工伤认定中若干法律问题探讨

正确认定工伤,首先要根据工伤的构成要件准确把握工伤的概念,其次要能够准确把握劳务关系、雇佣关系、委托关系与事实劳动关系之间的异同,最后需要结合实际对工作原因、工作场所、上下班途中等三大要素作出合理认定。     

地方治理理论的启示

地方治理理论作为研究公共事务的一个新的分析框架,是新兴的治理理论基本理念在地方政府层面的具体化。地方治理理论对于地方政府治理和改革实践,具有三个方面的重要启示:地方政府应当是公共服务的提供者、公共秩序的维护者、公共利益的保障者和公民参与的推动者;应当构建积极的公民资格,培育强烈的公民精神;应当逐步建立和完善公民参与网络,为地方治理的发展奠定坚实的基础。     

Lost in space? the role of place in the delivery of social welfare law advice over the telephone and face-to-face

ABSTRACT

Advice that is provided exclusively over the telephone has been promoted by government as more convenient and accessible than face-to-face appointments. The resulting push towards telephone-only provision, as implemented by the Legal Aid, Sentencing and Punishment of Offenders Act 2012, challenges the long history of association between social welfare law advice and local delivery within disadvantaged communities. This article reports on qualitative research comparing telephone and face-to-face advice which uncovers the continuing relevance of place in the dynamics and mechanics of social welfare law provision. Familiarity with the geographical location, knowledge of local policies and procedures, relationships with opponents and allies, and an understanding of the ‘local legal culture’ mean that face-to-face advisers are often able to conduct their legal casework more effectively. Conversely, local knowledge is unlikely to be available to Community Legal Advice telephone advisers. This research suggests that, in addition, telephone-only advisers may be developing a more narrow understanding of the essential qualities of casework. These findings are particularly significant in view of the likely future expansion of remote methods of delivery in legal aid work.     

Working Girls: Femininity and Entrapment in Peyton Place and Valley of the Dolls

Jacqueline Susann's Valley of the Dolls (1966) and Grace Metalious's Peyton Place (1956) are novels that have long exerted a powerful hold on the popular imagination. The bestselling Peyton Place was adapted into a successful film in 1957 before becoming an iconic television series, running from 1964 to 1969. Valley of the Dolls was similarly re-imagined in two films, Valley of the Dolls (1967) and Beyond the Valley of the Dolls (1970), which, even today, retain a cult following. These books are typically remembered for their scandalous bringing to light of such ‘taboo’ issues as adultery, abortion, female sexuality and sexual abuse. But this article suggests that Peyton Place and Valley of the Dolls are equally preoccupied with a sympathetic examination of the role of women in the post-war workplace. In both of these novels, the process of female self-fashioning is integrally related to a woman's entry into the workforce, and to the making and controlling of her own money. But this entry into the male-dominated workforce is inherently fraught with danger, and Metalious and Susann expose some of the myriad ways in which the so-called ‘American Dream’ is contingent on the entrapment, suppression and regulation of various forms of female desire and agency.

地名是用以确定或代表某个地方并与其他地方相区别的文字符号和标记。地名权的本质属性是人身权。地名经过一段时间使用后会获得一定的商业价值,由此而转化得来的利益应是一个派生权,其原生权仍属人身权。因此大楼更名权的诉讼,是具有人身权内容的行政诉讼。地名权属准共有的范畴,为所有权人共有,应适用所有权共有制度中的有关规定。

具有广泛的群众基础是保证共产党执政地位的必要条件。不断扩大党的群众基础是深刻总结党80多年来领导革命、建设和改革的历史经验作出的正确决策。扩大党的群众基础不会改变党的工人阶级先锋队性质。而准确理解和在实际工作中正确把握扩大党的群众基础,必须科学认识新的社会阶层中的广大人员也是中国特色社会主义事业的建设者;必须准确把握判断人们政治上先进与落后的标准;必须积极和稳妥地吸收新的社会阶层中的优秀分子入党。     

法治与贵州民族地区法律建设

实行法治,是进入全面现代化的重要标志之一,当今,它在全世界范围内,特别是东方国家的发展趋向已日益明显,并对整个社会产生着日益重要的影响。在我国,在党的“我们应当在发展社会主义民主、健全社会主义法制方面取得明显的进展”①的思想指导下,贵州民族自治地方的法治建设究竟怎样呢?本文就此作点探讨。     

论鲍照女性题材的乐府诗创作

鲍照是南朝刘宋时期的重要诗人,与谢灵运、颜延之并称＂元嘉三大家＂。鲍照在乐府诗创作上取得了极大成就。在他的乐府诗中,女性题材的诗歌创作占有相当的比重。根据表现主题的不同,又可具体分为艳情和闺怨两类。前者内容香艳但不失寄托,后者多借女性之怨抒发自身之悲。作为一个男性诗人,鲍照发妇人语,代女性言,呈现出＂男子作闺音＂的现象。同时,鲍照借鉴了南朝民歌的元素,形成了清艳的艺术风格。     

行政诉讼集中管辖的悖论及其克服

为摆脱地方干扰,增强法院依法独立公正审理行政案件的能力,而作为行政审判体制改革试点来推进与行政管理区域有限分离的行政诉讼集中管辖制度,在一定程度上能够保证宪法、法律赋予法院的行政审判权有效运行。这种做法实为改革过程中的无奈之举,故而需要宽容、理解和支持。但是,改革试点也面临着如何符合实定法相关规定的挑战。对于确实具有合理性和实效性的改革举措,应当通过修法予以合法性支撑。不应将集中管辖确立为我国行政诉讼的一般制度,因为它不能有效根除行政诉讼的体制障碍,无法充分利用各级法院既有资源,与行政审判体制改革的长远目标相悖;要根除行政诉讼的体制障碍,需要在行政体制改革上下功夫,真正确立尊重法院裁判的行政责任体系。在深化司法体制改革的过程中,需要对行政诉讼集中管辖的试错探索予以科学评价,对实践和理论误区予以逐步矫正,确立正确的方法论和科学的行政诉讼管辖制度,以基层管辖、本地管辖等法定管辖为一般管辖,以提级管辖、异地管辖等裁定管辖为补充管辖。     

Antiforeigner Resentment as a Manifestation of Xhosa Hegemonic Masculinity

Abstract

During a xenophobia and social cohesion research project conducted by the Safety and Violence Initiative (SaVI) of the University of Cape Town (UCT) and Freedom House USA, researchers found an overwhelming perception that foreign nationals were taking things that belong to South Africans. This perception was most prevalent in the male population, and antiforeigner resentment was mainly aimed toward male foreign nationals. This paper uses ethnographic research in the form of qualitative interviews from Motherwell and Makhanda in the Eastern Cape province to find out how constructions of hegemonic masculinities at the local level contribute to antiforeigner resentment.
