从事实到规范:物权法民意基础的实证研究——以土地问题为中心

以社会调查数据为判断标准,物权法对土地制度发展的事实,既有呼应,也有背离、漠视、逃避和模糊。呼应主要包括:明确坚持保护私有财产;妥善规定承包经营权的流转、登记的效力、土地使用权到期后的处理等。背离表现为:继续强调集体土地所有权。漠视表现为:未规定建设用地使用权的类型和取得时效;未明确承认宅基地使用权、集体建设用地使用权的流转等。逃避表现为:未能明确统一登记的具体机构及其设置等。模糊表现为:未能清楚界定征收条件、征收中物权的变动时间、登记审查等。     

To block or not to block: European approaches to content regulation,and implications for freedom of expression

Based on the limited effectiveness of state laws, and lack of harmonization at international level a number of states started to introduce policies to block access to Internet content and websites deemed illegal which are situated outside their legal jurisdiction. However, blocking policies are not always subject to due process principles, decisions are not necessarily taken by the courts of law, and often administrative bodies or Internet hotlines run by the private sector decide which content or website should be subject to blocking. Therefore, increasingly, the compatibility of blocking action is questioned with regards to the fundamental right of freedom of expression. This article assesses significant developments at the pan-European level with regards to the development, and implementation of Internet content blocking policies. Adaptation of content blocking policies from certain member states of both the European Union and the Council of Europe will be used to assess the nature and implementation of access blocking policies. It will be argued that there could be a breach of Article 10 of the European Convention on Human Rights if blocking measures or filtering tools are used at state level to silence politically motivated speech on the Internet.

哲学的“未来”观念（上）

西方将哲学称作“形而上学 (metaphysics)”,“meta”和“physics”缺一不可。“形而上学”不能“形式化”,“时间”与“自由”进入“形而上学”,也不能“形式化”。“时间”不可分割,但“时间”与“自由”皆有“度”。“自由”有“你我他”,“时间”有“过去现在未来”。同时这也是“存在”的状态———“人自由者”的一种特殊“存在状态 (Dasein)”。“人”作为“Da sein”是“有死者会死者”,以“死”来划分“时间”的“维度”。“生死”这一过程,就是“自我”的“现时在世”。然而,“死”仍提示着“他者”。在“Dasein”的“过去现在未来”的“度”中,“未来”居于核心的地位。“人”作为“自由者”,是“创造者”。“自由”的“创造”,使“非存在”成为“存在”。“自由”之“创造”,使“未来”成为“希望”。“希望”又使传统哲学范畴的地位发生变化,“可能性现实性”如同“自由必然”一样在理解上有所推进。     

积极人格研究述评

积极心理学认为人格心理学研究要致力于研究人格形成的积极因素,而不单是研究人格形成的消极因素。综合现有的文献资料,总结积极心理学在人格研究的观点,及实现积极人格的途径,对目前积极人格的研究具有促进作用。     

Autonomy,Belongingness, and Engagement in School as Contributors to Adolescent Psychological Well-Being

Self-determination theory emphasizes the importance of school-based autonomy and belongingness to academic achievement and psychological adjustment, and the theory posits a model in which engagement in school mediates the influence of autonomy and belongingness on these outcomes. To date, this model has only been evaluated on academic outcomes. Utilizing short-term longitudinal data (5-month timeframe) from a set of secondary schools in the rural Midwest (N = 283, M age = 15.3, 51.9% male, 86.2% White), we extend the model to include a measure of positive adjustment (i.e., hope). We also find a direct link between peer-related belongingness (i.e., peer support) and positive adjustment that is not mediated by engagement in school. A reciprocal relationship between academic autonomy, teacher-related belongingness (i.e., teacher support) and engagement in learning is supported, but this reciprocal relationship does not extend to peer-related belongingness. The implications of these findings for secondary schools are discussed.

The Freedom Charter: the contested South African land issue

The Freedom Charter represents a desire to create a society that is based on common citizenship and democracy in a society divided in all aspects of its life. This paper problematises and interrogates the Charter’s theoretical and philosophical claim on land. It uses the methodology of Afrocentricity and Africana critical theory to dispute the theoretical and philosophical basis of the Freedom Charter. The paper argues that the understanding, desire and vision of the Freedom Charter are irreconcilable. It concludes that the Charter reconciles the dispossessed with their dispossession, reflecting coloniality and white domination in South Africa.
