ABSTRACTSince the late 20th century, the federal government has regulated colleges’ and universities’ handling of campus sexual and gender-based violence (CSGBV). Although the arc of history has bent toward establishing greater protections for victims of such violence, new proposed regulation by the U.S. Department of Education under the Trump administration focuses more heavily on ensuring due process rights for students accused of CSGBV. Most recently, in November 2018, U.S. Secretary of Education, Betsy DeVos submitted a proposed rule change to the regulation of Title IX of the Education Amendments of 1972. This article provides the historical context for this most recent proposed federal regulation of CSGBV and discusses the criticism of this proposal that, if it is implemented, students would become less safe in the ivory tower. 相似文献

This article explores the evidential challenges victim withdrawal presents in domestic violence cases. More specifically it examines innovative measures taken in the United States to overcome problems of proof typically associated with domestic violence prosecutions. These evidentiary initiatives have facilitated a shift towards so–called 'victimless' prosecution in the context of domestic violence which dispenses with victim participation. The European Union is in the early stages of developing policy and practice guidelines for dealing with domestic violence
offenders. There is a real danger, however, that that policy and practice is going to be shaped by political lobbyists rather
than academic literature and evidence-based practice. Feminist advocates control the curriculum of domestic violence perpetrator
programmes in the US and more recently in the UK and proscribe treatments that do not conform to their conceptualisation of
domestic violence. Feminist advocates conceptualise domestic violence as unilateral male-to-female violence enacted to control
and dominate women, supported by the patriarchal beliefs and systems of the wider society. Academic support for this theory
is lacking, however, and scientifically sound evaluations find that programmes based on this philosophy have little or no
effect on recidivism. Empirical literature suggests that domestic violence is not a unitary phenomenon and that perpetrators

The English law of theft is confusing and problematic in principle. Since the introduction of the Theft Act 1968 there has been inconsistency in the interpretation of appropriation as court and commentators have grappled with the intuition that appropriation must entail some subjective element and cannot be purely objective. Although subjectivity is traditionally associated with culpability rather than with conduct, it is argued that some acts can be subjective and yet factual and stand as causes to effects. Appropriation is such an act, its necessary and sufficient condition being a mindset, here termed proprietary subjectivity, on the part of the actor. It is argued that clarification of the concept of appropriation can help to resolve misperceived problems. Such clarification will also reveal other problems in the law of theft. This article examines domestic violence criminal prosecutions and addresses what 'effective' prosecutorial action means in such cases. The argument elaborates on a point recently articulated by the UN Special Rapporteur on Violence against Women, which links effective prosecution of violence against women to the creation of a less patriarchal society. Research has indicated that school factors such as communal school organization and student bonding are predictive of school disorder, with greater communal organization and greater student bonding leading to less delinquency and victimization. Data from a nationally representative sample of 254 public, nonalternative, secondary schools were used to examine structural equation models representing hypothesized relationships among communal school organization, student bonding, and school disorder. The hypothesis that communally organized schools would have less disorder held true for teacher victimization and student delinquency, but not for student victimization. In addition, the hypothesis that the relationship between communal school organization and school disorder would be mediated by student bonding was supported for student delinquency, but not for teacher victimization. 相似文献
