| 摘 要： | 目前我国民事纠纷解决机制存在效率低下的弊病,难以充分发挥其解纷功能.其中最明显的表现就是诉讼内外纠纷解决机制之间缺乏有效的衔接.应当在合理分流纠纷的前提下,分别建立人民调解制度、仲裁制度、行政处理及涉法信访等诉讼外纠纷解决机制与诉讼纠纷解决机制的有机衔接,达到诉讼内外纠纷解决机制的功能互补与良性互动.

| Abstract: | At present, the civil dispute solution mechanism in our country is inefficient to make full use of its functions of dispute resolution. The alternative dispute resolution mechanism can not link up with the civil action effectively is the most clear evidence. So, on the condition of reasonable tributaries, the organic link should be established respectively between the people mediation system, the arbitration, the administrative conciliation, the complaint letter and visits and the civil procedure to realize their complementary functions and the benign interactions. |
