| 摘 要： | 鉴于目前我国相关的法律法规对民办高校产权规定的模糊及冲突，导致民办高校产权不清晰，直接影响民办高校举办者投资民办高校的热情以及民办高校资源配置的效率，这也成为困扰民办高校发展的制度瓶颈。本文认为应该尊重产权属性的内在功能，在实现公益价值的前提下，把民办高校区分为捐资举办的民办高校和投资举办的民办高校，分别确定产权，保护投资人对财产的所有权和收益权。
