民法中撤销权的检讨与建构

我国多部民事法律及司法解释规定了撤销权,但未形成统一的撤销权制度。通过对撤销权的类型化梳理,发现民法中撤销权存有诸多不合理之处,如未将撤销权与撤回权作区分,撤销权行使方式过于依赖司法权,撤销权除斥期间规定存有缺陷,制度设计未有效地平衡撤销权人、相对人及第三人的利益等弊端。对上述问题的检讨并促其改进,建构统一的撤销权制度,不仅于民法理论体系上使撤销权臻于完善,也有助于撤销权司法实务的推进。
