| 摘 要： | 自然权利论以自然状态中的人性为基础搭建起学说平台。其中,人自我保存的欲望和人之理性分别构成了自然权利的哲学基础和实现基础。人性基础使自然权利具有一种原生性,表明了自然权利不是来自人为的努力,也不是来自外在的授予。国家不能产生而只能承认自然权利,如果剥夺自然权利就意味着道德上的非正当性。因此,在政治社会中,即使有的权利未被列举和揭示,也会基于自然权利的固有性而被承认。这一理论对今天中国的人权法治建设仍不无启示。
