线形结构基础上之双三角结构:对我国刑事诉讼结构之再认识

我国当前刑事诉讼结构是以线形结构为基础,并由庭审前阶段以检察裁判权为中心的前三角结构以及庭审阶段以法院审判权为中心的后三角结构所构成,这种结构存在一些弊端。改革的思路应当是,变线形结构为基础为庭审阶段三角结构为基础,确立庭审中心论并继续加强审判职能作用,同时强化检察机关对侦、辩双方诉讼行为的监督。     

司法鉴定标准化实现机制探讨

司法鉴定标准化一直是司法鉴定理论界和实务界追求的理想。众多学者认为要确保司法鉴定的公信力,就必须设立司法鉴定标准,走标准化的道路。对于标准化的内涵有必要从标准的理论出发进行重新解读,并提出标准化的实现前提、实现过程及应关注的问题。     

诉讼诈骗定性相关问题探讨

理论界和实务中对诉讼诈骗行为能否构成诈骗罪存在认识分歧,从理论上解决这个问题并不存在困难,诉讼诈骗符合诈骗罪的客体要件,诈骗罪中被骗者、被害者、交付人不要求同一,被骗者应当具有处分权,被害者自愿交付不是诈骗罪成立的要件。     

Metric assessment of the "mastoid triangle" for sex determination: a validation study

Recently, a metric approach to skeletal sex determination was published by Paiva and Segre which is based on the summation of two triangular areas defined by three distinct craniometric landmarks: Porion, Mastoidale, and Asterion. According to the authors, values for the total triangle > or =1447.40 mm(2) are characteristic for male crania, while values < or =1260.36 mm(2) are indicative of female skulls (95% confidence). In order to evaluate the method's validity, two sex- and age-documented samples of different provenience were analyzed (N=197). The results show that while the indicated measurements display significant sex differences, the technique is of little practical meaning where a single individual must be independently classified. It is hypothesized that differences in the expression of sexual dimorphism as well as a population-specific variability of the asterion location undermine the value of the mastoid triangle as a sex determinant.

日本的对华外交深受国际体系和中美日三角关系的影响。由于中美两个大国在全球层面的战略竞争加剧,以2017年为分水岭,第二次安倍内阁领导下的日本的整体对华外交政策经历了从\"战略制衡\"向\"战术避险\"方向的转变。在2017年以前,日本为了联美对华实施\"战略制衡\",在外交方面,以\"印太战略\"孤立中国;在安全方面,加强岛屿防卫能力和强化日美同盟;在经济方面,大力支持\"跨太平洋伙伴关系协定\"和对\"一带一路\"倡议持冷淡态度。在2017年以后,在中美关系的不确定性增大的情况下,安倍领导下的日本对华实施\"战术避险\"。在外交方面,加强印太战略的开放性、领导人互访和对华自制;在安全方面,继续强化国防上的内部制衡;在经济方面,有条件地认同\"一带一路\"倡议并对华展开第三方市场合作。展望未来,令和时代的日本将是一个拥有部分战略自主的中等强国,在日美同盟框架下维持与中国有距离的交往,力图在瞬息万变的国际政治角力中实现日本国家利益的最大化。     

Calliphora vicina (Diptera: Calliphoridae) collected from a human corpse above 3400 m in elevation

In the summer of 2005 an adult hiker was killed in a fall in Rocky Mountain National Park, Colorado (U.S.A.). His body was subsequently colonized by the blowfly Calliphora vicina (Diptera: Calliphoridae). The body was discovered 9 days later at an elevation of 3475 m (11,400 feet). This is the first report of C. vicina on a human corpse at this elevation in Colorado. This paper provides additional confirmation of this fly colonizing a human corpse at high elevations in Colorado.

益气活血方对非ST段抬高型心肌梗死合并心源性休克患者血流动力学参数的影响

目的 研究益气活血方对非ST段抬高型心肌梗死合并心源性休克的血流动力学参数的影响。〖JP〗 方法 将24例患者随机分为治疗组和对照组各12例,均以西医常规对症治疗,治疗组加用益气活血中药汤剂胃管鼻饲治疗1周,比较两组患者治疗前、治疗3 d后及治疗1周后的心指数（cardiac index,CI）、中心静脉压（central venous pressure,CVP）、血管外肺水指数（extravascular lung water index,ELWI）、全心舒张末容积指数（end diastolic volume index,GEDI）、外周血管阻力指数（systemic vascular resistance index,SVRI）和平均动脉压（mean arterial pressure,MAP）的变化。 结果 治疗1周后,两组CI、SVRI、GEDI较治疗前显著升高（P<0.05）,ELWI较治疗前显著降低（P<0.05）;治疗1周后,治疗组CI、SVRI显著高于对照组（P<0.05）,ELWI显著低于对照组（P<0.05）;两组同时点CVP、MAP、GEDI比较,差异均无统计学意义（P>0.05）。 结论 在西医常规治疗基础上加用益气活血中药可改善非ST段抬高型心肌梗死合并心源性休克的血流动力学状况,其效应随治疗时间延长而增加。     

Iron triangle of the gong jian fa: Lessons from wrongful convictions in capital cases?

This article examines the iron triangle of the gong jian fa (police, prosecutors and courts) in China, based on Chinese lessons from high-profile wrongful convictions in capital cases. It argues that the iron triangle acts as both an administrative and a political control on such cases, behind which lies overly close cooperation between the three state institutions. This cooperation often results from coordination by local political-legal committees (PLCs). Under this institutional environment, the police, prosecutors and courts have to work together and cooperate with combating crime, without necessary restricts to ensure criminal justice even in capital cases. Responding to repeated occurrences of such typical injustices, China has promoted several waves of justice reforms to prevent and reduce wrongful convictions over the last ten years, but has failed to make substantive progress without effectively addressing the iron triangle. This continued failure calls for a holistic approach to future systemic reform. Particularly, specific measures are required to enhance judicial independence and to reduce intervention from local PLCs during the handling of individual cases. Such reforms would greatly reduce the risk of wrongful convictions in capital cases.
