A view from the policy community: a new strategic narrative for Europe?

ABSTRACT

Reflecting on the results presented in articles in this special issue, European leaders should take greater account of external perceptions in crafting the European Union's strategic narrative and guiding its actions. Failure to do so has impaired external policies like the Euro-Mediterranean Partnership, the European Neighbourhood Policy and Eastern Partnership. Leaders emerging from the Arab uprisings perceived the EU as complicit with their countries’ former anciens régimes and Russian leaders see EU support for democracy and the market economy in former Soviet states as duplicitous and instrusive. Awareness of such perceptions should be filtered into EU decision-making, without validating views that European officials and diplomats consider misleading.     

CSR and social conflict in the Brazilian extractive sector

ABSTRACT

Corporate social responsibility (CSR) is an important means to address conflicts, support local development and build trust between businesses and civil society. Yet CSR often fails to live up to its ambitions and can even exacerbate conflicts between companies and communities. In this article we consider how changing CSR strategies over the past four decades between Brazilian company Vale to Norwegian company Hydro have fomented or mitigated company–community conflicts in Northern Brazil. We find that paternalistic and philanthropic approaches of Vale over time led to deep resentment and mistrust due to underdevelopment and environmental damages. Moreover, while Hydro’s more modern CSR strategies sought to deepen community engagement and build legitimacy, the company has struggled in addressing the legacies inherited from Vale and past and current civil society grievances. The case suggests that even forward-thinking CSR approaches are vulnerable to failure where they prioritise business risk over community engagement, neglect to account for past legacies in areas of operation, and fail to create a shared vision of future development. It suggests that EI companies should both understand and engage with their social and environmental impacts in the past, present, and future and create shared economic benefits in the short and long term in order to address social conflicts.     

An analysis of the fundamental tensions between copyright and social media: the legal implications of sharing images on Instagram

ABSTRACT

Copyright is inherently intertwined with the development of technology and none more so than the advent of the Internet and sharing technologies. More recently, social media platforms have become the latest challenge for copyright law and policy. This article builds on the literature that recognises the underlying conflict between copyright and social networking sites (SNSs); namely that the basic implication of copyright is the restriction of copying, whereas the ethos of social networking is the promotion of sharing. In particular, this article focuses on the disparity between the restricted acts of copying and communication to the public under copyright law and the encouragement of sharing on SNS Instagram. In doing so, it contextualises the debate surrounding copyright and social media and provides an understanding of the legal implications of using Instagram. As such this paper analyses (1) the infringement of copyright protected work on Instagram, and (2) the user-agreement and licensing of copyright material on Instagram. This study concludes that the disparity between the principles of copyright and social media lead to confusion and vulnerability of users. Therefore, it is suggested that Instagram should better inform its users of the implications of sharing third-party content as well as the terms of its user agreement. This could be done by implementing a copyright strategy, which includes a notice and takedown system as well as investing in producing educational content for users. Perhaps SNSs, such as Instagram might be more motivated to take steps to recognise intellectual property rights if they were considered Internet Services Provides such as YouTube.     

Articulating the threatened suffragette body: suffragette embroidered cloths worked in Holloway Prison, 1911–1912

ABSTRACT

In public archives there are a number of hand-embroidered cloths worked by suffragettes incarcerated in Holloway Prison between 1911 and 1912. Denied political status, some of the embroiderers used the hunger strike as a political tool and were forcibly fed. In this paper the embroideries are reframed as material and discursive evidence of suffragette prison experiences. The material narratives of the embroidered cloths are traced, drawing on a dialogue between critical theory, material object enquiry, practice as research and the work of contemporary textile practitioners. Embroidering by suffragettes is explored as an embodied and situated ‘thread act’ that materialised the making of networks, the need for protection of the body and mind, the powers and dangers of boundary crossing, and proto-political thinking.     

全面从严治党背景下的农村基层党组织建设——基于陕西省延安市索洛湾村的调研

加强农村基层党组织建设是坚持和加强党对农村工作全面领导的必然要求,是巩固基层政权的迫切需要,是巩固党在农村执政基础的应然选择。但是,部分农村基层党组织软弱涣散,党员结构不平衡,在党意识不强,农村干部本领恐慌,管理制度、监督机制不健全。需要通过选优配强带头人,提升党员队伍素质,增强服务效能,提升乡村治理能力,落实主体责任等路径,推动农村基层党组织全面进步、全面过硬,促进全面从严治在农村落地生根。     

Citizen aid,social media and brokerage after disaster

Abstract

In a crisis, aid providers deliver humanitarian relief across a hierarchy of organisations where influence and capacity map to their scale of operations. On the front lines of crises, ‘citizen aid’ is what small, local and informal groups offer to fellow citizens. These citizen aid groups are well-networked in place and tend to work through longstanding personal relationships. In the Philippines, citizen aid groups frequently support their activities by documenting their work with photos of beneficiaries to solicit donations from within the country and around the world across social media platforms. This paper builds on recent debates on brokerage through a case study of citizen aid in the relief effort after Typhoon Haiyan (2013–2017). Using this case-study approach, we demonstrate how social media has produced novel forms of brokerage shaped by circulating images online. This new kind of brokerage involves a layered network of brokers that both shapes citizen aid efforts and creates new channels for localising aid, enhancing the control of citizen groups in the Global South over aid.     

统筹各类编制资源的改革方向和政策建议

统筹使用各类编制资源,是新时代机构和行政体制改革的重要方向。本文首先分析了编制分类的内容构成、不同类型编制的管理权限、编制总量控制的政策约束,进而对编制分类管理的效应及带来的问题进行了综合性分析。接着,追踪梳理当前地方统筹使用各类编制的最新探索和创新。在此基础上,从跨类别、跨部门、跨地域、跨层级四个维度,提出编制统筹管理改革的思路和政策建议。     

法律全球化中的刑法现代化——刑法现代化的一个问题

本文探讨了法律全球化下刑法的现代化及其功能的转变问题 ,认为对刑法乃至整个法律体系的本质都须作整体性的反思 ,起码要做重新的定位 ,这应该是刑法现代化的基本前提。只有那些具有同一化、实体化、可操作性的法律才能成为全球化的法律。作为公法、历来与国家主权联系甚密的刑法 ,其全球化的现实就更为渺茫。但是 ,刑法的全球化是否有必要是问题的核心 ,而不是是否可能。我们认为 ,以人权为核心展开的刑法的功能的转变应该是必要的。     

WTO背景下的政府政策体制分析

加入WTO将对我国政府的政策体制带来深刻的影响。目前政府政策体制存在着突出问题,我国政府应遵循政策体制改革与创新的原则,构建适应WTO要求的政策体制。     

论罪犯改造中的情感及教育

罪犯在改造中的一般情感特点有:不良的心境;消极的激情;缺乏社会性情感。罪犯情绪发生的心理机制有以境生情和以情生情两种模式。实施情感教育是对罪犯进行人格改造的一种有效方式,但必须注意情感教育的艺术化。
