| 摘 要： | 商业秘密作为一种无形权利，无法要求权利人防止常理以外的一切不测事件的发生。对于商业秘密的法律保护应以民事和行政手段为主，只有对性质较为严重的才可以犯罪论处，过失显然不符合这一条件。
