| 摘 要： | 巨额财产来源不明罪从出现之日,就引起学术界巨大纷争。该罪具有出现的必要性和科学性,但其存在的缺陷和不足是显而易见的。本文从犯罪构成、罪名及法定刑方面重新认识该罪,并提出完善对策,进行制度构建,以期抛砖引玉,与同行商榷。

| Abstract: | From the very beginning,the crime of holding a huge amount of property with unidentified sources has aroused Sharp disputes among the legal circle.Its Legislation is scientifically necessary but with obvious drawbacks and defficiency.This article reanalyzes this crime from its construction,name and statutory sentence,and also proposes measures of improvement. |
