论民俗习惯在公安机关家事调解中的功能

调解是我国公安工作的优良传统,它是矛盾纠纷化解机制的重要组成部分和有效手段,在基层公安工作中发挥着重要作用。在家事调解的过程中,如何在遵循国家法律规定的前提下充分彰显民俗习惯在家事调解中的功能成为公安机关的关注焦点。为此,文章在梳理家事纠纷调解中民俗习惯基本特征的基础上,提出了家事调解中适用民俗习惯的基本原则,并进一步设计了充分发挥家事调解中民俗习惯功能的配套机制。
