逆防卫质疑与犯罪人保护的思考

本文主要论证不法侵害人对防卫过当行为拥有逆防卫权的这一制度构想的缺陷 ,但同时强调了应保护不法侵害人的合法权益 ,对无限防卫权予以严格的限制     

学者钱钟书的读书与治学

钱钟书为中国现代文史大家,其读书、自学与治学的方法既成就其自身的学术事业,也嘉惠后学。钱氏读书与自学中虽兴趣广泛,中西兼顾,但也沙中淘金,择要而取;虽博闻强记,天赋异禀,但也手抄笔记,肯下硬功夫。在治学过程中,注重"瞥观疏记,识小积多",并持之以恒,终其一生。践行读书、自学与治学的方法与态度对于当代学者治学有很强的警示和借鉴价值。     

基层自治制度的理论阐述与路径选择

健全充满活力的基层群众自治制度,着力推进基层直接民主制度化、规范化、程序化是党的十九届四中全会决定的要求。通过开展基层社会治理体系和治理能力现代化研究,探索建立"自治、法治、德治"相结合的现代基层治理体系,加快形成共建共治共享的现代基层社会治理新格局。面对地方治理需求侧(社会公民的期望)与地方治理供给侧(地方政府能力)之间的落差,应摒弃地方政府与基层组织二元对立模式,建立全新的"分权、互动"基层自治的理论分析框架,将多元主体纳入地方治理体系来共同履行公共职责。通过借鉴国外的经验并经过创造性转化,为基层自治提供包括培养自治能力、培育自治组织、强化城乡社区自治协商、衔接居民自治与村民自治在内的充分而有效的制度供给。     

Use of Self in the Context of Youth Work

Used in the education of counselors, nurses, occupational therapists and social workers, “use of self” is a way of understanding how practitioners bring about human change. In this article, the author discusses how use of self can be applied to youth work and is related to “developmentally responsive practice” thereby providing a deep theoretical construct for understanding youth work as relational. The author concludes by presenting the barriers to the use of self paradigm in the current climate of assessment and accountability, designed to measure static inputs and outputs rather than dynamic systems or ecologies and presents a challenge to the field for designing methodologies that are equally dynamic, responsive and relational.     

NGO话语与民间妇女组织的自我认同

本文以西方主流NGO话语在本土的传播为路径,通过研究民间妇女组织的相关文献资料,归纳分析民间妇女组织领导者和参与者对自己组织的思考和社会角色定位,即他们的自我认同.分析认为,民间妇女组织自我认同在最近几年发生转变,即从关注妇女事业的民间妇女组织向关注公民社会发展的妇女NGO转变,这一转变与西方主流NGO话语在本土的系统传播密切相关.     

从警察被害谈警察自我防范教育——公安教育不容忽视的课题

本文认为当前社会治安形势仍很严峻,暴力犯罪特别是持枪犯罪非常严重,人民警察伤亡人数正在逐年增加.本文就警察被害的问题更多的从"被害人学"的角度出发,分析研究警察自身的疏漏,失误和过错以警察教育为基础,探讨警察被害与警察教育的关系,且对今后警校如何进行警察自我防范教育做了初步构想.     

义利关系:历史性与现代性

在当代多元化、差异性的社会中,“义”的“私德”性质淡化,“公德”性质突显,其内涵已不再局限于个体之“道义”,而根本上吁求社会与制度之“正义”。构建当代转型社会的制度之“义”,以最终实现“义利统一”的道德机制,成为传统义利观转型与发展的现代性视域。     

The law and the sublime: Rethinking the self and its boundaries

Christine Battersby has argued that it is Kant (and not Descartes) who provides the paradigm model of what it is to be a self in modernity. The Kantian self is established in opposition to its other. The body is commonly envisaged as a container, with selfhood as something that is defended against the outside. In contrast, she proposes a feminist reworking of such a model of selfhood, applicable to both men and women, in which the self and other emerge over time through patterns of relationality. This paper introduces Battersby’s work by focusing upon her early analysis of Kantian aesthetics, in particular the sublime. The aim is to draw out some of the legal and political implications of her work, particularly with regard to the common law’s developing conception of privacy. This is carried out by distinguishing her ontological position from the psychology of Carol Gilligan and then by considering the overlapping concerns of Jennifer Nedelsky in the area of legal theory.

Maternal Acceptance as a Moderator of the Relation Between Threat to Self Appraisals and Mental Health Problems in Adolescents from Divorced Families

Appraisals about the implications of stressful events that are evaluated as involving a threat to self (negative self-evaluation, negative evaluation from others, rejection by others) have been shown to place youth at risk for the development of mental health problems. This longitudinal study tested a protective-stabilizing interactive model, in which high maternal acceptance was predicted to mitigate the prospective relation between threat to self appraisals and change in adolescents’ mental health problems six months later. Participants were 89 adolescents from divorced families ages 10–12 and residential mothers. Adolescents reported on threat to self appraisals from the most stressful event experienced in the past month. Mothers and youth reported on maternal acceptance and mental health problems. Multiple regression analyses provided support for the protective effects of maternal acceptance on adolescents’ mental health problems. Intervention implications are discussed. She also has designed and evaluated the efficacy of preventive interventions for children from divorced families and children who have experienced parental bereavement. Jenn-Yun Tein is a research associate professor and Co-Director of the Research Methodology Core of the Prevention Research Center at Arizona State University, Tempe, AZ. Her research interests include analyses of mediation and moderation of preventive interventions as well as applications of methodology and statistics in prevention research. Irwin Sandler is a Regents’ Professor in the Department of Psychology and Director of the Prevention Research Center at Arizona State University, Tempe, AZ. His research interests focus on understanding resilience for children exposed to stress and on the development, evaluation and dissemination of programs to promote resilience and prevent mental health problems for children in stress.
