胎儿地位的法哲学思考——以权利之概念分析为基础

胎儿地位问题是自罗马法以来倍受法学界关注的重要课题之一。对这一问题的探讨,必须以权利之概念分析作为基础。坚持“活着出生规则”为前提,采取概括保护与个别保护相结合的立法策略,应该作为我国民法保护胎儿利益的明智选择。     

20世纪80年代“第三梯队建设”战略决策的历史考察

1980年代初，中共中央从保持党的执政地位、国家的长期稳定及加快社会主义现代化建设出发，作出关于第三梯队建设的战略决策。这一过渡性人才选拔培养战略，至80年代末随着其使命的完成而退出历史舞台。尽管它存在的时间不长，但其产生的影响却极为深远。     

走下“过山车”——关于对“80后”认知问题的一些思考

长期以来,人们对“80后”的认知中,存在着“过山车”般大起大落的现象。这与成人社会的认知障碍有着直接关系。成人社会的认知障碍,主要与“80后”的独生子女身份、改革开放以来种种新生事物的层出不穷、成人社会期待回报的心理等等有着直接的关系。要准确认知和把握“80后”的特征和特质,成人社会必须加强对“80后”和新生事物的学习。     

Dismissal of strikers and industrial disputes: the 1985–1987 strike and mass sackings at Silentnight

The 1985–1987 dispute at Silentnight bed factories in the north of England was an exceptionally long and bitter strike, lasting for 20 months from June 1985 until February 1987. A total of 346 workers were sacked for taking part in the strike, which gained a high profile with remarkable levels of support and solidarity action, largely due to its emblematic status as an extreme example of punitive treatment of workers taking industrial action in the period immediately following the defeat of the miners in 1984/1985. Workers took lawful strike action in 1985 over the non-implementation of agreed pay rises and compulsory redundancies counter to an existing agreement between the firm and the union, with the company responding to the dispute with mass dismissals. Pickets were maintained at the two factories in question for nearly two years, with the strikers gaining wide-ranging support from across the labour movement, but the company stood firm against the dismissed strikers who were ultimately defeated. Based on archival research and interviews with participants in the strike, the article analyses in detail how the dispute was sustained for so long, the legal context and the weakness of legal protections for strikers in the period, and the widespread political mobilisation and networks of support and solidarity that arose around the strike and in opposition to the policies of the Conservative government of the day.

判断纸张折痕与写印字迹先后次序的实验研究

添改文件属于变造文件的一种,在污损文件检验中占据重要地位。对一份疑似添改的文件进行真伪识别,不仅要看形成文件的物质材料的理化性质是否遵循其正常的变化规律,还要看整份文件的形成过程是否符合正常的行文程序。由于各种色料与纸张折痕交叉,不同形成次序时交叉部位呈现出来的表观特征存在差别,因而能够根据这种差别判断色料与折痕形成的先后次序,进而为确定一份可疑的文件是否存在添改事实提供依据。     

评述行政紧急权力的法律控制

紧急状态是任何社会在其发展过程中都不可避免的,因而行政紧急权力的动用在特定情况下也就同样不可避免。但是何为行政紧急权力,为什么要控制行政紧急权力以及如何控制行政紧急权力,这些关乎行政紧急权力有效运行的重大问题,伴随着紧急状态立法成为我国行政法学者热议的话题。学者们对行政紧急权力的基本属性还存在不同的理解,对行政紧急权力法律控制的必要性和控制路径也存在着不同的认识。加强对行政紧急权力在事前、事中、事后的法律控制是根本途径。     

Tominaga Nakamoto and the Origin of Japan's Oriental Studies

Tominaga Nakamoto, a Japanese scholar of the early 18th century, changed the basic pattern of Japans Buddhist and Confucianist studies with his books Shutsujō Kōgo (Words after Enlightenment) and Okina no Fumi (The Writings of an Old Man). In the former book, based on his analysis of Chinese culture in terms of Confucianism and Indian culture from the viewpoint of Buddhism, he compared Indian, Chinese and Japanese culture and summarized their characteristics with the words “fanciful”, “elegant” and “simple” respectively. In the meantime, in combing through the development of Buddhism he put forward a set of key concepts in relation to his research methodology, extending his domain from country-specific studies to Asia regional studies and finally Oriental studies. In the latter book, he used the concept “makoto”, roughly meaning “practicing the good”, to synthesize the Way of the three nations. His study transformed Japanese Confucianism and Buddhism from a system of belief to an academic field. Despite his rational analysis and criticism of the traditional oriental culture, Tominaga consciously identified with it and inherited it. As the first scholar in early modern Japan who developed his own research methodology, Tominaga is the trailblazer of Oriental studies.
