庭审提问可以看作是提问者为实现特定交际目的和顺应不断变化的交际环境而进行言语选择的动态过程。在庭审提问过程中,提问者根据不断变化的语境选用不同的策略(如重复、重述、并置、话题控制等),可以实现不同的交际目的,推动合作或推翻虚假供词。  相似文献

The aim of the current study was to determine the prevalence of probable attention-deficit/hyperactivity disorder (ADHD) in prisoners and to assess the relationship between ADHD and recidivism. We studied 356 inmates, who were evaluated using the Wender Utah Rating Scale and Adult ADHD Self-Report Scale. Type of crime and other crime-related data were compared between inmates with and without ADHD. The group with probable ADHD had a higher average number of convictions compared to the group without ADHD. The probable ADHD group also demonstrated higher incidence of extortion crime, drug trade, disciplinary action at school, and military service than the group without ADHD. Linear regression analysis revealed that the presence of probable ADHD was effective on the number of convictions. The findings of our study support that the presence of probable ADHD carries a potential risk of being prone to certain crimes and demonstrate a correlation between the presence of probable ADHD and early involvement in crime and the number of convictions.  相似文献

高校思想政治理论课教学与传播学具有相通性,为运用传播学的受众理论研究和解决高校思想政治理论课教学内容的重复问题提供了可能性。调查发现,教学内容的重复难以满足受众"求新求异"与"求真求实"的心理需求,影响了教学效果。要解决这一问题,必须做到以下两个方面:(1)改革创新,赋予重复内容以新的材料、意蕴和形式;(2)实事求是,凸显重复内容的生活性和价值性。  相似文献

想像竞合犯,是指行为人实施一个事实行为,而同时触犯两个以上罪名的犯罪形态。其基本特征为:想像的犯罪竞合,实质的、裁判的一罪;基于单一或复合罪过的一个事实行为;同时触犯数个不同罪名的具体犯罪。想像竞合犯不同于规范竞合与结果加重犯。想像竞合犯一个事实行为的重复性,强调的是事实行为在数罪评价中的整体重复,包括准整体重复。打击错误原则上可以视为想像竞合犯的情形。对于想像竞合犯从一重处断。  相似文献

ABSTRACT

Since behaviorism fell out of favor as one of the prominent learning theories, language education has done away with using repetition of linguistic forms as one of the important strategies used in second-language classrooms. As a new direction in educational philosophy and theory, edusemiotics can offer a new perspective about the use of repetition in learning a new language. When language forms are treated as signs and not as substances, as in edusemiotics, linguistic particles can never be truly repeated, but each instance of a repetition of a language particle and structure disambiguates the meaning of a form in a different context. This paper argues that the repetition of language forms at the lexical, syntactical, phonetic, and discursive levels aids language learners to intuit meaning and function in the new language. Further, it is discussed that repetition of language forms prompts language learners to look for similarity in patterns between linguistic structures rather than surface-level similarity of forms of language. Finally, the use of linguistic repetition is examined for its affective and poetic bearing, as an important aspect of the acquisition of language.  相似文献

刑事诉讼本应从立案侦查,向起诉、一审、二审不断推进,直至执行而终止,然而在我国刑事诉讼中出现了不少程序回逆的现象。有些程序回逆是必要且合理的,但大多数程序回逆或者背离了刑事诉讼法设立的目的,或者与刑事诉讼法的基本原则相抵触,或者违背了刑事诉讼的基本理念。有必要对有关法律和司法解释进行修改,保留有必要且合理的程序回逆的规定,废除无必要且不合理的程序回逆的规定,限制有必要但欠科学的程序回逆的规定,以完善相关诉讼程序和制度。  相似文献
