与家长之间部分理念与行为相互冲突背后隐含的期待,分析了园所类型可能对幼儿教师情感劳动产生的影响。     

Pursuing the allure of combat: an ethnography of violence amongst Iraqi Shi’I combatants fighting ISIS

The social sciences speak of violence through its meaning, performances, manifestations and representations; however, the inner workings of violence are less explored. In order to suggest a different mode of seeing violence, I explore the inner workings of violence through the pleasures of and fun among Shi’i volunteer combatants. I apply Walter Benjamin’s motion of pure means to explain how violence becomes self-referential and non-representational via combat-zone ethnography amongst Iraqi Shi’i militants who fought against ISIS in Iraq. I address the fine line between pleasure and fun in order to highlight the inner workings of violence during combat and to encourage a fresh bottom-up anthropological perspective in assessing the parameters of the persistence and resilience of volunteer combatants. My approach advocates moving beyond recruitment and ideological interpolation by questioning the allure of combat through an ontological framework that includes combatants’ perspectives and narratives.     

Defenders of Freedom or Perpetrators and Facilitators of Crimes? Beyond Progressive Retreatism in the Trump Era

ABSTRACT

Heavily influenced by broad definitions of crime developed by a few pioneering critical criminologists, the main objective of this article is to provide evidence showing that the current Trump administration is a regime that commits crimes of the powerful and facilitates some types of interpersonal violence in private places. Special attention is devoted to direct and in-direct state-perpetrated violent crimes against women.
