浅谈村民自治进程中的干群关系

村民自治作为一种直接的民主形式 ,是现阶段中国农村社会的基本政治制度。干群关系作为维系农村社会的基础 ,是推进村民自治进程的关键。正确认识村民自治进程中干群关系出现的新变化 ,并且采取切实有效的措施加以改善和发展 ,不仅是农村社会稳定和发展的基础 ,更是推进民主政治建设 ,开创农村工作新局面的重要保证。     

转变治理理念 构建和谐社区——试析社区治理中的居民参与问题

社区治理的主体既包括政府部门,也包括社区自治组织和居民个人。在以往的社区治理模式中,都过分强调政府的作用而忽视了居民个人对社区公共政策的参与,这就造成了当前我国城市社区中居民参与水平低下、参与机制缺乏的状况。因此,采取积极稳妥的政策措施,转变政府治理理念,改进治理模式,全面理顺政府与社区关系,为居民参与社区治理创造有利条件,大力构建和谐有效的社区治理体系乃是当务之急。     

论法治的社会基础

市民社会是法治的社会基础。自治是市民社会的内在要求,法治需以社会自治为基础。市民社会蕴含的公民意识是法治精神的基础。只有大力推进市民社会建设,才能从根本上实现法治。     

现代社会的法律自治——韦伯论现代法律的自治性

韦伯的社会学是作为包括法律科学在内的整个社会科学的基础而出现的,为我们理解法律现象提供了一个基于社会理论的＂外在视角＂。以韦伯的法律社会学为基础考察法律自治性的社会理论依据,可以为我们理解包括法律自治在内的现代法律现象提供一把钥匙。     

论城市化过程中被征地农民的参与管理权

在城市化进程中，农民“无权”、“失权”的弱势地位导致自身合法权益严重受损。本文基于组织行为学的参与管理理论、当代行政法学“行政权——公民权”的平衡理论和西方发达国家在发展中国家实施扶持项目的过程中形成的村民参与管理理论，结合我国的村民自治制度提出赋予城市化进程中被征地农民参与管理权，并由被征地农民会议享有和行使等对策，以保障征地过程中的行政权与农民的合法的财产权之间的制衡，从而维护广大被征地农民的合法权益。     

构建科学有效的村官监督机制

监督缺失是导致村官腐败最重要的制度性根源,因此,落实民主监督、强化上级监督、加大依法惩治力度,构建科学有效的村官监督机制是遏制村官腐败的关键。     

Bridging borders through institution-building: the EGTC as a facilitator of institutional integration in cross-border regions

This article examines cross-border integration at the sub-state level in the frame of a European Grouping of Territorial Cooperation (EGTC). The EGTC is a supranational and directly applicable EU legal instrument that regulates the creation of cross-border ‘associations' with legal personality between public authorities. Thus, it represents a policy tool that can have an effect on the institutional frame of cross-border cooperation and potentially enhance cross-border institutional integration at the sub-state level. The aim of this article is to examine the potential effect of this EU instrument on cross-border institutional integration by studying the institutional architecture of selected EGTCs. This is done on the basis of an analytical grid that defines elements of a possible integration process based on an institutional-oriented approach. This analytical grid is applied to four case studies: the Eurométropole Lille-Kortrijk-Tournai, the EGTC Ister-Granum, the Pyrenees-Mediterranean Euroregion and the European Region Tyrol-South Tyrol-Trentino. The empirical analysis shows that despite the considerable improvement of the legal basis for cooperation, the possible effect of the EGTC for further institutional cross-border integration is still rather limited due to a narrow design of institutions and a low level of actor involvement.     

Morphing the Demos into the right shape. Normative principles for enfranchising resident aliens and expatriate citizens

In this article I criticize, first, democratic inclusion principles that are indeterminate with regard to democratic boundaries and indifferent towards the structural features of polities. I suggest that a democratic stakeholder principle passes these critical tests and can be applied to democratic polities of different kinds. Second, I compare birthright-based and residence-based membership regimes at state and local levels and consider how they can accommodate international migrants. Third, I argue that these two regimes are not freestanding alternatives between which democratic polities have to choose, but are combined in a multilevel architecture of democratic citizenship, in which the inclusion and exclusion dynamics of birthright and residence mutually constrain each other and every individual is included as a citizen in both types of polities.     

The political value of languages

A theory of linguistic justice needs to take into account the three distinct values of language as a medium for communication, as a source of individual identity and as an instrument for political self-government. Doing so would undermine Van Parijs’ claim that political borders and peoples should be downgraded to a purely instrumental role for purposes of social justice. But it would widen the scope of egalitarian global justice by including a universal right of individuals to membership self-governing polities and it could provide more solid theoretical foundations for his defence of coercive territorial language regimes.

社区是社会的细胞,社区和谐是社会和谐的基础之一,构建社会主义和谐社会应从建设和谐社区入手。构建社会主义和谐社区,是一项系统工程,应在把社区自治作为和谐社区建设和发展方向的基础上,建立完善、系统的社区自治法律制度。积极稳妥地推进民主选举、决策、管理及监督。依法加强居委会组织队伍建设和社区基础设施建设,逐步实现社区居民自我教育、自我服务、自我管理、自我监督,创建管理有序、民主和谐的自治型和谐社区。
