论涉台投资法律保护的现状、问题及其相关思考

自1988年以来,祖国大陆先后颁布了一系列涉台投资法律和法规,尤其是1994年全国人大常委会制定的《台胞投资保护法》和1999年国务院颁布的《台胞投资保护法实施细则》,在促进台胞直接投资、确保台商合法权益以及推动两岸经贸交流方面取得了积极而富有成效的成果。但随着时间的推移和现实情况的发展变化,这些法律和法规在实施过程中也暴露出一些亟待解决的问题,需要我们面对和审视,并提出健全和完善的合理化建议。     

Agrarian structure,foreign investment in land,and land prices in Brazil

The recent global rush for farmland in Latin America has produced a dramatic increase in the level of foreign investment in land in Brazil. The current trend accentuates the ongoing process of foreignization of agriculture associated with the production of grains, sugar, ethanol and other commodities, increasing land prices. In response, the Brazilian government reestablished a legal mechanism for ‘controlling’ land-based foreign investment which has proven neither efficient nor effective in solving land concentration. This paper examines this issue by analyzing the causes of the increase in investment as well as the consequences of this process with respect to land prices, critically situating land-based investments and the government's policy response in a broader discussion of the demands of agrarian social movements.     

From Sub-state Nationalism to Subnational Competition States: The Development and Institutionalization of Commercial Paradiplomacy in Scotland and Quebec

Many of the most active regions in terms of commercial paradiplomacy are home to influential nationalist movements: Scotland and Quebec are cases in point. Conversely, many rich and export-oriented regions, such as South East England in the United Kingdom or Ontario in Canada, remain less active, if at all, in this domain. Nevertheless, the influence of nationalism as a driving force behind the practice of commercial paradiplomacy by subnational entities has often been subordinated to other variables such as ‘trade openness’ (exports as part of GDP) or ‘asymmetry’ with national economic interests (export and FDI partners). This article describes the development of autonomous commercial paradiplomacy apparatuses in Quebec and Scotland by focusing on nationalism as a crucial motive, which is also partly responsible for the way such apparatuses developed, through the establishment of organizations and strategies institutionally distinct from those of the ‘rest’ of Canada and the UK.

Against All Odds? Russia’s Financial Crisis and Global Geopolitics

Over the past 15 years, Russia’s model of political-economy has evolved around three main channels of global economic integration: 1) export of natural resources and a national system of redistribution of export revenues; 2) financialisation, acting as a boost for domestic consumption/demand; and 3) the offshore integration of Russian capital into global capital markets. The current crisis is affecting all three channels of Russia’s global political economy. Together, reduced export revenues, the deepening financial crisis and the dominance of offshore-sourced investments into Russia, serve as crisis transmission mechanisms, and thus constitute three sets of (inter-related) dilemmas for the Russian authorities. Four scenarios of possible development of the current situation are provided.     

东道国法制环境对中国企业“走出去”的影响

企业"走出去"是我国参与国际经济合作的重要途径。目前,我国海外直接投资企业足迹遍布五大洲,海外投资规模不断扩大,投资主体也日趋多元化。我国企业在"走出去"取得成效的同时,还面临很多困难,有时甚至遭受严重的挫折。加强对东道国法制环境的研究,可以帮助企业减少"走出去"的障碍,最大限度地实现海外投资目标。     

入世后我国招商引资的新策略

目前，国际资本市场在世界经济全球化和现代信息技术的推动下进一步快速增长。际此，我们应立足于发展，充分利用入世的有利时机和积极因素．及时调整招商引资策略．以促进吸引外资规模的继续扩大和攀升。     

Public Pension Funds and Alternative Investments: A Tale of Four Swedish National Pension Funds

This exploratory study offers insights into why public pension plans might invest in alternative asset classes at levels inconsistent with modern portfolio theory. Using a case study methodology, the research relies on fieldwork data and in-depth interviews with individuals familiar with four Swedish national pension funds. The findings suggest that alternative assets are perceived as important vehicles for improving portfolio diversification, but that the funds’ propensity to invest in them is constrained by information asymmetry and access to alternatives. The findings also indicate that investment restrictions and political considerations have had limited effects on decisions to invest in alternative assets.
