| 摘 要： | 刑法中有关身份的问题极为复杂，尤其是当它与犯罪构成、共犯问题出现交叉时更为棘手。传统刑法理论只是在共犯论中稍带提及。笔者拟在对身份界定的基础上对身份在犯罪构成中的体系性地位和身份犯、亲手犯问题着重进行论述。
