Innovation Policy as Performativity—the Case of Sweden

This article analyzes how the idea of “innovationism” in Sweden has generated a new kind of idea-driven policy around the creation of innovative regional policy. In contrast to similar policies in this area, this policy does not manifest itself through traditional instruments, but evolves through symbolic and ritual performances, in particular through events and conferences. The article asks how this emerging idea has changed the existing institutional formation of sponsoring industrially relevant research. The vision of concerted action between decision-makers within modern innovationism reinforces territorial identity, but it also tends to devolve responsibility to the regional level since concerted action on the national level is hard to obtain. What emerges is a system of governing at a distance where different actors perform their roles according to often academic ideas of innovationism. The study is based on two qualitative studies in Sweden entailing both documentary sources and semi-structured interviews.     

Convergence Criteria for Participation in the Flexible Mechanisms of the Kyoto Protocol

We suggest a multi-layered system of three convergence criteria – similar to those used in the run-up to the European monetary union – that define the notion of "demonstrable progress" towards reaching the emission commitments under the Kyoto Protocol. These are the existence of an independently evaluated national emissions inventory, the level of domestic policies and measures, and the quantitative convergence of emissions towards the Kyoto target. While the first of these criteria constitutes a necessary condition for use of the Kyoto Mechanisms, the other two should determine the degree of participation allowed for any given Annex I country.

中加环境治理协调模式比较研究

加拿大在环境治理中面对日益突出的协调问题,发展出跨界合作模式,强调环境治理主体间的平等协商,并在众多环境领域创设出许多绩效显著的典型治理机制,解决了制度供给问题。而我国传统的行政调控模式,强调上下级间的权威性调解和控制,并弱化政府之外的利益相关者和公众参与,虽然具有高效权威的优点,但在实践中并不能有效化解环境治理主体间的恶性博弈,不断酿成公地悲剧事件。加拿大模式具有奥斯特罗姆提出的多中心自主治理理论特征,为我国环境治理提供了新的思路。虽然我国借鉴加拿大模式时在制度供给上受到了体制制约,但仍有制度创设空间。     

浅析票据行为的意思表示

票据行为的意思表示应当遵循法律行为意思表示的一般规则。但是其效果意思和表示行为都有特殊性。在对效果意思作解释时,以“观其行,不听其言”的严格表示主义为原则;以“言对行的反叛”的意思主义为例外。但这个特性以不同于一般民法理论中的折衷主义;在表示行为上其特殊性表现为唯一的文句记载,排斥一般法律行为可适用的沉默和推定方式。票据行为意思表示效力的发生均无须相对人(债权人)的承诺为要件。     

An evaluation of matching unknown writing inks with the United States International Ink Library

Utilizing a database of standards for forensic casework is a valuable resource. Undoubtedly, as more standards (and corresponding information about the specimens) are collected, there is a greater certainty of identification when a questioned and a known item cannot be distinguished after a series of analyses. The United States Secret Service and the Internal Revenue Service National Forensic Laboratory jointly maintain the largest known forensic collection of writing inks in the world, which is comprised of over 8500 ink standards collected worldwide, dating back to the 1920s. This study was conducted to evaluate the reliability of matching arbitrarily purchased pens with known inks from a database. One hundred pens were randomly obtained from a variety of sources and their respective ink compositions were compared with standards. Eighty-five of the inks were determined to be suitable for comparison utilizing optical examinations and thin-layer chromatography. Three of the inks did not match any of the specimens on record; one of these inks was similar to an ink from an identical brand of pen that was in the database, but had a modified formulation.

全国港澳研究会于2021年2月在北京举办"完善‘一国两制’制度体系,落实‘爱国者治港’根本原则"专题研讨会。夏宝龙同志在讲话中表示,习近平总书记关于"爱国者治港"的重要论述,是对香港回归以来"一国两制"实践经验的高度提炼,是对"一国两制"实践规律的深刻揭示,为推动"一国两制"实践行稳致远、保持香港长治久安指明了方向。"爱国者治港"是"一国两制"方针的核心要义,是推进"一国两制"事业的时代呼唤,要坚持"爱国者治港"的客观标准和要求,对相关制度进行完善。与会专家学者表示,"爱国者治港"是在香港特别行政区维护国家主权、安全、发展利益的重要前提。香港现行选举制度还不能为全面落实"爱国者治港"原则提供坚实的制度保障,需要尽快加以完善,修补漏洞。
