Wer hat einen vom Rechtsvorgänger des Wohnungseigentümers eigenmächtig errichteten,nicht parifizierten Keller zu erhalten?

Nutzt ein Wohnungseigentümer einen eigenm?chtig errichteten Teil seines WE-Objekts (hier: einen von seinem Rechtsvorg?nger ohne Baubewilligung gebauten Keller) ausschlie?lich, ohne dass diese R?umlichkeit in die Nutzwertfestsetzung einbezogen worden ist, handelt es sich zwar um einen allgemeinen Teil der WE-Liegenschaft. Die Erhaltungspflicht (hier: Behebung ernster [Feuchtigkeits-]Sch?den im Keller) trifft aber nicht die Eigentümergemeinschaft, sondern nach § 839 ABGB den ausschlie?lich nutzenden Wohnungseigentümer allein. Auch eine langj?hrige Duldung der ausschlie?lichen Kellerbenützung durch den Wohnungseigentümer vermag die Erhaltungspflicht dieses Raums nicht auf die Eigentümergemeinschaft zu verlagern. Diese Duldung vernichtet lediglich den Beseitigungsanspruch wegen eigenm?chtiger Inanspruchnahme allgemeiner Liegenschaftsteile.     

Umschichtungen im Konzern – keine Änderung der wirtschaftlichen Einflussmöglichkeiten

Keine ?nderung der wirtschaftlichen Einflussm?glichkeiten liegt vor, wenn es zu Anteilsübertragungen oder Umgründungen zwischen konzernverbundenen Gesellschaften kommt, aber sich bei jenen Personen nichts ?ndert, die auf der obersten Ebene den Einfluss ausüben. Derartige Handlungen innerhalb eines Konzernverbunds verwirklichen nicht den Tatbestand des § 12a Abs 3 MRG.     

Antrag auf Zwangsversteigerung aufgrund unechten Fremdwährungstitels hat auf europäische Währung zu lauten

Bei der Zwangsversteigerung einer Liegenschaft zur Hereinbringung einer Geldforderung in der Fremdw?hrung von Staaten, die nicht der Europ?ischen Union oder dem Europ?ischen Wirtschaftsraum (Drittstaaten) angeh?ren (in casu: US-Dollar), hat der betreibende Gl?ubiger schon im Exekutionsantrag wegen des Verbots von bücherlichen Eintragungen auf W?hrungen von Drittstaaten (Art I § 5 Abs 3 1. Euro-JuBeG) eine Umrechnung der betriebenen Forderung in Euro vorzunehmen. Eine amtswegige Umrechnung durch das Exekutionsgericht findet nicht statt. Ein Verbesserungsverfahren zur nachtr?glichen Umrechnung ist wegen der rangbegründenden Wirkung der Anmerkung der Einleitung des Zwangsversteigerungsverfahrens dann nicht zul?ssig, wenn der Exekutionsantrag beim Buchgericht eingebracht wird.     

VfGH-Verfahren: Bescheidbeschwerde in Fristverletzungsfällen auch ohne Aufhebungsantrag

Das uneingeschr?nkte Erfordernis eines Aufhebungsbegehrens in einer Bescheidbeschwerde auch in F?llen, in denen sich der GH auf den Ausspruch einer Rechtsverletzung (des Rechts auf ein Verfahren innerhalb angemessener Frist) zu beschr?nken hat und den Bescheid nicht aufheben kann, verletzt die Vorgaben des Art 144 Abs 1 B-VG sowie uU der Art 6 und 13 MRK.     

A Pacific Sojourn: Anna Kavan and the New Zealand Connection, 1941–2

Abstract

This article examines Anna Kavan’s sojourn in New Zealand from February 1941 to November 1942 in the company of the pacifist playwright Ian Hamilton. Living in the most remote of the ex-British colonies reinforced Kavan’s ontological sense of homelessness and wish to disidentify from British society, yet the colony’s anglophone orientation offered familiarity within the strange and alien. The geography, landscapes and communities of its Pacific islands encouraged a reshaping of her imaginative engagement with otherness. Referring to Kavan’s recently published diary, ‘Five Months Further or What I Remember ab[ou]t New Zealand’, the essay argues that the New Zealand ‘experience’ encouraged her use of tropes of the Gothic and uncanny as she grappled with issues of distance, homelessness and disjunctive reality. The discussion focuses on the alternative/parallel world that New Zealand represents in stories published in I Am Lazarus (1945). It identifies experimental techniques associated with Gothic fiction by which Kavan registers the overlapping dualisms of war-torn London and idyllic rural New Zealand, and represents memory through framing devices and defamiliarizing rhetorical tropes as a distancing activity interrupting the present moment: dream sequences, irruptions into and splittings of reality, space and time reversals, doublings of self/other, disjunctive non sequiturs and ghostly mirror imaging.     

Hearts and Minds: War Neurosis and the Politics of Madness in Anna Kavan's I Am Lazarus

Abstract

Anna Kavan's fictional portrayals of psychiatric breakdown and its treatment provide a unique perspective on the patient's experience of early to mid twentieth-century psychiatry. This article looks in detail at Kavan's time working with soldiers suffering from effort syndrome during the Second World War, observing how the solider-psychiatric patient becomes a figurehead for her radical politics in her Horizon article ‘The Case of Bill Williams’ (1944), and a prominent protagonist in her stories. Through close reading of her correspondence, her journalism and her wartime stories collected in I Am Lazarus (1945), it examines how the intersection of psychological trauma and physiological symptoms characteristic of effort syndrome surfaces in Kavan's writing of this period and in her own psychic responses to the war. It observes the importance of figurative language to her portrayal of war trauma and psychological breakdown, as her characters embody metaphor in their psychosomatic symptoms, and explores a twisted reconception of mind–body dualism prevalent throughout her writing of this period. It goes on to examine how the peculiar interaction of the physical and the psychological extends to the relationship between Kavan's characters and their external environment in her Blitz stories. Against the backdrop of the war-torn city, mind and body engage in ongoing conflict, affect and emotion bleed into her physical landscapes, and everyday objects become animated and hostile towards her protagonists.     

20世纪国际关系领域的基准时间:历史视角中的三次世界大战

基准时间是宏观历史过程中的临界点,标志着一连串的重大变革可能会在较长时间内延续。基准时间具有九条标准,可以分为一等基准时间、二等基准时间和三等基准时间。20世纪的基准时间主要包括三次世界大战(一战、二战和冷战),第二次世界大战前后发生的变革比第一次世界大战和冷战前后的变革都要来得更为深远。将20世纪的三个基准时间置于两个世纪的视角中加以审视,可以突出现代性革命,这种视角能够观察20世纪的三个基准时间在正在展开的"全球性变革"这一大的主题下是否会相互联接、是如何相互联接的。20世纪国际政治的关键事件,都应该被视为19世纪"全球性变革"所引发的发展态势和挑战的后期结果。     

Dis-Assembly Lines: gestures,situations, and surveillances

In “Americanism and Fordism,” Antonio Gramsci offers a brief meditation on the gestural performances of assembly-line workers who, rather than become subordinate to the disciplinary flow of the machine, cultivate perfectly timed gestures that allow workers to hide in plain sight: or, in other words, to inhabit the scene of management otherwise. Rather than extend Gramsci's investment in virtuosic, masterful performances of gesture, this article considers the potentiality of gesture through Lucille Ball's and Tehching Hsieh's performances of bad timing. As different as these performances are in terms of genre and historical situation, each uses gesture as a technique to performatively divide the labor process, producing fleeting temporalities of waste within rhythms marshaled toward production and accumulation. While it tracks the effects of these itinerant gestures, this article reconsiders the oppositions between productive and reproductive work, rationality and emotionality, and work and home that sustain Gramsci's theory, as well as how the collapse of such oppositions introduces alternative historical and artistic trajectories into theories of precariousness.     

Dual-Credit Courses and the Road to College: Experimental Evidence from Tennessee

Dual-credit courses expose high school students to college-level content and provide the opportunity to earn college credits, in part to smooth the transition to college. With the Tennessee Department of Education, we conduct the first randomized controlled trial of the effects of dual-credit math coursework on a range of high school and college outcomes. We find that the dual-credit advanced algebra course alters students’ subsequent high school math course-taking, reducing enrollment in remedial math and boosting enrollment in precalculus and Advanced Placement math courses. We fail to detect an effect of the dual-credit math course on overall rates of college enrollment. However, the course induces some students to choose four-year universities instead of two-year colleges, particularly for those in the middle of the math achievement distribution and those first exposed to the opportunity to take the course in eleventh rather than twelfth grade. We see limited evidence of improvements in early math performance during college.
