从民事审判看中级、基层法院的司法运作

我国中基层法院在司法运作和司法管理方面呈现出行政管理的特点,与法院独立的要求相去甚远。本文从民事审判的角度,试图从中级、基层法院司法运作的现状、强化中级法院法制统一功能的微观路径选择,对中级、基层法院司法运作中存在的案件请示制度、管辖制度及上诉改判、发回重审制度进行初步研究,对两级法院固化的工作方式作合理性分析,表达从法院内部形成内生的、渐进的方式促进司法独立实现的意愿。从构思到成文的始终,笔者始终在思索美国法官最喜欢说的一句话:我们为什么拥有这么大的权力?因为我们始终谨慎地行使权力。
