协商民主制度与中国特色社会主义政治发展

健全社会主义协商民主制度，是党的十八大提出的一个重要新概念．是推进中国特色社会主义政治发展的战略谋划。协商民主的概念虽然提出于西方，但在涵义上与中国政治协商相通。提出健全社会主义协商民主制度，不仅具有中国意义，而且有着为人类政治文明提供世界经验的价值。民主是政治发展的核心问题，人民代表大会制度与多党合作和政治协商制度体现的选举民主与协商民主，构成我国社会主义民主的两种重要形式。在中国特色社会主义政治发展道路上，选举民主与协商民主都是不可或缺的重要资源．从一定意义上说，中国特色社会主义民主政治建设的更大优势在协商而不在选举。中国社会主义协商民主制度具有系统构造，其深刻性在于将协商民主从社会覆盖、工作向度、普遍要求和运作规范等方面得到提升．协商民主不再是一种单向度、窄渠道、小口径的实践形式，而成为社会政治生活和政治关系中具有全方位的制度系统和工作机制。协商民主作为一种形式载体，其政治生活的覆盖面、民意吸纳的包容性、参与范围的广泛性，需要得到有效的制度供给，需要形成规范运作的机制。

CONSULTANT CONDUCT IN ANTICIPATION OF A CHILD CUSTODY EVALUATION: ETHICAL AND SOCIAL DILEMMAS AND THE NEED FOR NEUTRAL PARENT EDUCATION

Mental health professionals are being retained with increasing frequency as “custody consultants” to prepare a parent for a child custody evaluation. While this practice may serve a legitimate function, no ethical guidelines clearly govern the conduct of a consultant in such circumstances. This lack of guidance has led to professional disagreement regarding the ethical implications of the practice. This ethical ambiguity is accompanied by social concern regarding the high cost of custody consulting, which has the practical effect of denying consulting services to low‐income or self‐represented litigants. This Note will describe the growing practice of custody consulting and the ethical and social unease currently associated with the practice. This Note will then propose that mandatory parent education programs be developed for parents preparing to undergo a custody evaluation. This type of educational program would provide many of the benefits of custody consulting in an ethically neutral fashion and would ensure that all parents have access to the benefits of this growing practice.     

THE EMERGING FORENSIC ROLE FOR WORK PRODUCT REVIEW AND CASE ANALYSIS IN CHILD ACCESS AND PARENTING PLAN DISPUTES

An emerging forensic service is that of conducting a work product review of a court‐appointed child custody evaluator's evaluation and report. If the reviewer determines there are serious deficiencies in the work product, then the reviewer will provide consultation to the retaining attorney and expert testimony. The reviewer usually is in a hybrid role of consulting/advising the retaining attorney, testifying, and educating the court. Ethical issues in providing forensic services and rebuttal testimony as a reviewer are discussed. Both reviewers and evaluators have a duty to be objective and balanced in their analyses of data and issues. Both types of experts should strive to be helpful to the court and try to serve the best interests of children. Ethical nuances involving review work are discussed. Evaluator and reviewer share the same dataset. Evaluators need to take care to keep a high quality case record with legible interview notes. Reviewers provide a monitoring function for the court or a function of forensic quality control so the court will not be misled by expert testimony of evaluators that is based on flawed data collection and/or analysis. A list of questions is presented for reviewers to use in scrutinizing the quality of the custody evaluation. A list of questions is presented for examining the quality of the reviewer's own work product. The importance of a case analysis and use of conceptual frameworks by evaluators and reviewers is discussed.     

Impact of American Political Marketing on Israeli Society

The extensive literature examining the impact of American campaign styles in other countries generally attributes various political changes to the presence of American professionals and imported campaign techniques. Yet foreign professionals working on international campaigns may have more or less influence, and there is little systematic understanding of the factors that contribute to their actual influence over the local campaign. This paper examines the Israeli case as an example of strong penetration of American campaign professionals and techniques and analyzes the factors that contributed to their relatively high level of influence. Following this, a framework is proposed for assessing when imported American professionals and/or styles are likely to have a strong or weak influence on a campaign, based on factors leading to easy adoption or requiring more extensive adaptation. The study finds that in Israel, endogenous factors including social, political, cultural, and economic evolution contributed to the easy adoption of American campaign practices, creating a welcoming environment for American professionals. Thus, the major changes in campaigns often attributed to Americanization in other countries may be due at least in part to organic social, economic, and cultural changes of that society.
