| 摘 要： | 我国未来应当构建工伤保险、侵权损害赔偿以及商业保险的综合救济体系。在解决工伤事故时，应当由工伤保险提供主要赔偿来源，同时保留受害雇员获得民事赔偿的权利，将民事侵权赔偿作为补充来源，并以雇员所受实际损害为最高限额；同时积极发挥商业保险作用，鼓励企业投保雇主责任险和意外伤害保险，分散企业经营风险，实现对企业更全面保护。

| Abstract: | In modern society,the legal system of compensation for industrial injury, has developed from single compensation mechanism to compound compensation system,which covers the tort law,insurance law,labor law and social security law. In civil law,the researches of special torts are focus on medical accident,traffic accident,while in labor law and security law, the researches are focus on industrial security. There is no research on the balance of tort law and security law. The article focuses on the nature of industrial injury. , the four models of compound compensation system, the relationship between industrial tort liability and industrial injury security, the problems in theory and practice. At last it brings forward writer＇ s own opinion about the compound compensation system of industrial injury |
