女精神病人久卧街头,警察拒绝救助引发争议。根据《人民警察法》,公安机关有协助救助的义务;依照《城市生活无着的流浪乞讨人员救助管理办法》,对于城市流浪乞讨人员,公安机关不能再强制收容遣送。由于缺乏法律依据,没有行政管束权力,警察无法发挥协助救助的作用。警务实践已经突破警察法建立的框架,迫使我们增加适应社会需要的新的法律规范,适度地扩大警察职权,构建行政管束制度。 相似文献

ABSTRACTThe authors draw on two competing cultural perspectives—culture as values and culture in action—to examine the relationship between street codes and the propensity to violently victimize others. Specifically, they explore whether individual-level and school-level street codes, net of one another, are related to 3 types of violence: assault, robbery, and sexual battery. In addition, they consider whether these effects vary according to 3 contextual characteristics: (a) the location of the offending—in school versus out of school, (b) school-level economic disadvantage, and (c) school efficacy. Three-level ordinal logistic regression models are estimated using four waves of survey data from over 3,000 students nested within 103 schools. Results provide evidence that individual-level street codes are related to violent offending in a manner that is, largely speaking, not tied to context. However, there is some evidence that the effects of school-level street codes on offending differ between outside of school and in school settings and are conditioned by levels of school disadvantage and efficacy. Overall, some support is offered for both the culture-as-values and culture-in-action perspectives. 相似文献

This study examined street robbery patterns in Philadelphia, Pennsylvania, from the years 2009 to 2011 to determine whether the effects of potentially criminogenic places are different across different periods of the day. Census block (N = 13,164) street robbery counts across four periods (6:45 a.m . to 9:59 a.m., 10:00 a.m . to 4:29 p.m ., 4:30 p.m . to 9:14 p.m ., and 9:15 p.m. to 6:44 a.m. ) were modeled with 12 different potentially criminogenic places, 3 measures of illicit markets, 4 compositional control variables, and spatially lagged versions of the 12 potentially criminogenic places and population using simultaneously estimated negative binomial regression models. Differences in the magnitudes of the parameter estimates across the time periods were assessed with Wald tests. Overall, the patterns across the four models were mostly consistent with the effects hypothesized based on the study's crime pattern theory and time‐geography theoretical frame; yet differences in the magnitudes of the coefficients were less pronounced than hypothesized. Overall, the results provide moderate support for the crime pattern theory and time‐geography explanation of spatial‐temporal robbery patterns; however, numerous points are raised for future crime and place research. 相似文献

Within any type of system, the actors in the system inevitably compete over resources. With competition comes the possibility of conflict. To minimize such effects, actors often will partition the system into geographic territories. It is against the larger ecological backdrop of competition and conflict that we examine territory formation among urban street gangs. Although previous studies have examined the social and built environment where gangs form, and how the presence of a gang influences local levels of violence, we know little about how competitive interactions are tied to the formation and maintenance of gang territories. We use formal spatial Lotka–Volterra competition models to derive hypotheses about competition‐driven territory formation. By using data on 563 between‐gang shootings, involving 13 rival street gangs in the Hollenbeck Policing Division of Los Angeles, we show that violence strongly clusters along the boundaries between gangs in a way that is quantitatively predicted by the theory. The results suggest that even weak competitive interactions between gangs are sufficient to drive gang territory formation without recourse to other processes or assumptions. 相似文献

Weisburd, Groff, and Yang argue that there is a ‘law of concentrations of crime at place’ within cities. In this paper, we provide a test for this proposition in Tel Aviv-Jaffa. We found that crime concentrations at street segments in 2010 were remarkably similar to those observed in American cities. About 4.5% of the street segments produced approximately 50% of the crime, and about 1% of street segments produced 25% of crime. Our study provides important verification of the broad applicability of the law of crime concentrations at place. 相似文献

L'étude des réformes de l'administration et des institutions publiques suisses a considérablement délaissé la problématique des conséquences des changements sur le terrain et surtout n'a pas analysé le vécu des acteurs administratifs de base. Notre étude vise, au niveau analytique, à rendre compte du vécu des réformes à l'échelon des «petits fonctionnaires»; sur un plan méthodologique, une enquête de nature ethnographique est introduite pour étudier ce questionnement. Notre enquête sur la réforme de l'armée suisse «Armée XXI» sert d'illustration. Si notre démarche permet de parvenir à des résultats intéressants sur les conséquences et le vécu de cette réforme, elle comporte également des enjeux empiriques spécifiques articulés autour de la question centrale de la relation du chercheur à son terrain. Au final, une microsociologie ethnographique du vécu des réformes par les acteurs de base nous semble susceptible de contribuer à un enrichissement de la recherche sur les transformations récentes des institutions publiques en Suisse. 相似文献

Street networks shape day‐to‐day activities in complex ways, dictating where, when, and in what contexts potential victims, offenders, and crime preventers interact with one another. Identifying generalizable principles of such influence offers considerable utility to theorists, policy makers, and practitioners. Unfortunately, key difficulties associated with the observation of these interactions, and control of the settings within which they take place, limit traditional empirical approaches that aim to uncover mechanisms linking street network structure with crime risk. By drawing on parallel advances in the formal analyses of street networks and the computational modeling of crime events interactions, we present a theoretically informed and empirically validated agent‐based model of residential burglary that permits investigation of the relationship between street network structure and crime commission and prevention through guardianship. Through the use of this model, we explore the validity of competing theoretical accounts of street network permeability and crime risk—the encounter (eyes on the street) and enclosure (defensible space) hypotheses. The results of our analyses provide support for both hypotheses, but in doing so, they reveal that the relationship between street network permeability and crime is likely nonlinear. We discuss the ramifications of these findings for both criminological theory and crime prevention practice. 相似文献

This longitudinal, multimethod study uses geographical information system (GIS) software to evaluate the community-wide impact of a neighborhood revitalization project. Unsystematic visual examination and analysis of GIS maps are offered as a complementary tool to quantitative analysis and one that is much more compelling, meaningful, and effective in presentation to community and nonscientific professional audiences. The centerpiece of the intervention was the development of a new, middle-class housing subdivision in an area that was declining physically and economically. This represents three major urban/housing policy directions: (1) the emphasis on home ownership for working-class families, (2) the deconcentration of poverty through development of mixed-income neighborhoods, and (3) the clean up and redevelopment of contaminated, former industrial brownfields. Resident survey responses, objective environmental assessment observations, and building permit data were collected, geocoded at the address level, and aggregated to the block level on 60 street blocks in the older neighborhoods surrounding the new housing in two waves: during site clearing and housing construction (Time 1: 1993–95) and three years post-completion (Time 2: 1998–99). Variables mapped include (a) Time 1–2 change in self-reported home repairs and improvements, (b) change in the assessed physical condition of yards and exteriors of 925 individual residential properties, (c) change in residents' home pride, and (d) a city archive of building permits at Time 2. Physical conditions improved overall in the neighborhood, but spatial analysis of the maps suggest that the spillover effects, if any, of the new housing were geographically limited and included unintended negative psychological consequences. Results argue for greater use of GIS and the street block level in community research and of psychological and behavioral variables in planning research and decisions. 相似文献

The adoption of SOGI policies depends on the strategies activists choose to support or oppose them. Nevertheless, the conditions that explain why some strategies are prioritised over others are not evident. In Peru, the 2013 debate over civil unions prompted a strategic shift in which the conservative wing started to benefit from intensive street mobilisation strategies. Why did this change occur? We argue that a deeply divided electoral competition and the decay of the Catholic Church's moral authority favoured this outcome. This article analyses the trajectory of these strategies over time to identify the conditions that contributed to the shift. 相似文献
