应当将刑法第239条第2款"犯前款罪"的成立时间限制解释于绑架罪既遂以后,在绑架过程中致使被绑架人死亡的,根据行为以绑架罪(未遂)与故意伤害致人死亡或过失致人死亡等罪名数罪并罚;杀害被绑架人的,以绑架罪(未遂)与故意杀人罪数罪并罚。致使被绑架人死亡不是结果加重犯,而是结合犯。
