Responsiveness and accountability constitute the process of democratic representation, reinforcing each other. Responsiveness asks elected representatives to adopt policies ex ante preferred by citizens, while accountability consists of the people's ex post sanctioning of the representatives based on policy outcomes. However, the regulatory literature tends to interpret responsiveness narrowly between a regulator and regulatees: the regulator is responsive to regulatees’ compliance without considering broader public needs and preferences. Democratic regulatory responsiveness requires that the regulator should be responsive to the people, not just regulatees. We address this theoretical gap by pointing out the perils of regulatory capture and advancing John Braithwaite's idea of tripartism as a remedy. We draw out two conditions of democratic regulatory responsiveness from Philip Selznick – comprehensiveness and proactiveness. We then propose overlapping networked responsiveness based on indirect reciprocity among various stakeholders. This mechanism is the key to connecting regulatory responsiveness with accountability.  相似文献

This essay expands Saidiya Hartman's unflinching paradigmatic analysis in Scenes of Subjection of the modes of historical continuity in which Black women are barred from reciprocity, recognition, and incorporation ab initio (Hartman, Saidiya V. 1997. Scenes of Subjection: Terror, Slavery, and Self-Making in Nineteenth-Century America. New York: Oxford University Press.). By engaging the works of key Marxist feminist theorist Leopoldina Fortunati, I will demystify the ways in which these three homologies which non-Black women depend upon for the coherence of their complaint are parasitic on the flesh of Black women and men.  相似文献

Scholars often highlight the capacity for cooperation and reciprocity as one of the most outstanding features of Andean peasants, but also raise concerns that these traditional strategies necessarily wither and fade as Andean people and places are increasingly incorporated into capitalist markets and processes. This study examines how non-market cooperative and reciprocal economic practices are affected as rural Bolivians expand production to meet a growing international demand for the Andean pseudo-grain quinoa. Based on the grounded experiences of rural Bolivians who are negotiating the modernisation and martketisation of agricultural production for the first time, I find that increasing incorporation into global markets need not undermine the moral economy of rural people, and may in fact strengthen their commitment to reciprocal and cooperative strategies. In contrast to claims that the spread of modern markets and technologies will weaken and ultimately replace cooperative strategies, I argue that reciprocity practices are important components in the construction of a new, hybrid economic space. Within this space, where economic strategies are based on moral sentiments as well as market logic, reciprocity provides a socially and ecologically appropriate ‘toolkit’ with which rural people negotiate their uneven incorporation into global capitalistic processes.  相似文献

This paper considers the role of reciprocity rules in various strategic settings. After distinguishing four typical categories of social interaction, the paper examines three forms of reciprocity constraints. An ideal rule of perfect incentive alignment (structural reciprocity) serves as a benchmark for the analysis of a golden rule of reciprocity, characterized by a mechanical linking of one player's strategy to that of the other player; and a silver rule of stochastic reciprocity, characterized by a probabilistic symmetry in the relationship between the players.  相似文献

ABSTRACT

Growing precarity amongst rural households in Myanmar is characterised by increasingly debt-fuelled agriculture, decreasing sufficiency and sustainability of rural livelihoods and an absence of social safety nets. This constrains the capacity for viable livelihoods, as risk-averse coping strategies undermine long-term economic sustainability. In this context, informal support networks may be expected to decline or collapse. However, recent evidence demonstrates the widespread emergence of community-based social organisations in rural communities, formed along traditional principles of reciprocity. Analysis of large-scale rural household surveys demonstrates that such organisations are found in nearly 40% of communities in rural Myanmar. These organisations collect and redistribute funds to help with healthcare, education, funerals and other social needs. The presence of such organisations is linked to higher levels of household resilience, achieved through reducing the inequalities linked to gender, disability and poverty, and through providing enabling environments for effective income diversification. Communities with higher levels of migration are more likely to have community-based social organisations, possibly a result of economic and social remittances. In the absence of effective formalised social protection, these social organisations provide most of the social assistance in rural communities, representing new networks of reciprocity in the face of increasing precarity.  相似文献

Two books edited by members of the MacArthur Norms and Preferences Network (an interdisciplinary group, mainly anthropologists and economists) are reviewed here. These books in large part reflect a renewed interest in group selection that has occurred among these researchers: they promote the theory that human cooperative behavior evolved via selective processes which favored biological and/or cultural group-level adaptations as opposed to individual-level adaptations. In support of this theory, an impressive collection of cross-cultural data are presented which suggest that participants in experimental economic games often do not behave as self-interested income maximizers; this lack of self-interest is regarded as evidence of group selection. In this review, problems with these data and with the theory are discussed. On the data side, it is argued that even if a behavior seems individually-maladaptive in a game context, there is no reason to believe that it would have been that way in ancestral contexts, since the environments of experimental games do not at all resemble those in which ancestral humans would have interacted cooperatively. And on the theory side, it is argued that it is premature to invoke group selection in order to explain human cooperation, because more parsimonious individual-level theories have not yet been exhausted. In summary, these books represent ambitious interdisciplinary contributions on an important topic, and they include unique and useful data; however, they do not make a convincing case that the evolution of human cooperation required group selection.  相似文献

One reason that regulation is difficult is that repeated encounters between regulator and regulatee are rare. We suggest diplomacy as a model for reconfiguring regulatory institutions in response. Ambassadors for Regulatory Affairs who would be agents for all state regulatory agencies could be based in most large firms and small and medium enterprises that pose unusual regulatory risks. In rural towns, police would be trained as regulatory ambassadors. Just as a US Secretary of State can launch a “diplomatic surge” in Myanmar from 2009, so regulatory surges are possible in market sectors of high risk or high opportunity. We propose strategies of indirect reciprocity as a way in which reciprocity that is only episodic in these strategic ways can promote more general responsiveness. Indirect reciprocity is reciprocity that we do not personally experience, but learn from the experience of a culture. This means that so long as we sustain regulation as a relational as opposed to a purely technocratic process, indirect reciprocity might civilize regulatory compliance in an historical process informed by the theories of Elias and Putnam.  相似文献

In the era of globalization, commercial transactions readily gain international dimensions and are increasingly delocalized. With a view to establishing effective dispute resolution mechanisms, it is desirable that judgments rendered in one state be recognized and enforced in other states. This is especially important in East Asia, as cross-border business activities are rapidly expanding along with its economic growth. This paper aims to examine the recognition and enforcement of judgments in civil and commercial matters in East Asia with a focus on Sino–Japanese relationships, where the establishment of a reciprocal relationship has posed a considerable challenge. It is worth considering how we can gradually pave the way towards the mutual recognition and enforcement of judgments to achieve coordination among legal systems.  相似文献

This article discusses the rules for recognition and enforcement of foreign judgments in the Republic of Korea (hereinafter referred to as “South Korea” or “Korea”). Articles 217 and 217-2 of the Civil Procedure Act of Korea and Articles 26 and 27 of the Civil Enforcement Act of Korea provide for the recognition and enforcement of foreign judgments respectively. Korea has not entered into any bilateral or multilateral treaties regarding the recognition and enforcement of foreign judgments and is not a party to the Convention on Choice of Court Agreements. The article also considers the current undesirable status of recognition and enforcement of judgments in the region consisting of China, Japan and South Korea (hereinafter referred to as “Region”) and suggests a course of action to be taken to improve the situation. The author believes that the experts of the Region should embark upon a project to improve the current situation and that the first step should be to exchange and gather information on the current legal regime of the countries in the Region on the recognition and enforcement of judgments. The author looks forward to future cooperation among the experts in the Region on this topic and is confident that the reciprocity requirement, which currently is a major obstacle to the mutual recognition and enforcement of foreign judgments in the Region, will be overcome in the near future.  相似文献
